RECORD OF PROCEEDINGS b Public Works Committee, April 27, 1995 - Page 2 - Following discussion, the Committee recommends Staff investigate ~ the placement of this handicapped space, account for other handicapped locations in the area to determine the need for an additional space, and report back to the next meeting. WATER DEPARTMENT LOOP PROJECT--APPROVAL OF CHANGE ORDER Chairman Gillette reported that Director Linnane informed him of the following change orders as they occurred. Director Linnane explained that six change orders are pending as follows: Spruce Dr. to Rock Ridge Ln., uncertain utility location, $2,700; Hwy. 34/36 intersection, change from 12" to 8" tap connections to accommodate water outages to Stanley Village, ($330); Old Church Shops, deletion of several service taps, ($1,700); Hwy. 34/36 Intersection, irrigation connections for Stanley Village, $1,800; Cleave St., maintenance of water line leak, $1,500; and Spruce Dr. & Rock Ridge Ln., unknown utility locations at West Park Center, $725.00. The Committee recommends approval of Water Department Loop Project change orders totaling $4,695. LAKE ESTES TRAIL PROJECT--APPROVAL OF CHANGE ORDER Chairman Gillette was informed of this change order prior to the meeting. Director Linnane explained that a manhole extension along the Bike Path was requested by Upper Thompson Sanitation District. The project will remain within budget with this change order. The Committee recommends approval of the Lake Estes Hike/Bike Trail change order in the amount of $2,000.00. Director Linnane added that ribbon cutting is set for June 16 at 10:00 a.m. Trustee 1- Doylen requested Staff explore a proposal from GOCO to sponsor ./"- signage for the Bike Path. ~t HABITAT FOR HUMANITY- -REOUEST TO AMEND WAIVED TAP FEE AMOUNT Chairman Gillette declared a conflict of interest and vacated the room. Dale Williams, Habitat for Humanity Building Committee representative, requested two water tap fees be allowed for the duplex construction on Lot 2, Murphy Subdivision. Two families have been assigned to this duplex. As each family will have sole ownership, the lot may be split into two lots in the future and separate water tap fees will avoid confusion for any future ownership. Director Linnane explained that at the March Public Works meeting, the Committee recommended the waiver of one multi- family water tap fee in the amount of $5,665. Two single family tap fees would bring the total to $8,040. The Committee recommends approval of two single-family resident tap fees in the amount of $8,040 for Lot 2, Murphy Subdivision, with the restriction that the Town be reimbursed if the duplex is sold on the open market within ten (10) years. Chairman Gillette resumed his position on the - Committee. The Elkhorn Avenue Water Loop Project will be completed May 15, weather permitting. The asphalt overlay of Elkhorn Avenue is scheduled for 1996. The Augmentation Plan is scheduled for filing with the Water Court on April 28. Maps outlining the Hwy. 7/Hwy. 34 Project will be displayed at each meeting prior to construction start in an effort to initiate input from citizens. 1-1 . Besides the growth in student population at the schools, other factors contribute to the increased traffic congestion. Some of these factors include the future multiple family housing project west of the elementary school, the recent relocation of the county offices to the Park R-3 Administration Building, and the new construction of the "swing" school building along Brodie Avenue. It is the consensus of the Board of Education that Community Drive needs to be straightened with only one intersection as it crosses Manford Avenue. A traffic signal with pedestrian signage will improve the safe passage of our young people to and from school. The most obvious footprint would take the new Community Drive north of Manford through the existing horse barns on the corner until it can realign back into that portion of Community that intersects Highway 36. Request you cause a study of this suggestion, and cause it to be added to the capital improvement plan for completion by September 1998. Box 1200 Estes Park, CO 80517 Dear Mr. Linnane: The Colorado Department of Transportation (CDOT) has identified approximately 5075 sq. feet (1/10 an acre) of wetland impacts associated with the S.H. 7 widening project from S.H. 36 to Carriage Drive. Where wetland impacts are unavoidable, it is CDOT's policy to replace these wetlands on a 1:1 basis within or adjacent to the highway Right of Way. Wetland mitigation on a 1:1 basis upholds the federal policy of no net,loss of wetlands. CDOT proposes to mitigate the wetlands impacted by this project, at the site where the impacts occur (near Carriage Drive). The wetlands will be replaced with in kind vegetation, maintaining the area's original appearance. The enclosed map shows the areas of wetland impacts and the proposed mitigation area. As requested in your letter dated November 18, 1994, an agreement authorizing CDOT to use town owned land for a wetland mitigation site which will be maintained, in perpetuity, as a functional wetland will be drafted by CDOT Right of Way staff. SCOTT AVENG ...4 ./. 