VACATION AND DEDICATION J.lf,4 . 9*90 ORDINANCE NO. AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET KNOWN AS VIRGINIA DRIVE WHEREAS, the owners of the property abutting a portion of Virginia Drive have requested that the Town vacate a portion of this street as the buildings encroach on the street right of way; and WHEREAS, there is no longer any necessity to have public street access in the location of a portion ofVirginia Drive to be vacated; and WHEREAS, it is necessary to reserve public utility, access and drainage easements in the vacated street; and WHEREAS, the Board of Trustees of the Town of Estes Park has determined that it is in the best interests o f the Town to permanently abandon and vacate a portion of Virginia Drive, reserving public utility, access and drainage easements. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO. Section 1: The Board of Trustees o f the Town of Estes Park, Colorado hereby vacates a portion of Virginia Drive as more specifically described on Exhibit A attached hereto and incorporated herein by reference. Section 2: The Town hereby reserves over the vacated portion of Virginia Drive permanent public utility, access and drainage easements. Section 3: The Town surrenders any and all right, title and interest to the vacated portion of Virginia Drive, subject to the reservation set forth in Section 2 above. Section 4: This Ordinance shall take effect and be enforced thirty (30) days after its adoption and publication. Town Clerk AGREEMENT THIS AGREEMENT made this day of , 1998, by and between Sara B. Schultz ("Schultz") and the Town of Estes Park, Colorado, a Colorado corporation ("the Town'D· RECITALS WHEREAS, Schultz owns the following described real property within the Town of Estes Park to-Wit: Lot 4 and a portion of Lot 5, Block 10, Second Amended Plat, Town of Estes Park, Larimer County, Colorado, ("the Property"); and WHEREAS, two buildings ("the two buildings") located upon the Property encroach into a public street, Virginia Drive; and WHEREAS, Schultz desires that the Town vacate a portion of Virginia Drive upon which the two buildings encroach; and WHEREAS, the Town will agree to vacate a portion of Virginia Drive in return for dedication of a portion of the Property for a public street and other terms and conditions as more fully set forth in this Agreement. NOW, THEREFORE, in consideration of the agreements herein contained and other good and valuable consideration the parties agree as follows: 1. Schultz agrees to dedicate the Property described on Exhibit A attached hereto and incorporated herein by reference to the Town in the form acceptable to the Town. Upon receipt of said Deed of Dedication, the Town will vacate the portion of Virginia Drive as more fully set forth on Exhibit B attached hereto and incorporated herein by reference. 2. Schultz shall not make or cause to be made any substantial improvements to the two buildings, now located on the Property. "Substantial improvement" means all repairs, reconstruction and improvement of a structure, the total cumulative costs of which repairs, reconstruction and improvement exceeds fifty percent (50°/0) of the market value of the structures either before the improvement or repair is begun, or, if the structure has been damaged and is being reconstructed, before the same occurred. 3. Schultz shall be entitled to make improvements to the two buildings, in the form of remodeling, so long as said remodeling does not exceed fifty percent (50%) of the market value; does not extend or enlarge the structure into the vacated right of way and the Town has approved the remodeling pursuant to the Development Plan Review process of the Town. Schultz may also locate further improvements on the Property so long as said improvements do not encroach into the vacated right of way, violate any applicable set back requirements of the Town and are approved through the Development Plan Review process of the Town. 4. The covenants and agreements contained herein shall be binding upon all heirs, successors and assigns of the parties hereto and shall be a covenant running with Lot 4 and 5, Block 10, Second Amended Plat, Town of Estes Park and the vacated right of way set forth on Exhibit A. 5. This Agreement shall be recorded in the Clerk & Recorder's Office of Larimer County, Colorado. 6. Personal jurisdiction and venue for any civil action commenced by either party to this Agreement whether arising out of or relating to the Agreement will be deemed to be proper only if such action is commenced in District Court for Larimer County. 