The easement would lessen the impact to the private owners of the Ranch Meadows Subdivision to the south and would allow an electric line to be "looped" along the east line. Please refer to the attached location sketch and letter from Bill Van Horn for a more detailed description of the request Town Attorney Greg White has reviewed the request and does not foresee any legal problems with the granting of an easement Budget/Cost N/A Recommendation: Staff recommends approval of the request since it would lessen the impact to private and public property. Box 1200 Estes Park, CO 80517 Dear Bill, Pursuant to recent conversations, I am requesting on the behalf o f Gary and Sharon Nordic, that the Town grant a ten (10) foot wide utility easement along the east boundary and south boundary of the open space now owned by the Town in the easterly portion of The Reserve, 2nd Filing. Sewer service for The Reserve was originally designed with two connections going through Ranch Meadows Subdivision to minimize the length of line. These areas of Ranch Meadows are now built out and significant site improvements will be disrupted by the sewer construction. The proposed change will result in more length of main but will eliminate digging up the Town street and the installation of an additional man-hole. The change has been approved by UTSD. A need has also arisen for an electrical easement along a portion o f the east line o f the subdivision to provide for a looping of the system. The enclosed description is for a general utility easement along the entire east and south boundaries of the open space. The areas we address have been either by citizen request or by Street Department review and traffic analysis. In an effort to be attentive to the safety concerns of citizens, motorists and pedestrians, we have addressed the most critical or obvious areas first. These usually include steep drop-offs, ravines, switchbacks and obstacles. Ideal Fence Company of Erie, Colorado, is one of the few guardrail specialists located along the Front Range. For the past four years they have been working with Engineering staff closely and have produced a high-quality product. They have offered the following prices: 1. Fall River Estates, various locations. 932 linear feet plus end treatments $17,563 2. Upper Columbine and other miscellaneous locations. 7,437 Total: $25,000 Budget/Cost: Budget: $25,000 Cost: $25,000 Recommendation: Staff requests to purchase the installation of guardrails for a total of $25,000 from Ideal Fence Company. This year guardrail and handrail improvements are scheduled for the bridges at Old Ranger Drive and East Riverside Drive across the Big Thompson River. Maintenance to various bridge abutments is also scheduled. Inspections during May will determine the exact locations. Ideal Fence Company, Erie, Colorado, has been the general contractor for the Town's previous guardrail and handrail projects and its work has been very good. It is one of the few companies along the Front Range that has shown interest in the Town's relatively small guardrail projects. Ideal Fence Company has submitted prices for the project Budget/Cost Budget $30,000 Cost Old Ranger Drive Bridge $12,150 (Ideal Fence Co.) East Riverside Drive Bridge 7,421 (Ideal Fence Co.) Misc. Abutments & Maintenance 10,000 (Contractor to be determined) Total: $29,571 Recommendation: Staff recommends approval of Ideal Fence Company's price of $19,571 and $10,000 for abutment work, with the abutment contractor to be determined. PO BOX 1200 ESTES PARK, CO 80517 Re: Fall River Bridges Dear Bill: You have requested that I give you a legal opinion concerning the eight bridges located on Fall River that were constructed after the 1982 Lawn Lake flood. These eight bridges are listed as follows: Fall River Village Four Seasons Colonial Deer Crest Pine Haven James Mcintyre Ponderosa Kanemoto In reaching this legal opinion, I have reviewed the following documents: 1. The Town's file with regard to the application for the $400K HUD Imminent Threat development grant. 2. Grants of Easement from the Property owners to the Town to allow construction of the bridges. 3. Letter dated September 8, 1993, to the Colorado Department of Transportation from Greg Sievers. It is my opinion that the bridges are private bridges and not property of the Town of Estes Park. In arriving at this opinion I have considered the following factors: 1423 West 29th St. (970) 667-5310 Loveland, CO 80538 Fax (970) 667-2527 1. Prior to July 15, 1982, all the bridges were private bridges providing access to private properties. The private property owners have not dedicated the bridges to public use nor granted any public access to or over the private bridges. 2. There is no requirement in the grant application, grant acceptance, nor any correspondence which indicates it was a requirement for the grant that the bridges following construction be public. Although there were some statements made in 1983 concerning this matter, it does not appear to be a requirement of the federal grant. The following quote in The Trail Gazette article dated November 24, 1982 states as follows: "Kistner ( Bob Kistner, FEMA Disaster Recovery Manager) explained that the Town may have to own the bridges if HUD money is used to replace them. If that were the case, the Town would then lease the bridges back to the current owners. "But I'm not sure of that yet-I'm still trying to get a legal opinion on it," Kistner sid Monday afternoon." 3. Following the construction of the bridges, the property owners did not execute any documents conveying the bridges and any access rights to the bridges to the Town of Estes Park. 4. The letter of September 8, 1993, from Mr. Sievers to the Colorado Department of Transportation confirms ownership of the Town of Estes Park. That letter was written without consultation with me with regard to the legal question of bridge ownership. I believe this misstatement with regard to ownership of the bridges in the September 8,1993 letter relates back to certain statements made in the grant application which stated that the Town would institute a special improvement district in order to finance the construction of the bridges. Such a special improvement district would require public ownership of the bridges. However, a special improvement district was never instituted by the Town, as there was no necessity for recoupment of Town funds through that funding mechanism. 5. The bridges do not provide any public benefit to the Town or its citizens. Accesses to the bridges are private. Therefore, there is no reason the Town would wish to assert ownership in the bridges if the public cannot use them. 6. The Grants of Easement appear to be for the purpose of allowing the Town access to the site in order to construct the bridges. Those Grants of Easements do not convey to the Town ownership of the bridges once construction is completed. In fact, some of the Grants of Easement contain the following language: "together with the right of access along the route of Old Fall River Road, for vehicular and pedestrian traffic. Such access right is limited to that right of access, if any, which existed on July 15, 1982." Based upon my review of the above referenced documents and reasons stated in this letter, it is my opinion that the bridges are privately owned. The Improvment District to be formed by the Town would have the ability to issue special assessment bonds to finance the project. Along with designing a preventative maintenance program, I have contracted the services of Rocky Mountain Consultants to assist me in preparing our application for the DOT/Federal Bridge Funds and in planning future repair and reconstruction. I have discovered that the eight local private bridges have been excluded. Following the ftood of July 15, 1982, state eniergency money was acquired for the construction of these bridges. One requirement of that funding was for the Town of Estes Park to assume ownership and maintenance of those bridges. Due to the low volume of use on these bridges, they have remained in good condition. However, that determination is really the responsibility of a professional engineer. I have been in contact with Randy Haynes at Alpha Engineering Group, Inc. I understand that they may add these bridges to our report next year. This letter is to confirm the ownership and maintenance of the following bridges by the Town of Estes Park. All bridges are on the Fall River. Listed in order from east to west: 1.