1 .. 6-1-7VJV-(Lb CaJ~nUA·crr US i,Jup U.) <7-Lb ~' tENn Ek €,4 CONTRACT THIS CONTRACT, made this day of , 199-, by and between the State of Colorado for the use and benefit of THE DEPARTMENT OF TRANSPORTATION, hereinafter referred to as "CDOT", and THE TOWN OF ESTES PARK, hereinafter referred to as "THE TOWN", WHEREAS, authority exists in the law and funds have been budgeted, appropriated, and otherwise made available, and a sufficient unencumbered balance thereof remains available for payment in Fund Number 400, Appropriation Code 010, and Contract Encumbrance Number ; and WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, CDOT plans to improve State Highway 7 south of Estes Park to include the construction of eight foot paved shoulders and fourteen foot wide M. Ad\<- L.-£- paved me*~Kn, hereinafter referred to as "the highway project"; and WHEREAS, notwithstanding all appropriate efforts by CDOT to avoid wetland loss, the highway project will result in the cumulative loss of approximately 5,075 square f.eet of wetlands, all of which cannot be replaced within the project corridor; and WHEREAS, 23 C.F.R. Part 777 requires CDOT to mitigate the wetlands loss by providing or developing other wetlands, and WHEREAS, CDOT desires to contract with The Town to acquire an interest,· in the form of a conservation easement in gross in existing wetlands owned by The Town; and WHEREAS, the wetlands project has been accepted by the U.S. Army Corps Of Engineers ("The Army Corps") , as acceptable mitigation by CDOT for the wetlands loss on the highway project; and WHEREAS, the parties intend that the wetlands project will continue in perpetuity, except as provided in this contract; and 6-5 0 - NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, it is hereby agreed that: 1.· The following Exhibits are attached hereto and-incorporated in the terms and conditions of this Contract by this reference: < Exhibit A: Description of the Site. The Town shall grant and convey to CDOT a deed for a conservation easement in gross in the portion of the Site described in Exhibit B ("the easement property"), in accordance with the following conditions: (a) The conservation easement granted by The Town to CDOT shall be in the form of Exhibit . The Town shall grant and convey the fully- executed conservation easement to CDOT on the date which is ten working days from the date of execution of this Contract. The "date of execution" of this Contract shall be the date that the CDOT Controller signs this Contract, as indicated by the date first written above. (b) The Town shall grant the conservation easement to CDOT pursuant to the provisions of 38-30.5-101 C.R.S., et seq., as amended, which provisions shall be incorporated as terms and conditions of the easement. The conservation easement granted by The Town shall run with the easement property. The easement shall be perpetual, except to the extent expressly provided otherwise herein. The easement shall restrict the use of the easement property to prevent either of the following conditions: (1) any activities reasonably within the landowner's control which would disturb the surface conditions. Specifically, farming, mining, housing development and the construction of roads and parking facilities. 6-6 ,'141 r. 0 (2) any activities reasonably within the landowner's control that might undermine or damage the three necessary attributes to sustain a wetland complex; specifically, availability of water, wetland plant species and hydric soil. (C) The conservation easement shall be granted to CDOT for the following purposes: (1) to provide mitigation for the wetlands loss, as described herein; (2) to allow CDOT to protect the wetlands values of the easement property and to prohibit or limit any action(s) or use(s) of the easement property that CDOT reasonably determines are not consistent with or appropriate to retaining or maintaining such property as wetlands; (3) to allow CDOT to take all reasonable actions, including ingress to and egress from the easement property, that CDOT deems necessary to monitor and enforce the conservation easement and, in an emergency, to retain and maintain such - property as wetlands; and. 3. In exchange for and conditioned upon The Town's grant and conveyance to CDOT of the conservation easement described in Paragraph 2 above, The Town will donate the fully-executed easement and convey to CDOT. 4. CDOT· shall manage the conservation easement property, consistent protection of lands containing significant biodiversity values, to provide conservation and protection of the wetland and biological values of the Site, subject to the provisions of the Paragraphs a & b. (a) If changed circumstances (including, without limitation, alter- ations in the site's hydrology, climate change, acts of God, disaster or other unforeseen events) substantially alter or degrade the Site's wetlands and biological features or values, or render the plants or plant communities nonviable, then CDOT will dispose of the Site back to The Town. 6-7 (b) Maintenance will cease when the wetland mitigation site has been determined to'be functioning as wetlands. This will be determined by CDOT staff biologist, landscape architect and COE/DOW Natural Resources Agencies. 