Prepared for the Estes Valley Community by the Estes Valley Community Services Coalition Common Ground Committee September 2005 TOWN of ESTES PARK Inter-Office Memorandum August 9,2005 TO: Public Works Committee U- FROM: Bill Linnane SUBJECT: Fish Creek Trail Phase 3 - New grant awarded April 2005 and approved by Town Board Background: The Colorado Department of Transportation (CDOT) awarded the Town an "Enhancement Grant" of $160,000 for the third phase of the Fish Creek Trail (Lakeshore Drive/Carriage Hills Ponds area). The Town match is $100,000. The Design and Construction Management Scope will be in the revised budget since the grant notification was not received until the first quarter of 2005. The Town solicited Des/CM Scopes and received two bids: • Cornerstone Engineering .................................. $46,885 4 • Van Horn Engineering ....................................... $39,695 The tentative schedule is to advertise for bids for the construction during the fourth quarter of 2005 or the first quarter of 2006. Cost/Budget: Cost: Van Horn Engineering $39,699 Budget: 2005 Larimer County Open Space - Trails.......... $100,000 Action: Staff recommends approval to award the Scope to Van Horn Engineering at a cost of $39,695. The Estes Valley Recreation and Park District and the Golf Course have no problem with the 15-ft. long easement. Cost/Budget: N/A Action: Staff recommends approval. Box 1200 Estes Park, CO 80517 RE: The Links ofEstes Park _ Sewer Line Easement Dear Committee Members: Bud and Rachel Jarvis managers of The Links of Estes Park, Inc. respectfully request the Public Works Committee to review and recommend approval ofa 15' wide sewer line easement that crosses a small portion of the Estes Park Golf Course. Currently the Community Development Department and Town staff are reviewing a proposed development of six condominium units on the Jarvis property, ' A portion ofLot3 Saint Vrain Addition '. Located on the property today are three small duplex cabins that are served by a septic system built many years ago. With the new development proposed connection to a proper sanitary sewer system is required by code. The portion of the golf course that will be crossed is a short distance to an existing manhole along Upper Thompson Sanitation's sewer main. Cornerstone Engineering and Surveying, Inc. ( CES ) has met with the Estes Park Golf Course Superintendent, Brad Doggett, and it was determined that disturbance of the area in question would not have any adverse effect to the Golf Course. Accompanying this correspondence is a copy of an Easement Grant form, an exhibit depicting the legal description of said easement, and a letter by the Director of Estes Valley Recreation and Park District affirming Mr. Doggett's assessment. EASEMENT GRANT FOR VALUABLE CONSIDERATION, the receipt and sufficiency whereof is acknowledged by receipt of $1.00, the Town ofEstes Park, a Colorado Municipal Corporation, its successors and assigns, hereinafter referred to as GRANTOR, does hereby grant unto Byford D. and Rachel Jarvis managers ofThe Links ofEstes Park, Inc. and their successors and assigns, hereinafter referred to as GRANTEES, an easement for a sewer line with the right to construct, maintain, inspect, operate, repair, replace and remove such sewer line. Said sewer line shall be for the transmission of sewage under and through the property described on Exhibit A attached hereto. GRANTOR hereby grants unto GRANTEES the right to access to said easement and the right of ingress and egress on and over the property shown and described on Exhibit A. The following conditions for the easement shall be in place: 1 The easement shall be 15.0 feet in width. 2 The sewer line shall run along the line designated by Exhibit A-1. Upon completion of its construction, repair, or maintenance work, the GRANTEES shall restore such property, as is affected to substantially the same condition as existed prior to such work. 3 GRANTOR reserves the right to use and enjoy such described propeny so long as such use and enjoyment does not interfere with the rights herein granted to the GRANTEES. 4 The rights herein granted may be assigned in whole or in part, and the terms, condition, provision of this easement grant shall extend to and be binding upon the heirs, personal representatives, successors and assigns ofthe parties hereto.
