Hwy. 36/7 Project CDOT asphalt maintenance & project update TOWN of ESTES PARK Inter-Office Memorandum June 13, 2000 TO: Public Works *In~littee FROM: Bill Linnane (v,i/t~ SUBJECT: Upper Thompson Sanitation District (UTSD) Utility Request BackgrOU.nd: The UTSD was required to relocate a sewer line during the Hwy. 36 CDOT project. The Town staff allowed UTSD to relocate it just north of the bridge on Town-owned land since the original location was also on the Town-owned property and within close proximity of the new location. Cost/Budget: N/A Rprnmmpnolatinn Staff recommends approval of the easement request. BL/lb Attachments 1-1 EASEMENT GRANT (revised 3/1/95) FOR VALUABLE CONSIDERATION, the receipt and sufficiency whereof is acknowledged Town of Estes Park hereinafter sometimes referred to, whether one or more, as GRANTOR, does hereby grant unto the UPPER THOMPSON SANITATION DISTRICT, its successors and assigns, hereinafter referred to as DISTRICT, an easement for a sewer pipe, (hereinafter referred to as pipeline), with the right to construct, maintain, inspect, operate, protect, 0 repair, replace, relocate, change the size of and remove, such pipeline, together with such other rights, for the transmission of sewage on, under and through the property described on Exhibit "A" attached hereto, such easement indicated thereon as construction easement being for the purpose of installing such pipeline and such easement indicated thereon an the permanent easement being for the purposes described above after installation. GRANTOR warrants that lie is the owner in fee simple of said property and is authorized to grant this easement. GRANTOR hereby grants unto DISTRICT the right of access .to said easement and the right of ingress and egress on or over the property described on Exhibit "A" for any and all purposes necessary and incident to the exercise by said DISTRICT of the rights granted liereunder and further grants unto DISTRICT the right at any time to Construct and maintain additional pipeline or pipelines within such described property under the same terms and conditions as the initial pipeline is constructed and maintained. GRANTOR reserves the right to use and enjoy ouch described property so long as such use and elljoyment does not interfere with the rights herein granted to tlie said DISTRICT. GRANTOR specifically agrees not to build, create, or construct any obstructions or structures over or within said easement, plant trees or impound any water thereon, nor permit the same to be done by others without the written consent of DISTRICT. Such consent, in regard to fences, non concrete roads or parking areas, and similar uses will not be unreasonably withheld if the DISTRICT determines that the same will not interfere with its rights hereunder. '1'he rights herein granted may be assigned in whole or it-1 part, and the terms, conditions, provisions of this easement grant shall extend to and be binding upon the heirs, personal representatives, successors, and assigned of the parties hereto. page 1 of.3 1-2 - Upon completion of the construction, repair or maintenance work DISTRICT shall restore such property, except trees and shrubs, as is affected to substantially the same condition as existed prior to such work. ' Any grant, warratity, agreement, reservation or other covenant contained herein, insofar as each individual GRANTOR is affected, shall be considered as pertaining only to that portion of such described property which is claimed to be owned by the respective signers hereof, as indicated by the Larimer County, Colorado, real property records or otherwise.