5. CDOT will provide liaison with The Town through CDOT's Region 4 Engineer. 6-8 ... OK. -to t.--41-4 0...4-44 T -~•Ule A MEMORANDUM OF UNDERSTANDING 0716 47'0*- THIS MEMORANDUM OF UNDERSTANDING dated this 28th day of May, 1991, by and between the TOWN OF ESTES PARK, hereinafter referred to as the ("Town) and the CARRIAGE HILLS PLANNED UNIT DEVELOPMENT ASSOCIATION, a Colorado non-profit corporation, hereinafter referred to as the ("Association"). WHEREAS, the Town of Estes Park has had certain discussions with the residents of the 6th and 7th Filings of Carriage Hills, A Planned Unit Development, hereinafter referred to as the ("Property") with regard to the annexation of the Property to the Town of Estes Park; and WHEREAS, the Association is a legal entity which represents certain interests of the residents of the Property and also owns real property within the Property; and WHEREAS, the parties desire to set forth the understandings of the parties with regard to the annexation of the Property to the Town. NOW, THEREFORE, IN CONSIDERATION OF THE RECITALS STATED ABOVE, THE PARTIES HEREBY STATE AS FOLLOWS: 1. The Town intends to consider the annexation of the Property in accordance with the terms and conditions of the "Municipal Annexation Act of 1965". The annexation of the Property shall be subject to all of the terms and conditions, including all requirements for petitions, notice and hearing as set forth in the Municipal Annexation Act of 1965. In the event that the Town does receive a petition which conforms with the provisions of said Act and the Town does annex the property, the parties agree that the following is an understanding of the parties of various items of concern between the parties. A. ZONING: It is anticipated that the Property will be zoned E-Estate, according to the terms and conditions of the Municipal Code of the Town of Estes Park. The parties understand and agree that the Town does not obligate itself in any manner to approve E-Estate Zoning for the Property. B. STREETS: The streets will be dedicated to the Town pursuant to the annexation process. Due to said dedication process, the Town will accept maintenance of all of the streets dedicated. As the streets will then become streets in the Town Street System, the Town will evaluate the condition of said streets along with all other streets of the Town. The streets will be evaluated, maintained and improved in accordance with the regular maintenance program of the Town of Estes Park. 1 6-9 D. WATER RATES: Upon annexation,- -the-water -rate-will-"--"~"~~ change from a rural rate to an urban rate, pursuant to the Municipal Code. E. SALES AND USE TAXES: Upon annexation, the Property will be subject to the Town's sales and use taxes. F. POLICE PROTECTION: Upon annexation, the Town will provide police and fire protection as it provides to all other areas within the Town's boundaries. G. HIGHWAY 7 BIKE PATH: It is the Town's intent to budget for and extend the Highway 7 bike path along the Property sometime in the future. Both parties specifically agree as follows: 2. OPEN SPACE. The Town will accept dedication of Outlet D\ as open space upon receipt of an appropriate and approved Deed of \ Dedication executed by the Association. Said Deed of Dedication ~ will specify that Outlet D remain as open space subject to the \ reserved right of the Town to construct improvements, such as \ pedestrian and bike paths that are consistent with open space and the ability of the Town to modify the ponds and drainage areas as <- is necessary. 3. OTHER OPEN SPACE. The Town would consider accepting ~ dedication of other open space outlots owned by the Association, / provided there are no maintenance responsibilities for said open l space. A. BUILDING PERMITS AND INSPECTIONS. Any building permit inspection within the Property shall be performed by the Town. The Town agrees to notify the Association, through its designated representative, of any building permit applications. This agreement by the Town is merely for notification of the Association of all building permits. The Town shall not be required to administer, interpret or in any way become involved in any dispute between any building permit applicant and the Association or any residents of the Property with regard to whether or not the structure for which the building permit is applied for is in compliance