REF: Linda Moldry 1631 Avalon Estes Park, CO 805 ]7 Tel: (970) 586-5628 (leave message) I / TOWN of ESTES PARK Inter-Office Memorandum March 15, 1999 TO: Public Works Committee FROM: Bill Linnane SUBJECT: Citizen Request for Crosswalk Signage for a School Bus Stop at Avalon/Country Club Dr./Hwy. 7 Background: Mrs. Linda Mundry has requested that CDOT, Park R-3 School District and the Town have a beacon sign installed at the above location (please refer to the attached letter and location map). I spoke with Jeff Kullman, CDOT Safety Engineer, about the issue. The State's policy is that they refer such requests for school bus stop safety signage to the local school district. Tony Paglia, the Park R-3 School District Director of Transportation, and Mr. Kullman discussed the matter and have the opinion that a beacon sign at this location is not warranted. Mrs. Mundry has a grade school-aged child and lives on the east side of Hwy. 7. The school bus drops off the children on the east side of Hwy. 7. Mr. Paglia and the school bus driver, Mr. Howard Woodward, will attend the Public Works Committee meeting. Budget/cost N/A Recommendation: Staff recommends following the above CDOT policy and the Park R-3 School District's recommendation as stated above. Vacation Request and a Request for a Private Access Easement Background: On the attached letter to Mayor Bob Dekker, Mr. Jerry Lefebvre has requested that the Town vacate a 50' section of the R.O.W. adjacent to Community Drive and Mountain Golf Villas; refer to his sketch attachment and a copy of the various plats I have made notations upon. He has also requested that the Town dedicate an access easement across Outlot A, Mountain Golf Villas. 1) R.O.W. Vacation Request The 50' strip of R.O.W. was dedicated for public use when the Mountain Golf Villas was subdivided in 1993. The Planning Commission requested this R.O.W. to accommodate any possible future public road connection to Graves Avenue. Although the Town does not have any current plans for a connection, the future is difficult to foresee. The Town has a policy to recommend "vacations where there is absolutely no possibility of future need for the R.O.W. for either street or other access purpose," as quoted from the Town Attorney's legal opinion concerning R.O.W. vacation, attached. 2) Access Easement Request The Town does not have the authority to grant an access or any other easement on another's property, this case being the Mountain Golf Villas Home Owners Association property. Also, any driveway structures, etc., placed on this outlot would be a violation of the Town regulations that require open space to be left open. Budget/cost N/A Recommendation: 1) Staff recommends denial of the R.O.W. Vacation Request. 2) The Town cannot dedicate an easement on a property owned by another. BL/lb 1-1 - toU do 1/.,6 favyh€ .'ji - -- Sioux Falls, SD Ptult FEB 1 6 1999 February 12, 1999 pe-7 · Mayor Bob Dekker 170 MacGregor Ave. 1 Estes Park, CO 80517 Dear Bob, Due to the lack of cooperation from our neighbors over the years about connecting our property with a Town street, and because the existing 50' wide right-of-way can no longer adequately serve all the properties north of the 1992 realignment of Community Drive, Enid and I have submitted to the Planning Commission, and enclosed herewith, a drawing and copies of our "Easement end Right-cf-way Agreement" of 1975, and we ask you and the Town Council to exchange the existing right-of-way for the proposed right- of-way easement indicated on our drawing. Former Mayor Tregent told us repeatedly since 1975 that our existing right-of-way easement could never be a Town street to Graves Ave. Therefore, in 1992, I was glad to tell Mayor Dannels and his councilmen, at one of the meetings, that the Town had us in mind with the right-of-way that the plan- ners of Mountain Golf 7illas were setting aside for us. However, we soon were to be disappointed while communicating with all our neighbors in trying to agree with them on a road connection across the new right-of-way to the 3 U.6 new street; that's when we learned from our neighbor, Ms. O'Connor, and from Town officials as well, that the 50' width of the right-of-way was intended to preserve the large tree that stands on the right-of-way near the Lot 32 property line, resulting in the present road connection with the street that is less than adequate for the properties of Lot 33. 1-2 I h -2- And to make matters worse, in 1996, the Town planners never informed us of their plan to permit the single-family residence on Lot 33 west to be converted to a duplex, resulting in a private easement, the existing private easement indicated on our drawing, the easement which is now less than ade- quate to serve the residents of the duplex with the two-way road that is needed across the south portion of our property. The above Town planning resolutions have served only to devaluate our property, and they have failed to this day to serve all the properties north of the new alignment with the adequate road connection with Community Drive that all properties need to be served with. ke are very much concerned about the way our property is being encroached upon by the Town planners, so we ask you and the Town Council to understand our predicament, and to honor our request to be served with a permanent road connection to our Town street according to the existing easements that all the neighbors agreed to in 1975. It is the current policy of the Town to entertain requests for vacations of utility and street right of ways under the folloming conditions: 1. The propern- owner reimburses the Town for all expenses including legal expenses. 2. The utilin' easement or street right of way to be vacated is no longer needed for future use. In the case of utility easements, all public utilities are contacted to receive their approval of the vacation. 