We want the July Western Week atmosphere - to be evident throughout the Estes Valley and the front Complete range. Rodeo FacIlltle, We believe that pole-banners hanging from some of the - lampposts in the downtown area would not only look attractive Special and festive but would also remind people passing through Conteetant about one of the good reasons to stop and spend more time and with us in Estes Park. Ltc 515)23 Stanl, Munlclp Carol Ball and Dave Barker, representing the Rooftop Rodeo E•• Committee, submitted a letter dated May 5, 1988 requesting the , Department purchase and install brackets for the lightpoles along Elkhorn Avenue. The Rodeo Committee is proposing to hang banners or flags to enhance and advertise the Rooftop Rodeo and Western Week which will take place in July. As guidelines regulating size, etc. have yet to be determined, the Rodeo Committee has not , prepared a design for their banner/flag. The brackets could be available for subsequent festivals and events. Director Dekker advised approximately 70 brackets were retained from the lightpoles that were installed prior to Streetscape; however, staff has not confirmed if said brackets could be used on the four-cluster lightpole. Discussion followed regarding ban- ner/flag guidelines, aesthetic concerns, re-instituting the placement of the American Flags during national holidays, Sign Code, and legal ramifications. The Committee recommends: (1) the Department provide a demonstration on 2-4 lightpoles in the Transit Center, using various methods to display a banner/flag; (2) the demonstration will take May 19th during the Public Works Committee meeting; (3) Carol Ball and Dave Barker, Light and Power Committee members, Public Works Committee members, Light and Power Director Dekker, Public Works Director Widmer, Town Planner Stamey, and EPURA are invited to view the demonstrations and voice their opinions and concerns. ¢ ~49 1 TOWN OF ESTES PARK Light ancl Power Department Robert L. To use the options on sheet 1 or 2, flag staff brackets we now have on hand could be used. The $10.00 charge you estimated for having your men install each one would be the only cost involved. Sheets 3 through 6 show arrangements that would require special brackets or clamps. Material and labor costs ~ probably would average $25.00 per pole for these. I L., 0.1.i Section 17.66.190, B., 5, provides: "Signs required or specifically authorized for a public purpose by any law, statute or ordinance shall not require a sign permit or sign permit fee, and may be of any type, number, area, height above grade, location or illumination authorized by the law, statute or ordinance under which such signs are required or authorized. No such sign shall be placed in the public right-of-way unless specifically authorized or required by law, statute or ordinance, and, except for warning signs or barricades of a temporary nature, such signs shall be permanently affixed to the ground, a building or other structure." In my opinion, the Board of Trustees, by ordinance, could authorize placement of light pole banners for activities such as the Rooftop Rodeo. I would recommend, however, that placement be limited to a few key areas and that both the number and size of the banners be reasonable. Post Office Box 1379 Estes Park, Colorado 80517 Re: 18 Hole Golf Course Boundary Dear Mr. Castleberry: As you have requested, this letter is to advise you of the Town's position regarding the eastern boundary of the 18 hole golf course as it relates to Mr. Van Horn's property. As you know, this boundary has been the subject of several meetings between the Town and Recreation·District. It has also been discussed at length by the Public Works Committee of the Town Board. It is my understanding that upon advice of legal counsel, the Town was not interested in pursuring the boundary question in court, at least at the Town's expense. The Town indicated interest in the land trade, if it were acceptable to the Recreation District, which was the purpose of our meeting with you on May 8, 1986. Box 1200 BY....-- Estes Park, Coloradio 80517 Dear Rich: As you know, a portion of the east boundary of the Municipal Golf Course is adjacent to the Paul VanHorn property, down near Fish Creek Road. Several months ago, a dispute arose with respect to that boundary. At that time, it is my understanding that the Town turned over the resolution of the matter to the Recreation District. The Recreation District and Paul VanHorn have reached a settlement. Of course, this is not the actual location of this piece, as it is at the north end of the VanHorn property. The second deed resolves the boundary line dispute, by the Town conveying to VanHorn the piece of property lying between the fence and the center of the creek. The first easement agreement is the grant of an easement by VanHorn to the Town, for a service road access, as the Recreation District needs to construct a service road down along the easterly portion of the golf course to the piece of land which VanHorn is conveying to the Town, and they needed this easement to get around a tee box. I have shaded this easement area in red on the drawing. t. - Mr. Richard Widmer April 26, 1988 Page 2 The fourth document is a scenic easement upon the property between the fence and the center of the creek. This description is slightly different than the description used with the deed from the Town to VanHorn because in the deed the center of the creek was used while in the description for the scenic easement exact calls are made which approximate the center of the creek. This is because the center of the creek was historically used in various deeds, so that it should be used in the deed clearing upon the boundary line dispute - while we requested specific calls down the center of the creek in the scenic easement, in case the creek moves. The last document is the license agreement which simply grants a revocable license to VanHorn to graze up to three horses on the parcel which VanHorn is conveying to the Town. Would you please review these documents, and I am sure that you will want the Town Attorney to do likewise - and then advise me just as soon as possible. ' .er 1 ... EASEMENT AGREEMENT This Agreement, entered into this "- - day of May, 1988, between Paul H. VanHorn, as Grantor, and the Town of Estes Park, Colorado, as Grantee and easement owner, is as follows: 1. In consideration of the covenants herein set forth, and for other good and valuable consideration the receipt of which is hereby acknowledged, Grantor hereby grants and conveys unto Grantee, a perpetual, exclusive conservation easement in gross, pursuant to CRS 38-30.5, with respect to, over and across the real property described upon Exhibit A which is incorporated herein by this reference, and which real property is owned by Grantor. 