7. In the event that either party defaults under any of the terms and conditions of the Agreement, the non-defaulting party shall be entitled to maintain an action for specific performance and/or for damages incurred by said non-defaulting party. Said damages to include all reasonable attorneys' fees and costs incurred by the non-defaulting party. 8. Notices. All notices, certificates, or other communications hereunder shall be sufficiently given and shall be deemed given when delivered or mailed by certified or registered mail, postage prepid, addressed as follows: The Town o f Estes Park P.O. RECORD OF PROCEEDINGS Public Works Committee October 23, 1997 Committee: Chairman Doylen, Trustees Bakker and Hix Attending: All Also Attending: Public Works Director Linnane, Clerk O'Connor Absent: Town Administrator Klaphake Chairman Doylen called the meeting to order at 8:31 a.m. 311 VIRGINIA DR. - OWNER REQUESTS RIGHT-OF-WAY VACATION. Public Works Director Linnane reported that two structures of Highland Cottages, 311 Virginia Dr., Lot 4 and a Portion of Lot 5, Block 10, Second Amended Plat, Town of Estes Park, encroach into the right-of-way of Virginia Dr., and the owner is requesting the Town vacate the public right-of-way. William Schultz, property owner, stated that all structures have been in place since 1899 and various site photographs were displayed. Mr. Schultz stated there is no history of any problem with the right-of- way, and questioned the need for his request at this time as the roadway was constructed after the structures were in place. Trustee Hix expressed his doubt that the structures had been in place since 1899. Director Linnane noted that such encroachments are not unique. In 1991 the Town granted a similar request on Big Horn Dr. with the stipulation that an agreement be attached to the ordinance whereby in exchange for the vacation, the owner was prevented from performing any major remodeling, enlarging/extending the exterior of the buildings into the new easement, or constructing any additional buildings on the property. In addition, the owner was to pay for all attorney fees. A similar agreement could be attached to this request: the Town could vacate 1,600 sq. ft. of right-of-way in exchange for 1,500 sq. ft. of right-of-way to the north (this exchange would be in thebest public interest and protect adjacent property owners). The agreement would stipulate that should any major remodeling, demolition, moving of the buildings, or extension into the right-of-way occur, the right-of-way would return to its original location. Mr. Schultz disagreed with a stipulation concerning major remodeling of the buildings outside of the proposed vacated right-of-way. Staff stated that if the property owner is considering development of the site, a development plan would be required for submittal to the Planning Commission. The decision on the right-of-way would then be based on a recommendation from the Planning Commission. Adjacent property owner, David Frank, expressed his concern with the right-of-way and/or roadway shifting onto his property. Chairman Doylen confirmed that the roadway is not being changed in any manner, and the right-of-way is not being shifted in the direction of Mr. Frank's property. Discussion followed, with the Committee recommending: (1) staff meet with the Town Attorney to formulate an agreement, to include the - property owner paying for attorney fees, (2) staff review the 8RAOmMOPUSLISHING CO. RECORD OF PROCEEDINGS Public Works Committee - October 23, 1997 - Page 2 agreement with the property owner prior to a subsequent Committee ~d~---- meeting, and (3) the agreement be submitted to the Public Works Committee between January-March, 1998 for further consideration. SOUTH SAINT VRAIN AVE. (HIGHWAY 7) UTILITY EASEMENT - U.T.S.D. & MILES COTTAGES REQUEST EASEMENT VACATION. U.T.S.D. and Miles Cottages are requesting the Town vacate a 15'-wide utility easement over Lot 1, Hartland Subdivision, a Replat of Lot 7, South Saint Vrain Addition, and Lot 1, Esquire Acres Subdivision of Lot 8, South Saint Vrain Addition. All utility companies have signed ·' the routing slip, and staff is in agreement with the request. The Committee recommends approval of the vacation of the utility easement on South Saint Vrain Ave., authorizing the Town Attorney to prepare an ordinance. REPORTS . The Committee received the Citizen Service Response Report for September, 1997. Hwy. 7 Widening Project - Update. The new traffic signal should be installed early in November. The signal was ordered in April, and the manufacturer has delayed receipt of parts. Signs are being placed, including school zone signs with blinking beacons. Director Linnane commended Manager Sievers for his efforts on this State project. Chairman Doylen proposed an informational piece be placed on Channel 8 regarding use of the new turning lanes. Lake Estes Causeway Trail Project, Phase 