3. In the case of street right of ways, the Town only recommends vacation where there is absolutely no possibility o f future need for the right o f way for either street or other access purposes. Each vacation request is reviewed on its own merits. There is no legal precedent established by the Town in vacating any utility or street right of way with regard to future requests. Legally, the Town can change its policy at any time without any potential legal liability. One of the reasons for scrutinizing the request for street vacation is that once a street is vacated title to the vacated property returns to the contiguous property owners. In the event that the Town would then need access over the vacated street, the only means of acquiring said access, if access would not be voluntarily given by the then owners of the property, would be through the use of the Town's condemnation powers. PROPERTY OWNER REQUEST FOR TOWN TO VACATE THE UNPAVED PORTION OF PANORAMA ROAD RIGHT-OF-WAY. On behalf of the Lot 3, 4, 5, 24 and 25 property owners, Alan Aspinall requested the Town vacate that portion of Panorama Rd. lying between Summit Dr. and Otis Ln. as the road at this point has never been used for public or private access. The only exception is that the driveway of Lot 3 does now and has always encroached on this right-of-way. Lot 5 is unimproved and all lot accesses were confirmed. Mr. Aspinall is aware of staff's position, but he does not believe this portion of the road will be improved (paved) in the future. Director Linnane does not support the request as it departs from current Town policy of granting vacations for hardship cases (eg: structure encroachment into public right-of-way) and precedent-setting implications as future right-of-way vacation requests will point to this request and expect similar right-of-way vacation approval. Mr. Aspinall reported he had discussed his request with Town Attorney White, and the property owners do recognize they would be required to pay for legal expenses. While he understands staff's position, in his opinion, this vacate is not , precedent-setting as it is unlikely the portion of the roadway in / question Will be improved for a future road connection. 1 Following discussion, the Committee recommends following ~ established Town policy, thus denying the request, requesting ~ Director Linnane to obtain and distribute a legal opinion on \ precedent issues. 2. OWNER REQUEST FOR TOWN TO VACATE A 10' SEWER EASEMENT IN ARAPAHO ESTATES, SECOND FILING. In a memorandum dated March 31, 1998, Paul Kochevar, Estes Park Surveyors, reported that when Arapaho Estates, Second Filing was platted, a sewer easement was placed across the Lots 18 and 19 to serve lots on the south side of Cherokee Dr. The sewer line was not placed in this easement, opting to locate the line to the south. All sewer lines are installed and serving all lots in the Second Filing. Therefore, the owner is requesting vacation of the sewer easement. In a letter dated April 2nd from the UTSD, the District confirmed_they had no objection. The property owner will pay for all associated legal fees. The Committee recommends approval of the request, authorizing the Town Attorney to prepare an Ordinance. 3. FALL RIVER ESTATES/DEER MOUNTAIN ROAD RETAINING WALL PROJECT - REQUEST AUTHORIZATION TO PROCEED. There has been an overlay (repaving) program for 16 years. The last three years we have added programs that apply a maintenance surface course to streets that are generally in good condition, while others that are in poor condition still receive an asphalt overlay. We have had very good success with both Chip Seal and Slurry Seal. Due to the limited number of companies that provide these services and the prices that have been offered, we have hired both A-1 ChipSeal Company and Quality Resurfadng Company on an annual basis. These two products are similar in their type of surface treatment. Both supply excellent Ultraviolet protection, skid resistance and waterproofing. All of which extend the life of the asphalt. Both are non structural. We continue to have excellent results from both. Budget: $200,000 1999 Street Improvement Project. Subsequently it was discovered that the concrete window sills have some cracks and spalling and should eventually be sealed. The Public Works Department budgeted for this work in the 1999 budget. Staff solicited a price from Western Waterproofing to perform this work. This work will require mechanically routing out the cracks, placing a tooled bead of caulk and painting the sills with two coats elastomeric sealing paint. The One-Ton's limited plow width (maximum for truck size) and limited ability to carry sand (approx. two yards) makes it very difficult and time-consuming to plow cul-de-sacs. This truck has become undependable due to age and hard usage. The vehicle qualifies for replacement in accordance with the Town's Vehicle Replacement Policy. We would like to replace it with a budgeted Freightliner truck. The Freightliner would be a short-turning radius truck allowing better maneuverability in cul- de-sacs and close spaces. It would also feature a wider snowplow and the ability to carry 5 to 6 yards of sand. (Continued on page 2...) We spoke with our account representative, Sue Miller at Executone, in length on Friday, February 19, 1999 1. Why wasn't our 1992 Phone system Y2K compatible? a) The hard drive is not compatible with Y2K dating. B) They did not have the CPU developed until 1997(Gateway & Dell didn't either) c) all models up to 1997 are not compatible. 2. Have Executone done test on the older systems? YES. The phone and voice mail system does not have the comprehension to understand the date ending in 2000. 3. What would happen if we didn't upgrade? The phones and voicemail WOULD continue to work just fine. They would not be able to time and date any sent or saved voice mails. The phones would not display the proper date. Any data reports needed in the future would not be possible. For Example: The system has memory. We can produce usage reports. That means, if called upon, the system can produce details like: total number of calls coming in and going out; from each of our phone numbers or any extension. Any future upgrades we would like to install will not be possible until the system is upgraded. OTHER PERTINANT INFORMATION 4. The cost of this upgrade is Tixed'. There will be no further charges. It is a lump sum, for a turnkey product. 5. The L&P staff is researching an upgrade to a digital (T-1) service via a $45,000 revenue from a fiber optics lease payment. T-1 service results in a reduced rate per month in our line costs. The current phone and voicemail system will not be compatible with any upgrades of this nature. 6. L&P staff is also researching D.I.D. service. (Direct inward dialing) This will offer direct dialing from outside customer to an employee desk. Thereby reducing the switching through the operator. This service also requires Y2K compliant equipment. 7. Any future expansion, such as updated desktop units, or feature enhancement to our system will require Y2K compliant equipment. 8. Inevitably, there will be future system enhancements. Therefore, it would be cost emdent to upgrade at this time. • Page 1
