Box 1200 Estes Park, Colorado 80517 Dear Sir: We are the owners of Lot 8, Block 13, Carriage Hills, 5th filing along Fish Creek Road, and we are in the process of buying the adjacent lot (Lot 7) in order to combine the two into one dwelling site. We recently discovered that Fish Creek Road actually laps onto the lots, and this is the main reason for combining the lots. Recent measurements indicate that Lot 7 does not have a liable building site within the 100 foot set back from the road, but it has a water tap that we would like to use on Lot 8. Therefore, we would like to transfer the water tap on Lot 7 to Lot 8. We are willing to file an agreement with Larimer County stating that the owners of Lot 8 will never build any kind of structure - 4-0 on Lot 7 that would use the water tap on Lot 7. The water tap would be for the exclusive use of Lot 8. The reason that we are requesting this approach is because we are trying to avoid the ~ cost of an amended plat, which is estimated at around $1500. We understand that the next meeting of the Public Works Committee % is at 2 p.m., June 11 at the Town Hall. We would be prepared to bring photos and further explain our request, if needed. Box 1200 94 \ Estes Park, CO 80517 Dear Bill: You have asked that I give a written opinion concerning the service of water to Mary's Lake Lodge by the Town. This opinion is based upon the following: 1. Prior to February 17, 1989, the property was served by the Crystal Water Company. On said date, the Town acquired certain assets of Crystal Water Company. Pursuant to the applicable provisions of the Asset Purchase Agreement, the Town agreed to the assignment of Crystal Water Company's rights and obligations in several water service arrangements. One of said service arrangements was that of the Mary's Lake Lodge property, which is,described in the Purchase Agreement as'follows: "Oral agreement for water service between Crystal Water Company and Wesley Box covering the Chalet property." 2. The only documentation available concerning this matter is a letter dated December 15, 1988 from Melvin Dinner on behalf of the Crystal Water Company to the Town of Estes Park which was written prior to the purchase of Crystal Water Company' s assets by the Town. The letter was accompanied by a. letter dated December 5, 1988 from W. C. Scott, concerning the arrangement with the Mary's Lake Lodge property. A copy of said correspond- ence is enclosed for your information. 2-1 1 Bill Linnane Page 2 3. Neither the Town of Estes Park nor the Crystal Water Company entered into any written contractural arrangement for the service of water to the Mary's Lake Lodge property, including, but not limited to, a service agreement and/or tap agreement. The Town has no written obligation to continue to serve raw water to the Mary's Lake Lodge property at the rate of $1.00 per thousand gallons for any specified period of time. So long as the Town does not discriminate among the Mary's Lake Lodge property and other property owners outside the municipal limits with regard to water service, the Town can treat the Mary's Lake Lodge property as it would treat any other properties receiving water service from the Town outside its corporate limits. Section 31-35-402(1) (f) C.R.S. gives the Town the right to "prescribe, revise and collect in advance or otherwise, from any consumer or any owner or occupant of any real property connected therewith or receiving service therefrom, rates, fees, tools, and charges or any combination thereof for the services furnished by, or the direct or indirect connection with or the use of, or any commodity from such water facilities...including, without limiting the generality of the foregoing, minimum charges, charges for the availability of service, tap fees, disconnection fees, reconnection fees..." Also, absent any written contract between the Mary's Lake Lodge property owners and the Crystal Water Company, the Town does not have the right to discriminate in favor of the Mary's Lake Lodge property owners over other customers of the Town's municipal water system. Said property should pay the same charges for water services that other users of the municipal water system pay. FEES. 1. PLANT INVESTMENT FEE. The Plant Investment Fee (PIF) reflects the Town's cost to deliver water upon demand and is not a measure of total annual water consumption. The PIF is based on a tap size and a fee associated with each tap size. The current PIF rates may be obtained · by contacting the Public Works Department. Except for separate water districts, the Town's PIF shall be paid before any service connections can be made to the distribution system. The tap size for determination of PIF's is estimated using equivalent fixture units. These equivalent fixture units are based on the number and type of fixtures in the building. The equivalent fixture value units (FVU), tapping fees, and monthly water rates are listed in Chapter 13.32, Title 13 of the Town's Municipal Code. NOTE: Based on the Town's interpretation of AWWA M22 and their experience, these fixture unit counts are the maximum allowable. It is the Owner's responsibility to ensure that these sizes are hydraulically compatible with his development. The minimum tap size shall be 3/4 inches and single-family residences, multi-family residences, commercial, and other customers shall use the above described fixture value unit procedure for estimating tap size for determination of PIFs. The Town's 1983 Pavement Management Study has been used to set priorities which have then been modified with engineering judgment and field inspections. This year's project proposes 1.5 miles of 11/2 inch overlay. The estimated costs for the various projects are included in the attached street improvement summary. The intended schedule is to bid the project in July, with construction to take place following Labor Day. The committee will review the bids, and if the bid prices vary significantly from the estimate, the project list will be modified to bring the project into line with the budget.