2. Grantee, as owner of this easement, shall have the right to prohibit, or require a limitation upon uses and acts of Grantor, Grantor's successor in title, as well as all others, with respect to said real property and the airspace above it, which prohibitions and/or limitations are appropriate to the retaining or maintaining of the said land and airspace in a natural, scenic or open condition. Included in this right but not in limitation of it, Grantee shall have the right to prohibit or limit the construction of any improvements upon or over said land, except fencing and soil conservation measures along and within Fish Creek, together with grazing, shall reasonably be allowed so long as the same do not interfere with the scenic or open condition of said real property. Nothing herein shall be construed so as to prevent entry upon the I property for the purpose of repair or installation of underground utilities, so long as the surface is restored. 3. Grantee shall have no duty or obligation to maintain or to make repairs of any nature upon the land, including but not in limitation to fencing or Fish Creek conservation measures. -1- '10 .. 4. VanHorn (herein called Licensee) is upon the following terms and conditions: 1. For good and valuable consideration the receipt of which is hereby acknowledged, the Town hereby grants to the Licensee the right to use the real property which is described upon Exhibit A which is incorporated herein by this reference, for the purpose of grazing horses thereon, during the period of this license. 2. Licensee agrees that at no time will he graze more than three horses at the same time upon said land. 3. Licensee shall maintain the necessary fencing, and shall locate and relocate the same at the request of Town or its assigns. 4. Licensee hereby agrees to hold Town and Estes Valley Recreation & Parks District together with the employees, directors, trustees and assigns of Town and of said District, harmless from any claims and demands of any nature whatsoever for personal injury (including death) and property damage caused or alleged to be caused to any person or property during the term hereof, as a result of Licensee's horses being upon Town's property, whether said action is based upon negligence, breach of warranty, strict liability or any other theory or basis whatsoever, including reasonable attorney fees and costs which are incurred by Town and said District in the defense of the same. 5. Town, or its assigns, may terminate this license at any time, without cause, upon twenty day's advanced, written notice. 6. This agreement shall be binding upon the parties hereto, their heirs, devisees, successors and assigns. C 4Cis~ft Estes Park, Colorado 80517 May 19,4988 Mr. Richard Widmer Public Works Director Box 1200 Estes Park, CO 80517 RE: Public Works Week Dear Rich: Personnel from Parks, Water, Streets and Fleet Maintenance provided excellent displays and information for Public Works Week. I wish to recognize their efforts as follows: Fleet Maintenance - The police vehicle and REO were spotless, and provided a good example of the care the Town's equipment receives under the direction of Gary Shanafelt and Dave Mahaney. Streets - The snow removal route map prepared by Roy Johnson illustrated the planning and organization necessary to keep the community's roads driveable in the winter. The new wooden street signs, such as those prepared by Robert Hirning, set an important image and are a valuable guide for our visitors and emergency services. Water - The display of a water service system showing the pipe, valves and meter connections, provided valuable information on a system that is rarely seen by most of the public. Grant Cole, Dean Cornelius and Rick Leahy ably explained the intricacies of this operation. Informatidnal handout which listed various flowers, wildflower mixes, trees, and shrubs growing in the Town's parks and identified the location in which to observe them. e Approximately a dozen different varieties of flowers and shrubs that will soon be planted. A complex irrigation valve and control system. e Some of the equipment used in the maintenance of the Town's parks. Park's personnel put a considerable amount of time and effort in the preparation of these displays. Dan Speedlin, Russ Franklin, Ken Zigler and Susan Elkins were invaluable in explaining the use and care of plant material in the landscape. The personnel who represented these divisions at the exhibit on Wednesday, May 18, 1988, provided excellent public relations for the Public Works Department. As representatives, their efforts reflect favorably on all Public Works employees. It was very evident that employees in each division have a significant amount of pride, not only in his/her work, but the community as a whole. A job well done. Stamey Town Planner SLS:lm MEMORANDUM May 19, 1988 TO: Public Works Committee FROM: Rich Widmer -ADO RE: Appraisal Proposals for Moccasin Saddle Requests for porposals to appraise four parcels of right-of-way for the Moccasin Saddle road project were sent to five MAI appraisers who do work in the northern Colorado area. Proposed work is for two bound narrative appraisals and two letter appraisals. All of these people have done work in the Estes area. Proposals were received from two, as follows: Appraisal Services-Real Estate Inc. $4,600 WestTerra $5 - 6,000 + expenses Believing both to have essentially equal qualifications and experience, I recommend the town hire Appraisal Services to perform,the appraisals.
