Box 1200 Estes Park, CO 80517 Re: Vacation of a portion of Panorama Road Dear Bill; I am acting in behalf of the owners of lots 3,4,5,24 & 25 of Stanley Heights Addition to the Town of Estes Park. We are asking that the Town vacate that portion of Panorama Road lying between Summit Drive (platted as Stanley Drive) and Otis Lane (platted as Crest Lane). We are all. of the property owners abutting this section of Panorama Road. The road at this point has never been used for public or private access, with the exception that the driveway of lot 3 does now and has always encroached on this right of way. We understand that the provisions of C.R.S. 43-2-302 control the procedure and resulting ownership. We understand also that any existing utility easements would be preserved. Thank you for your assistance in placing this matter before the Board of Trustees. The Town's current right-of-way vacation policy is to allow a right-of-way vacation for the hardship cases such as when structures encroach into public right-of-way putting a "red flag" onto Title insurance. When the vacation request is granted, the Town has requested right-of-way in exchange, if available, as compensation. Vacating right-of-way other than hardship cases sets a precedence that puts the town in an awkward situation of trying to foresee the future. If this right-of-way vacation request is granted, the next vacation request may use this as a procedure case for support. Granting this request could very possibly be the first step in changing the Town's policy from being strict with right-of-way vacation requests to being lax and allowing most vacation requests in the future. My professional opinion is that changing our policy is not in the general public's best interest BL/lp 1-3 . Box 1200 Estes Park, CO 80517 Re: Lot 18 and Lot 19, Arapaho Estates Second Filing Easement Vacation Dear Mr. Linnane: When Arapaho Estates Second Filing was platted, a sewer easement was placed across the above mentioned lots to serve lots on the south side of Cherokee Drive. The sewer was not placed in this easement. Another look at the best way to serve the lots to the south revealed that a line placed in Cherokee Drive was better. All the sewer lines are in and serve all the lots in the second filing. The owner would like to ask the Town to vacate the sewer easement as described on the attached Exhibit A . This area of road has received settling damage from underground springs for many years. Staff used Jim Nytes in 1995 to help determine a construction procedure and estimate quantities. That work will include rebuilding the rock retaining wall and the installation of an underground drain. We are requesting to proceed with this work without exceeding the budget by hiring Jim's Construction Materials Company to construct these improvements. This annual program addresses and provides street surface improvements, safety modification and roadway alignments changes throughout the Town. In recent years staff has expanded this program to include the application of polymer modified slurry seals and chip seals to extend the service life of street without the higher cost of complete overlays. These specialized fields are only available from a few western states companies. Listed below are the requested items, and attached is a list of projected streets to receive these products. 1. A-1 Chip Seal 35,000 Square Yards @ $1.25/SY = $43,750 2. Quality Resurfacing 50,000 Square Yards @ $1.00/SY = $50,000 3. Cornerstone Concrete Scott Avenue calmers Lump Sum = $10,000 4.
