Vacation Dear Mr. & Mrs. Burgener: In a letter to the Town dated May 2, 1996, the Park Entrance Estates Property Owners (PEEPO) requested that the Town vacate the public R.O.W. of Sunrise Lane. On October 24, 1996, at 8:00 a.m., the Public Works Committee will review this request. The vacated R.O.W. is currently proposed to be deeded to the owners of Lots 16, 21, and 26 Since you are one of the owners, your presence is requested at this meeting. Box 1200 Estes Park, CO 80517 RE: Vacation of Sunrise Lane-Park Entrance Estates Dear Bill: You have asked me to review the procedure to vacate Sunrise Lane in Park Entrance Estates. ,The reasons for the proposed vacation is that Sunrise Lane was not improved along with the other streets in Park Entrance Estates, will not be maintained by the Town, and serves only three lots. The State statutes govern the procedure of vacating a public roadway. Section 43-2-302 (1) (d) C.R.S., provides that the title to the vacated portion of the roadway would be as follows: A. Lot 26-the northern portion of Sunrise Lane abutting Lot 26. B. Lot 21-the portion of Sunrise Lane from the northeast corner of Lot 21 south to the north point of Lot 16, then the abutting 1/2 of Sunrise Lane from said point to its confluence with Meadow Circle. C. Lot 16-1/2 of the abutting portion of Sunrise Lane from the north point of Lot 16 to its confluence with Sunrise Lane. PROCEDURE: Vacation is accomplished by the Town Board passing an ordinance vacating the roadway. However, Section 43- 2-303(2) C.R.S., provides that no roadway shall be vacated so as to leave any land adjoining said roadway without an established 1-3 public road or private access connecting said land with another established public road. It will be necessary for Lots 21 and 16 to grant a private access easement over their vacated portion of the roadway to the southern boundary of Lot 26 in order for the Town to vacate the entire roadway. Also, it should be noted that the Town may reserve easements for the continued use of existing sewer, gas, water or similar pipelines and appurtenances if any of them presently exist in Sunrise Lane. if you need anything further, please do not hesitate to give me a call. Kearney and Sons bid has been compared to the lowest item bid prices form all the bidding contractor for the 1995 and 1996 Water Looping Projects. The results are as follows: Company Bid 1) Kearney & Sons Excavating $79,437 2) *Lowest Bid prices from the $84,519 1995 & 1996 Water Looping Projects Unit price extension for the bidder has been verified. Kearney and Sons Excavating has completed previous Town water lines for private clients with all work being to Town standards. Kearney's bid total is 6 % below the lowest unit prices from the two previous years. Kearney & Sons can have the project completed by June 1, 1997. Should the Town wish to have the project completed sooner, the water lines can be rebid. It is estimated that if rebid the cost would be between 10 % and 20 % greater. Rocky Mountain Consultants was retained under separate contract as of the September 10th Town Board meeting for the design and construction management of this project. Excess funds will be obtained from other miscellaneous Public Works Departments items. Total project price will be contained within the Public Works Department budget. With the approval of the Town Board on November 12, construction will follow immediately. Linnane Title Public Works Director Date Section 00950 - Page 2 of 3 6-2 ATTACHMENT TO CONTRACT CHANGE ORDER NO.001 1996 WATER LOOPING PROJECT Re-alignment of proposed water line at Fall River Lane was required due to conflicts with the existing water line and area constraints. Installation of a 12" solid sleeve. A section of line had to be laid backwards to avoid conflict with a new private fence. The 12" sleeve was required to connect with the previously laid portion of line on which the bells were facing the opposite direction. Installation of 120 X 12" X 6" tee and 6" valve furnished by the Town. Plus thrust block, furnished by the Contractor. The tee and valve were installed at Wonderview and Valley Drive for future crossing of Wonderview.
