TOWN of ESTES PARK Inter-Office Memorandum DATE: October 16, 2001 TO: Public Works Comwittee FROM: Bill Linnane ll-/ B- SUBJECT: Citizen request to ban on-street parking on Aspen, Birch, and Columbine Avenues ("Hill Streets"). Background: The Mayor received the attached letter dated August 28, 2001 from Patrick Cipolla, 632 Aspen Avenue, requesting that the steep portions of Aspen, Birch, and Columbine Avenues be posted as "No Parking." The letter cited a safety concern for children walking along the streets. The letter also mentioned particular on-street parking adjacent to 403 and 520 Aspen Avenue. The Mayor asked that I report to him on this request I researched the request and responded with my attached memo. The response memo recommended against banning on-street parking because: 1) It will increase traffic speeds. 2) It will relocate on-street parking to surrounding neighborhoods. 3) Excessive on-street parking was and is not a daily problem. (Background - Continued on Page 2) Cost/Budget N/A Action: Staff recommends continuing to allow on-street parking on the "hill *Yeets." Staff will respond to individual problems associated with on-street parking on a case -by-case basis. 1-1 Background - Continued#om Page 1 The Mayor relayed my memo to Mr. Cipolla who responded with the attached additional letter to Mayor Baudek, dated September 24, 2001. He cited that his original letter of request was actually a result of suggestions to him by EMT drivers. Therefore, he has asked that the request be revisited. Similar to the no parking request on MacGregor Avenue, the adjacent property owners have been notified of this Public Works Committee agenda item via door hangers. As a result of Mr. Cipolla's second letter, Greg Sievers contacted a sampling of the EMT drivers and a few of the contacts living on these hill streets. One driver that lives on Aspen Avenue mentioned that the old tenants of 520 Aspen Avenue routinely parked on the street It was also brought to our attention that a truck has been parked in front of 405 Aspen Avenue for at least six months. The Public Works Department informed the Police Department of the vehicle; the truck was "red-tagged" this past Monday, and as of this date is off of the street I still stand behind my original memo and recommend continuing to allow on- street parking. I recommend that the Public Works Department work with the residents as well as the EMT drivers and respond to individual situations such as those mentioned above. First of all, I think this issue needs to be re-visited. I originally submitted this request at the suggestion of certain EMT drivers. I knew what the result would be since it was me suggesting this. According to the EMT, one female driver has called in this problem to the police on at least 3 different occasions this summer. It is hard for them to manuever and understandably so. I also showed interested individuals the response letter from Mr. Linnane. Secondly, speed is not the issue (otherwise we wouldn't have 4 or 5 lanes highways here) - but safety is. Thirdly, at the time I said 520 Aspen, there were at least 5 vehicles there everyday. Since then, the lower apartment (the house is rented out at the bottom part) has been vacated. As for 403 Aspen, my error. It should have read 405 where at least 2 large vehicles are parked everyday. Lastly, if Bill Linnane thinks speed is the problem, ask him to talk to the EMT people! TOWN OF ESTES PARK Inter-Office Memorandum DATE: September 11, 2001 TO: Mayor John Baudek FROM: Bill Linnane (/ ~-~ Public Works Director SUBJECT: On-street parking on Aspen, Birch and Columbine This memo is in response to the letter from Patrick €ipolla you received requesting that there be no parking on the steep grades of Aspen, Birch and Columbine Avenues. Mr. Cipolla's opinion is that the cars parking on the steep grade cause a dangerous situation when children are walking on the road. He also stated that between four and seven vehicles are periodically parked on each of the steep grades of 403 Aspen and 520 Aspen. Greg Sievers and I drove the area at least three times after receiving a copy of the letter. At no time did we witness a large number of vehicles parked on the street Also, an acquaintance of mine lives at the top of Aspen and has informed me that occasionally on-street parking can be a nuisance, but it is only occasionally. He states that when there is an abundance of on-street parking, cars do tend to slow down. Neither 403 Aspen nor 520 Aspen had more than two cars parked adjacent to them. The cars in front of 403 & 520 Aspen were parked off-street. It is interesting because 403 Aspen, a house under construction at the southwest corner of Stanley Avenue and Aspen Avenue, is on a moderate slope of approximately 6% to 8%, similar to many othef town streets. In the past the Town has banned on-street parking in front of multi-family apartment complexes and for situations such as when the parking interferes with. a pedestrian trail/route or when safety is improved by the ban. 1-4 9. 4 , I cannot recommend banning on-street parking for the following reasons: 1) My opinion is that vehicle speeding is the number one safety concern for children walking on any roadway. Banning on-street parking will not decrease vehicle speeds, but may actually result in the increase of vehicle speeds. Proven design standards indicate that narrow roadway travel widths reduce vehicle speeds. I've attached a page out of the "Oregon Bicycle and Pedestrian Plan" by the Oregon Department of Transportation defending my opinion that banning on- street parking may actually increase traffic speed. 2) The slopes of Aspen, Birch and Columbine Avenues are from 12% to 15 % at their steepest Driftwood, which was not mentioned in the letter, has a slope of +20% at the steepest If we ban on-street parking on these streets, we will be relocating parking to the other adjacent streets and neighborhoods. I don't recommend that. 3) Excessive on-street parking was not evident when the Public Works Dgpartment inspected the area on three occasions. There were only a few cars parked on the steep sections of the hill streets. I must add that in mf opinion, on-street parking may not improve snowplowing safety and may not improve the visibility of children, but it will reduce traffic speeds. Excessive traffic speeds are the number one danger to pedestrians. (EC: Rich Widmer BL/mjs 1-5 . 