with any covenants or restrictions which govern the property. Real Estate Specialist 5-6 HIGHWAY 7 CORRIDOR - UTILITY STUDY 1.0 INTRODUCTION 1.1 Purpose The Colorado Department of Transportation (CDO'ID has proposed in the spring and summer of 1997 to reconstruct Highway 7 near the Town of Estes Park. The project involves approximately 2.4 miles of regrading, widening and overlayment. Re-alignment, grading and overlayment of secondary road approaches will also be included in the project. See Figure 1 for the limits of the construction. The Town of Estes Park has existing water mains and electrical lines along the highway corridor which will be impacted by the roadway construction project. The purpose of this report is to determine the extent of the impacts to the Town's water and electrical system and determine alternative methods to mitigate the impacts. 1.2 Existing System The existing Town water system and electrical utilities in the project area are shown on Plate 1 and 2 in the appendix. 1.2.1 Water System Existing water mains in the Highway 7 Right-of-Way serve as major water transmission mains looping the Mary's Lake Water Treatment Facility with the downtown core area. '.51 3.1.1 Alternative 1W - Colorado Departmpnt of Transportation Replacement ' 10'he position of the Colorado Department of Transportation would be to mitigate all impacts to Lithe Town of Estes Park Water System. Typically this would mean replacement of the effected ,fwater system components. The effected water mains would-be replaced to current Town of CEstes Park standards. Sections of the single 8" steel main would be replaced with a 8" ductile dron pipe. Sections ofthe 8", 4" and 2" water mains in parallel would be replaced with a single 212" ductile iron pipe to maintain the same flow capacity at the most economical price. Sections Yof the single 4" main along the west side of the highway would be replaced with a 6" ductile ifiron pipe per Town water standards. Table 1 details a preliminary cost estimate for the 1 ».4.1 freplacement of the Town Water System. The existing mains would be replaced with a single 12" water main, installed adjacent to the existing 8" steel water main. A 12" water main would conform to the master plan requirements for the area. The total length of the project is 10,400 feet. Replacement of the existing water main will help prevent excavation for repairs beneath the reconstructed roadway. A portion of the new 12" water main will remain under the roadway between the Highway 36/7 intersection and Manford Avenue. The new water main will have a life expectancy approximately the same as the new roadway. Increase fire flows to the hydrant which are currently serviced off of 2" and 4" water mains. 3. Installation of additional fire hydrants in more strategic locations. This would provide a more evenly distributed fire protection along both sides of Highway 7. 4. Installation of additional main valves. This would enable the Town to isolate smaller sections of the main for maintenances purposes. 5. General upgrade of the Town's water utilities along Highway 7. This would greatly reduce the amount of repair time along the highway corridor. . 6. (RMC) is submitting the following proposal for work related to the Highway 7 Water Utility Upgrade. The emphasis of the water utility upgrade is to replace the existing water mains in the Highway 7 corridor with a new single 12" water main prior to highway reconstruction. For the Highway 7 Water Utility Upgrade, RMC will provide field survey, preliminary and final design, easement preparation as required, state highway permitting and construction related engineering services for the project. This project includes approximately 10,400 feet of new 12" ductile iron pipe to be installed between the Highway 36/7 Interconnection and Pinewood Lane. Approximately 29,000 feet of existing 2", 4" and 8" water main will be abandoned along the highway corridor after completion of the new main. The north end of the new 12" main will tie into the existing 8" and 4" mains in Highway 7 adjacent to the Holiday Inn main entrance. The south end of the new main will tie into the existing 4" main at the entrance to Pinewood Lane. Also included will be the interconnect of 26 laterals, connection of service lines to both east and west side of the highway. Any existing laterals or services which are to be impacted due to the highway reconstruction will be relocated accordingly. Design of the project will begin immediately upon notice to proceed. Design would be completed to go bid by mid November, with construction to begin in December 1996 with a notice to proceed by October 1, 1996. Any easements will be secured prior to any construction. Based on the Town of Estes Park Highway 7 Corridor Utility Study for Water and Electric The Town portion of the design and construction was estimated to be 36.2 % of the total cost with CDOT estimated portion of 63.8%.