2 - Update. The bridge for Wapiti Meadows should be installed next week; the abutments have been poured; and EVRPD Director Gengler and staff have walked the trail and a preliminary plan to completely encircle the lake has been accomplished. Trail markers will be installed in the next couple of weeks. A final design on the Mall Road section is being prepared. A mileage estimate for the entire trail is approximately 3.5 - 3.7 miles; staff will confirm-the distance for the next meeting. Employee Recognition. Street Supt. Speedlin reported that Public Works employees have entered various APWA-sponsored contests. Employees have had success in trucks, and this year, Michael Hulbert placed third in the nation (25 states/international) out of a field of 65 competitors in loader equipment. The contest includes a written exam, diagnostics, and driving skills. Robert Hirning placed fifth. Such expertise verifies the quality of employees in Public Works. The Public Works Dept. issued each employee a $50 incentive award. Both employees were commended and they will be further acknowledged at the November 12th Town Board meeting. Mike expressed his appreciation to the Town for the opportunity he was afforded. After calling other locations, they made a second call to us to let us know they were on the way over to our property. Upon their arrival, they were shown the only unit available to meet their needs. Pleased with the accommodations, they were prepared to stay with us. Unfortunately, they decided not to finish booking the three (3) day reservation, directly stating, it was because of the noise from the road construction. They also indicated it was very difficult even getting into the property due to the delays in traffic on Highway 7. Because of this we request reimbursement for the loss in business in the amount of $286.38. This is figured as follows: Family of 3 Daily Rate $89.00 Days 3 Tax $19.38 Total $286.38 Should this unit rent, either today or tomorrow, we would reimburse the city for that amount. We do not know where this family ultimately stayed since we did not want to question them. At that point our goal was to attempt to have them return in the future, and any further questioning wouldn't have been appropriate. We thank you for your prompt attention to this matter. WORK PLAN AND COST ESTIMATE A. Manford Avenue Sidewalk < ~ Van Horn Engineering proposes an initial site visit with the Town Public Works Staff, Light and Power, and Telephone Corripany to review existing utility structures and the possibility of moving some of the same to accommodate the sidewalk. We would also discuss what other variables might be involved, i.e. width of street, gutter locations, Stanley Park encroachment, etc. It is our goal to establish the horizontal location of the walk at that time. We would then proceed with necessary field work for construction drawings. Preliminary construction drawings would be reviewed with the Town and an Engineer's Cost Estimate prepared. We would then proceed to prepare the construction drawings and bid documents for the project. The drawings would consist of plan and profile sheets for the sidewalk and associated infrastructure, along with needed detail sheets (road crossings, drainage structures, etc.). Bid documents would be very similar to those prepared by Van Horn Engineering for the Municipal Building Parking Lot Project, which already include the Town's standard contract documents and technical specifications. We will assist the Town in bidding the project and prepare our recommendation for the award of bids. We will prepare the necessary contract documents for Town execution. We propose to do all layout and field staking necessary to construct the project, all coordination necessary to provide for orderly construction, a minimum of two site visits per day, a project diary and photo documentation, all pay requests and change orders necessary, all client coordination, and a final set of "as-built" drawings for the project. B. West Riverside Park Sidewalk Van Horn Engineering proposes an initial site visit with the Town of Estes Park Staff to determine horizontal and vertical locations as well as construction constraints and demolition and disposal criteria. We would then proceed with field work and preliminary construction drawings. The cost estimating and bidding will be the same as for the Manford Avenue Sidewalk. Construction management will include the same activities as for Manford Avenue. Page 4 1. .. I Our cost proposal for the project is attached as-Exhibit A. Our total of costs for the two ~- locations is $25,175.00. These costs are based on the rate schedule shown on Exhibit A; which will also be used if work inaddition to the contract services is requested