160 ' II.9. TRAFFIC CALMING A. REDUCING The hump is designed with a reversing curve at TRAFFIC SPEEDS each end, and a level area in the middle long enough to accommodate most wheelbases. PHYSICAL CONSTRAINTS ,/9.12.139,- -- a t A.1.a. Narrow Streets or Travel Lanes Narrow cross-sections can effectively reduce speeds, as most drivers adjust their speed to the available lane width. I will fonvard your letter to Mr. Bill Linnane, the Public Works Department Director. I would think that this issue has come up before. I would also think that the majority of residents on these streets would be opposed to any parking restrictions, especially if they have numerous vehicles. I will have Mr. Linnane review the situation and forward a report to me. If some action might be warranted, the issue can be put on the Public Works Committee agenda for their recommendations. I will keep you informed of the status of what is occurring. Thank you for taking the time to bring a potential safety situation to my attention. The attached existing and proposed floor plans will give you a general idea of the project scope. (Continued on Page 2.) Cosl/Budget Cost Westover Construction Dispatch Office Remodel $78,468 Contingencies @ 10% 7,840 Alarm system (not to exceed) 10,000 Total: $96,308 Budget $80,000 The Police Department budgeted line items for vehicle equipment and radio equipment that could easily be adjusted to accommodate the $16,308 excess. Action: Staff requests approval to award the bid to Westover Construction and fund the estimated $16,308 excess from the vehicle and radio equipment budget line items. 3-1 Background: (Continued from Page 1) The project consists of: 1. Converting the two men's and women's restrooms into one public women's restroom and one private Dispatch unisex restroom. 2. Adding a kitchenette sink and counter to the general space. 3. Adding an equipment room with an air-conditioning unit for equipment. 4. Relocating the existing conference room. 5. Miscellaneous demolition, drywall, HVAC, cabinet, carpet electrical, and other work. The staff also budgeted to hardware a Dispatch alarm system from the reception desks in the Administration, Public Works, Finance, and Police Department offices. Staff solicited bids and received two bids on October 2nd. The bids did not include the alarm system. This scope will be unknown until the demo work is complete and the low bidder's electrician can have a better idea of the required work. The bids received are attached and the results are as follows. REZONING & FINAL PLAT FOR THE HABITAT SUBDIVISION, A PORTION OF LOT 33, BONNIE BRAE SUBDIVISION, HABITAT FOR HUMANITY OF ESTES VALLEY/APPLICANT. Mayor Baudek opened the public hearing. Community Development Dir. Joseph presented the Staff Report, noting that the Town Board previously approved the Final Plat, however, the need for a rezoning hearing was overlooked, thus this item must be revisited. The rezoning request is from R-2 to R-1 to create four 6-7,000 sq. ft. single-family lots restricted for attainable housing. The required deed restriction assures the availability of the units for sale or rent to persons meeting the income guidelines for no less than 20 years. The Planning Commission recommended approval. Bill Van Horn, Habitat Representative, stated that considerable discussion was held at the Planning Commission, however, the land use "stands on its own merit." Town Attorney White read Ordinance #13-01 zoning the property R-1 Single-Family Residential Zoning. The Ordinance includes an emergency clause. There was no additional testimony, thus Mayor Baudek closed the public hearing, and it was moved and seconded (Newsom/Gillette) Ordinance #13-01 be approved and the Final Plat be reaffirmed, and it passed unanimously. 5. LIQUOR SHOW CAUSE HEARING - (1) APPROVAL OF STIPULATION AGREEMENT & (2) FINDINGS AND ORDER OF SUSPENSION FOR DEER RIDGE, INC., dba NATIONAL PARK VILLAGE SOUTH (COUNTRY SUPER MARKET). Police Chief Richardson reported that following a meeting with the Licensee, staff prepared and executed a Stipulation Agreement. Inthe Agreement, staff is recommending a standard 21-day suspension of the 3.2% Retail Beer License, with the actual time served of 7 days from 12:01 a.m. Thursday, October 1101 through 11:59 p.m. Wednesday, October 17111. The remaining 14 days will be held in abeyance for one year from the date of the "Findings and Order of Suspension." It was moved and seconded (Gillette/Doylen) the following be approved: (1) Stipulation Agreement, and (2) the Findings and Order of Suspension, and it passed unanimously. u'S 6. BOARD ROOM REMODELING PROJECT - AUTHORIZATION TO PROCEED WITH DESIGN. As noted at the September 11 th Town Board meeting, this item Ia) was returned for consideration. Town Administrator Widmer advised that Chief Richardson, Judge Brown and he met and, with minor floor changes, an official Court space has been provided in the Police Dept. Randy DeMario/Heath Const. presented the final preliminary cost estimate of $766,310. Trustee Doylen questioned whether the benefit from Heath mobilizing with the Library Project remains in place, and Mr. DeMario confirmed that the Town is realizing a savings of approximately $25,000. Mayor Baudek was assured that the $766,310 cost was firm, pending any change orders initiated by the Town. Should the final GMP be significantly increased, the Town would have the ability to amend the project. Trustee Habecker stated that the cost figures do not appear out of line. Roger Thorn stated that the $766,310 figure is only for the Board Room remodel, and that he is seeking a decision on the additional Police Dept. minor remodel. Judge Brown commented on the staff meeting that addresses his security, and records stofage concerns. Trustee Doylen added that the existing room does not meet audio-visual needs of the physical audience and television audience, and there is poor ventilation, and sound. George Hockman questioned the future use of the existing Board Room and Administrator Widmer responded that the room could be used as a training/meeting room and perhaps future office space. It was moved and seconded (Gillette/Jeffrey-Clark) the Town proceed with the Town Board Remodeling Project for a Preliminary Guaranteed Maximum Price of $766,310, with the architect's fee for the Squad Room design to be obtained and submitted to the Town Board for further consideration, and it passed unanimously. 7.
