NOW, 'IHEREFORE, in consideration of the aforementioned premises, the undersigned covenants and agrees as follows: 1. The undersigned, The Congressional Corporation, is the cmner ' of all the land within the boundaries of the "Amended Plat of Lots 10, ·11, 12, 13, 14, 15, 16, and 17, and portions of Lots 1, 6, 8, ! , and 9, Elkhorn Estates Subdivision, Town of Estes Park, Colorado. i 2. As a condition of the approval of the Amended Plat by the ; Town of Estes Park, that The Congressional Corp., or any subsequent i owner or owners of said property or any lots thereof, shall be responsible to the Town of Estes Park for the cost of the installation ! and paving, street improvements, and/or utilities, as required by i i I ~ Title 16 of the Municipal Code of the Town of Estes Park. The under- signed or any subsequent owner of the property of any lots thereof, 6 i. agrees to pay for such inprovements when said inprovements are required 4 due to the development of the subject property. It shall be the 2 decision of the Town of Estes Park as to when said inlprovememts ~ are required. In the event that scme lots are separately owned | t .1 , at the time the improvements are installed, the cost shall be prorated: i . amoung the owners of the lots on the basis of street frontage of 1 the lots abutting said improvements.. : In the event the undersigned or any subsequent owner of any i if the aforementioned property fails to pay for the aforementioned inprovements, the Town of Estes Park shall be entitiled to recover from said owner all costs of enforcing this covenant including <reasonable attorney fees and Court costs. 3. The quantities and unit prices have been verified. A~350.00 charge for a rockwall was added after a homeowner complaint regarding drainage in front of his house. Bob Goehring and myself visited with the homeowner on 8/4/97. Additionally Mike Kearney would like to request the retainage for the project. She wants the sculpture to be mounted in Tregent Park. The Sculpture Committee has reviewed the piece and has determined that it is a good sculpture to add to the park. There will be a need to do site preparation, however, that can wait until next year. Acceptance of this gift is suggested. Box 850 Greeley, CO 80632 RE: State Highway 7 Water Utility and Relocating Fire Hydrant Dear Mike: Please find enclosed the Weinland Construction, Inc. invoice for the amount of $4,400.00. At approximate station 89+15 Mark Gosslin the CDOT project manager for the Highway 7 construction requested the Town of Estes Park relocate the fire hydrant to facilitate construction of the storm drainage system. This construction was performed by Weinland Construction, Inc., outside of the Town contract. Per our discussion, the Town of Estes Park will act as the disbursing agent for this portion of the project. If you have any questions, please do not hesitate to contact us.
