Over the past three years the town has been asked to pursue the Tree City designation, for various reasons this hasn't been accomplished. Dan and I have been putting together the materials to get the town involved in the Tree City USA program. The Tree City USA program is designed to recognize communities that effectively manage their public tree resources, and encourage the implementation of community tree management based on four requirements, referred to as standards. CD The first standard is to form a Tree Board. We want to have three members from the Parks Department, three from EVIA, and one from the Public Works Committee. We still have to decide on term limitations and when we want to activate the Tree Board. The second standard is to write a community tred44!inance. We came up with a draft using information from Loveland, Ft. Collins, and an example provided by Tree City USA. We want Greg White to proof read it to make sure it meets legal standards. We have enclosed a copy for you to look at. The third st,Mard is to have a community forestry program with an annual budget of at least two dollars per capita. This is already covered by our normal maintenance budget under new plantings, pest control, fertilization, mulching, pruning, and elk protection. From this point on we will be tracking these costyn our computer to provide more accurate data on these expenditures. The fourth st~dard is to observe Arbor Day. We've had meetings with EVRPD and the School District to come up with ideas. So far our plan is to plant two trees at the new youth center with some type of involvement with classes from the elementary school. We will donate $250 (out of 101 5200 452 2636 for new trees and plantings) for the purchase oftwo 5'-6' evergreen trees. We can get the trees from Chief and Judy. We are planning to do this event one day during the first week of May. EVIA also wants to observe Arbor Day by donating some trees for the Lake Trail. We will pick up nursery stock for them but they will have volunteers to plant and maintain their trees. This is what we've come up with so far. Please review what we've done to this point and let us know if we should continue with the plan. Dejinitions Street trees: "Street trees" are herein defined as trees, shrubs, bushes, and all other woody vegetation on land lying between property lines on either side of all streets, avenues, or ways within the city. Park trees: "Park trees" are herein defined as trees, shrubs, bushes, and all other woody vegetation in public parks having individual names, and all other areas owned by the city, or to which the public has free access as a park. Section 2. Creation and Establishment of a Tree Board There is hereby created and established a Tree Board for the Town of Estes Park, Colorado. The board shall consist of seven members, citizens and residents ofthis town, who shall be appointed by the mayor with the approval ofthe town board. Section 3. Term of (mice The term of the seven members to be appointed by the mayor shall be years. In the event that a vacancy shall occur during the term of any member, his successor shall be appointed for the unexpired portion of the term. Section 4. Compensation Members ofthe tree board shall serve without compensation. Section 5. Duties and Responsibilities of Tree Board It shall be the responsibility of the board to study, investigate, council, develop and administer a plan for the care, preservation, planting, replanting, and removal oftrees and shrubs in parks, along streets, and in other public areas. The board, when requested by the town board, shall consider, investigate, make finding, report and recommend upon any special matter of question coming within the scope of its work. Section 6. Operation The board shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. Section 7. Distance from Curb and Sidewalk The distance trees may be planted from sidewalks and curblines will be in accordance to species size. No tree shall be planted closer to any sidewalk than the following: Small trees, 2 feet; Medium trees, 3 feet; and Large trees, 4 feet. If curb does not exist, a distance of 6 feet from edge of pavement to accomodate drainage features. Section 8. Distance from Street Corners and Fireplugs No street tree shall be planted closer than 35 feet of any street corner, measured from the point of nearest intersecting curbs or curblines. No street tree shall be planted closer than 10 feet of any fireplug. 2-2 1 f Section 9. Public Tree Care The town shall have the right to plant, prune, maintain, and remove trees, plants, and shrubs within the lines of all streets, alleys, avenues, lanes, and public grounds as may be necessary to insure public safety or to preserve or enhance the beauty of such public grounds. The tree board may remove or cause order to be removed, any tree or part thereofwhich is in unsafe condition or by which reason ofits nature is injurious to sewers, power lines, gas lines, water lines, or other public improvements, or is infected with any injurious fungus, insect, or other pest. Section 10. Pruning, Corner Clearance Every owner of any tree overhanging any street or right-of-way within the town shall prune the branches so that such branches shall not obstruct the jight from street lamps or obstruct view of any street intersection and so that there shall be a clear space of 10 feet above the surface of the street or sidewalk. Said owners shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a safety hazard to the public. The city shall have the right to prune any tree or shrub on private property when it interferes with snow removal vehicles or interferes with visibility of any traffic control device or sign. Seclion 11. Dead or Diseased Tree Removal from Private Property The town shall have the right to cause the removal of any dead or diseased trees on private property within the city, when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the city. The Tree Board will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within sixty days after the date of service of notice. In the event of failure to comply with such provisions, the Town shall have the authority to remove such trees and charge the cost ofremoval to the owner. Section 12. Interference,rith Tree Board It shall be unlawful for any person to prevent, delay, or interfere with the tree board, or any of its agents, while engaging in the planting, cultivating, pruning, spraying, or removing of any street trees, park trees, or trees on private grounds, as authorized in this ordinance. Section 13. Review by Town Board The Town Board shall have the right to review the conduct, acts and decisions ofthe Tree Board. Any person may appeal any ruling or order of the Tree Board to the Town Board of Trustees who may hear the matter and make a final decision. Section 14. Coulsen Excavating out of Lowland was the apparent low bidder. The bid and other associated costs are approximately equal to the budget, so the project will mostly likely be awarded to Coulsen. The schedule is tentative at this point. It can take two to four weeks to award and an additional three weeks to actually proceed with construction. I would guess that construction will begin between April 8th and April 29th. We will update you on the schedule as more information is available. Greg Sievers and Gary Klaphake will be the Town's contacts while I am out of town. I will return April 1. I want to thank CDOT for their hard work and extremely accurate cost estimates. St. Vrain Estes Park, CO 80517 Project No.: 9-0223.035.00 Estes Park Bike Path Dear Kerry: Mountain Constructors, Inc. proposes to perform the warranty work on the above referenced project in the spring of 1997. By waiting until then, we will only have to move equipment in once, and if there are any other problems they will be taken care of them at that time. The only exception to this, would be if it is determined that there is a major problem that could be dangerous to cyclists and pedestrians using the path. Should this occur, Mountain Constructors would perform repairs at that time. The extra riprap work discussed in the meeting will also be completed in the spring of 1997. We also request that payment be made on the work completed to date. Retainage should not be held due to the fact that payment and performance bonds have been posted and are in effect until the warranty period expires.
