March 20, 1995 MEMORANDUM TO: Public Works Committee -,27 A FROM: Rich Widmer 7 14-< Assistant Toxp/Administrator SUBJECT: Proposed Lease of Town Property at Transfer Station The Town has been asked by SMB, Inc., doing business as A-1 Trash Service, Inc., if it would be interested in leasing a parcel of land next to the Transfer Station as a site for relocated A-1 Trash Service operations. After discussion at the February Public Works Committee meeting, Town Attorney White prepared a lease document. The key points of this 25-page document are summarized below: 1. Legal Description. Will be prepared by A-1 and checked by the Town. The parcel will be approximately 1.5 to 2 acres located south and west of the existing Transfer Station parcel. 2. Term. 25 years with an option to renew for 25 years. At the end of the term, all improvements to the property revert to the Town. 3. Rent. The rent will be paid in semi-annual installments, and will be calculated based on the area of the parcel valued at $1.50 per square foot, with a rate of return based on the Town' s investment rate (currently 5.9%) plus 1%, over the period of the lease. Using this method, the rent for a 1.5 acre parcel would be approximately $8,280 per year. The interest rate would be adjusted each year based on the Town's actual rate of return. 1-1 (303) 586-5331 • RO. Zoning. A-1 will be responsible for obtaining and paying for all necessary governmental approvals for use of and construction on the site. Written approval by the Town is required before any construction takes place. This site is currently outside the Town limits. It is eligible for annexation and, since it is municipally owned, may be annexed without the time periods for public hearings if desired. The Town may wish to consider annexation of this site, as well as the remainder of our property in this area. If the land were within the Town limits, the Town would have total control of the site approval process. 5. Use of Site. The lease specifies the site may only be used for trash hauling, recycling, sewer master business, and related uses. The lease may not be assigned without first obtaining written consent from the Town. 6. Environmental Concerns. A-1 accepts the site "as is," and the Town makes no warranties as to the environmental condition of the site. The Town is indemnified from any claim arising from this lease by A-1. 7. Taxes, Insurance. A-1 is responsible for any taxes, assessments, and utility charges for the site. A-1 is required to carry at least $1 million in public liability insurance in connection with use of the site. Recommendations: 1. Recommend Town Board approval of a Ground Lease Agreement signed by SMB, Inc, d/b/a A-1 Trash Service, Inc. including points 1 through 7 above, as modified. 2. We would like to request a waiver of the city tap fees for the lot 2 Murphy subdivision. As you may know, Habitat for Humanity is working to eliminate inadequate shelter and increase community stability through the building of simple, decent homes which are sold to low-income families at no-profit, no-interest rates. We are an all volunteer 501(c)(3) organization. The tap fee waiver would enable us to use donations directly towards the building process and would demonstrate the city's support for our efforts. HABITAT FOR HUMANITY - REQUEST TO WAIVE WATER TAP FEE. In summary, Gerald Swank/Board of Directors and Site Selection Chairman with Habitat for Humanity of the Estes Valley advised that Estes Park is one of 700 affiliates of Habitat for Humanity International. The non-profit organization's mission is to build low cost, well designed and constructed homes for families living in inadequate shelter due to the lack of suitable affordable housing in their community. Habitat seeks local, regional and federal support which includes at-cost and donated materials, public and private donations, volunteer labor and management, and private and federal grants. Capital, not charity, is provided, and the selected family is required to invest 500 hours of labor into the construction of their home and the one that follows. Habitat has obtained property at 509 Columbine and is requesting the Town waive its $3,700 water tap fee. Mr. Swank confirmed that Habitat requires a 2-year lease/option for the family--the house cannot be sold on the open market for 2 years. Discussion followed concerning the sewer system (a sewer line serving a neighboring property crosses the lot; it will be rerouted and the EPSD will allow both houses to connect to this existing line); and placing an extended deed restriction (pre-empting large capital gains and prompting reimbursement of the water tap fee to the Town); confirmation that the newly formed Housing Authority has not yet adopted a policy relating to fee waivers; and clarification that the Water Fund is an Enterprise Fund (the cost of water taps are attributed to the cost of providing water). The Committee recommends: (1) the Housing Authority purchase the water tap for this project as a "test case" rather than a precedent setting case (Authority to reimburse the Water Fund), (2) authorize the Town Attorney to prepare a deed restriction stating that if the house is sold on the open market within ten (10) years, that the Housing Authority shall be reimbursed said $3,700. Administrator Klaphake advised that the 1994 Budget already contains $50,000 to help support the Marys Lake housing effort; this fund will be increased by $3,700 for a total or $53,700. The Committee urged the Housing Authority to discuss waiver of fees at their first meeting scheduled in January. Chairman Habecker confirmed that this recommendation will be heard by the Town Board September 15, and he urged Mr. Swank to attend. 4-2 George A. This location was agreed to by Tom Brown as compatible with his development plans for the area and he suggested a fence be installed around the equipment which is agreeable with U S West.
