L TOWN of ESTES PARK Inter-Office Memorandum October 15, 2002 TO: The Public Works Committee FROM: Bill Linnane ~~---0 SUBJECT: Fall River Trail - Phase 1 Project Background: General Discussion: Two bids for the Fall River Trail - Phase 1 Project were received on Thursday, October 10. Those bids are: CONTRACTOR BID AMOUNT Mountain Contractors Inc. $248,589.50 G.L. Hoff Construction $290,37264 (Background and discussions continued on Page 2) Cost/Budget Budget $268,000 Cost Mountain Constructors bid $248,589.50 Valley Road extension 38,000.00 Willows Condos Section (deduct) -10,000.00 Sub-total: $276,589.50 Contingencies @ 6%: $16,000.00 Estimated total cost $292,600.00 The $24,600 over-budget amount could be funded from the Community Reinvestment Fund. Action: Staff recommends approval of Mountain Constructors bid and beginning the project west of the bridge and ending it at Valley Road at an estimated cost of $292,600. The remaining trail portion between Performance Park and the bridge could be constructed in 2003 at a cost of $80,000, if approved in the budget process. 1-1 (Background and discussions continued from Page 1) The original bid design proposed to end the Phase 1 section between James Street and Valley Road (refer to the attached sketch). After further review, Staff is recommending that this first phase of the trail should end at Valley Road. This would provide a logical and safer connection to the Town's roadway system and the West Wonderview Bypass. The cost of the additional extension is estimated at$38,000. The original bid design also proposed to begin the trail in front of the Willows Condos, in an existing trail easement The cost of that section of trail is estimated at $10,000. This section could be postponed to help offset the $38,000 extension cost Willows Condos Easement Discussion: The Willows Condos owners have requested that the trail be relocated to the CDOT RO.W. Mountain Constructors offered an "add-on" of $70,710 to build a trail within the CDOT RO.W., which includes a 56-foot x 12-foot prefabricated steel/wood plank bridge. The Willows Condos have offered $15,000 to offset this trail relocation cost This offer is not acceptable to Staff. Please refer to the attached sketch for the following discussion. The Willows Condos and the Fall River Village Trailer Court properties are important trail links to the Performance Park Project Since there has been no agreement reached with the Willows property owners and since the easement across the trailer court property is still under negotiation, the proposed Fall River Phase 1 Trail logically could begin just west of the bridge. The $10,000 Willows portion of the trail could be better utilized to offset the previously mentioned $38,000 extension to Valley Road. Proposed Alignment of the Trail: With all of this said, Staff is proposing to begin the project adjacent to and west of the bridge and end it at Valley Road. The additional cost to the bid is estimated at $28,000 ($38,000 extension minus $10,000 Willows). The trail section between Performance Park and the bridge which crosses the Willows Condos and the trailer court properties could be budgeted and constructed in 2003. The cost is estimated at $80,000. The bid opening was held on Thursday, October 10,2002 at the office of Cornerstone Engineering & Surveying, Inc. (CES). Bids were received from two contractors for the project. The results of the bidding contractors and bid amounts are listed below: Contractor Bid Amount Mountain Constructors, Inc. $248,589.50 G.L. Hoff Company $290,372.64. Included in the bid was the additional work for the alternative trail alignment around the Willows Townhomes at 300 Farview Drive. The alternative alignment included the additional item necessary to relocate the trail in the highway right-of-way with the addition of a pedestrian bridge. The result ofthe contractor bids for the alternative alignment are as follows: Contractor Bid Amount Mountain Constructors, Inc. $70,710.00 G.L. Hoff Company $94,382.00 Unit price extensions for the bidders have been verified by CES. There have been no apparent irregularities in the bid process or in the bids received. If Trust is ever required to pay any taxes or assessments on its interest in the Property, Town, or its successors, will reimburse Trust for the same. (b) Unkeep and Maintenance. Town shall .continue to be solely responsible for the upkeep and maintenance of, the Property. Trust shall have no obligation for the upkeep ormaintenance of the Property. 6. HOLD HARMLESS. Town, to the extent allowed by law, shall indemnify, defend, and hold Trust and its members, officers, directors, employees, agents, contractors and permitted assignees (collectively, the "Indemnified Parties'I) harmless from and against any and all liabilities, penalties, costs, losses, damages, expenses, causes of action, claims, demands, or judgments, including, without limitation, reasonable attorney's fees, arising from or in any way related to: (i) injury to or the death of any person, or physical damage to any property, resulting from any act, omission, condition, or other matter related to or occurring on or about the Property, regardless of cause, unless due solely to the negligence or intentional acts of any of the Indernnified Parties; (ii) the obligations specified in paragraph 3 and subparagraphs 5(a) and 5(b) above; (iii) the costs and expenses of Trust in enforcement of this Agreement; or (iv) the presence or release by Town or persons under the direction or control of Town of hazardous or toxic substances on, under or about the Property.