of us. 1 We will adhere to the time schedule giv6n in the request for proposals. This project is a joint effort with the Colorado Department of Transportation to install a permanent traffic counter just east of the intersection of Mall Road on Highway 36. A permanent counter has been in existence on Highway 34 near Mall Road since the 1960's. At that time the majority of inbound traffic came from the Highway 34 service area. This counter has telecommunication with the CDOT traffic engineering offices in Denver and produces invaluable information related to the number of visitors and users on a hourly, daily, weekly and monthly basis. Staff believes that over the decades those visitation patterns have changed. I have tried for several years to get a permanent station installed on Highway 36. However, due to budgetary restraints and the complexity of the project, it has always been put off. Last year I approached CDOT with a request to partner in the cost of installation and construct the site in-house. They agreed to supply and install the expensive hardware and software which does the actual counting and telemetry, if we would coordinate the construction of the site. This project is not an individual expenditure. I will act as project coordinator, by hiring several contractors to provide portions of the work. There will be utility service installations of electric and telephone as well as the trenching for them. A concrete pad must be poured to support the cabinet and the actual wire 'loops' must be cut into the highway. CDOT has begun their assistance with the delivery of the cabinet. It is just like the kind used for traffic signal controls. They are also suppling the detector cable. The local CDOT maintenance crew is currently crack sealing that portion of the highway. Staff is requesting to proceed with this project with expenditure of $5000. We would like to complete it before Memorial Day. The Police Department has budgeted $2000 for the installation of remote control operators on a few doors and the Public Works Department budgeted $5000 for the installation of similar remote controlled operators on several doors. These operators will allow safer access to the garages, while transporting prisoners or bringing in snowplow trucks in the wee hours of the night. Many of the existing operators are over twenty years old. Some will require replacement while others will simply need modifications to accept radio controls operators. Garage bay doors are 12' tall and 12' wide; due to their size, weight, type and age, the cost of these improvements is increased and not related to that of residential sized doors. The flexible asphaltic (Owens-Coming) roof was installed in 1987. To increase its life and maintain the warranty it should receive a liquid aluminization coating every 3 to 5 years. This coating protects the roofing material from harsh ultraviolet rays, so it stays flexible and waterproof. It was last coated in 1990. Staff is requesting to solicit bids from several qualified (O.C. approved) roofing contractors. The emphasis of the looping projects is to replace existing deteriorated water mains. For the 1998 Water Looping Projects, RMC will provide field survey, preliminary and final design, easement preparation as required and construction related engineering services for the following projects. Devils Gulch Interconnection This project includes extension of approximately 1100 feet of 12" water main between Lots 11 and 12 in the Stanley Heights Subdivision north to Devils Gulch Road. A preliminary design was prepared in 1992, this design will be updated and traffic control plans and permitting for access along Devils Gulch Road (Larimer County Right-of-Way) will be prepared. Big Thompson Tank Waterline This project includes the replacement of approximately 2600 feet of 10" water main with new 8" ductile iron pipe. The 8" line will be placed on the south edge of Lexington Lane from -Con,•r State Highway 7 to *Reed~Lane the west to the Big Thompson water tank. The project would also include interconnections of the existing water main laterals and service lines. Big Horn Drive to Chiquita Lane Interconnection This project includes the replacement of approximately 950 feet of 2" and 500 feet of 8" water main with 700 feet of new 12" ductile iron pipe and 500' of new 6" ductile iron pipe. The new 12" water main will extend from Big Horn Drive near the southeast corner of Lot 100 across to Chapin Lane and interconnect with the 8" line crossing Chapin Lane. The 6" main will proceed south between Lots 127 and 128 to Chiquita Lane and the northerly along Chiquita Lane to the northerly lot line of Lot 139. Easements will have to be obtained for a large portion of the waterline construction.
