Baylis, purchased Lots 7, 8, 9 and the west 1/2 of Lot 10 of Websters Subdivision in Estes Park. I am writing at his request and in his interest. Our intent is to develop the property and in order to make the best use of the land would like to use the alley down the center of the subdivision. At least two other land owners in the subdivision have expressed the same intention to me. However, some of the owners have fenced off the alley and made this impossible at this point. We were told that this was likely a civil matter, but in researching the access status of the property we discovered the enclosed documents that clearly show that this alley has been dedicated to public use and seemingly would be under the authority of the Town of Estes Park. We, as well as other owners, would like verymuch to use this alley as it was intended. Would it be possible for the town to enforce the intended use arid get the encroachments removed? Enclosed please find a map of the subdivision with the approximate locations of the encroachments that I know of. Please note that our fence is also in the alley about 3 feet and that we will move it to the property line in the near future. Box 1200 Estes Park, CO 80517 Dear Dale: Pursuant to your request, I am providing you with an opinion regarding certain aspects of vacating public alleys in Estes Park. 1. Section 43-2-303 C.R.S. provides that the Board of Trustees may by ordinance vacate any of its public roadways, including alleys. However, no alley may be vacated so as to leave any land adjoining said alley without an established public road connecting the land with another public road. 2. The above section also provides that the vacation ordinance may reserve continued use of any existing utility lines, including telephone. The vacation ordinance would have to specifically provide for that reservation. It is my opinion that the Town may not reserve any future utility easements. However, once the alley is vacated, the abutting land owner could dedicate future utility easements. 3. Section 43-2-302 C.R.S. provides that less than the entire width of the alley may be vacated. This amount included $15,000 to hire an apprentice mechanic so the fleet manager could have the time to operate the fleet management system. This is a significant expenditure, but one which I believe will enable us to operate in a more business-like manner. In discussing the proposed system with vendors and other fleet owners, it is apparent that one of the benefits of installing such a system is the cost savings in various areas that result. These are estimated on Attachment 1. This cost savings estimate indicates a payback in about 2 1/2 years for the hardware/software. The cost of the additional mechanic would be recovered by interdepartmental charges for vehicle work performed, depending upon the charge rates used. Further savings, although hard to quantify, would accrue with the fuel management portion of the system. Just one undetected fuel leak can cost many thousands of dollars in cleanup and fines. I realize that some may question these figures; however, according to my information, these percentages have actually been shown to be conservative when applied to other fleet operations. Many other fleets have had computerized management for several years. Fort Collins, for instance, has had a system since 1980. Because of the strong belief we in Public Works have for the worth of this system to the town, we would be willing to forego some proposed budgeted purchases to make the system a reality. By eliminating three street equipment items and three shop equipment items, $48,800 could be saved. I believe the remainder could easily be found if necessary. In summary, I believe we should consider very carefully whether our $1.5 million fleet of equipment is being adequately managed using our present methods. I believe that much improvement can be made, and therefore recommend that the suggested fleet management system be approved in the 1988 budget. Parts Inventory - It is estimated that about 10% of the total parts inventory will be saved due to an anticipated reduction in parts stocked by more accurate accounting, identification, and planning of required stock. Estimated Yearly Savings: 10% of Total Parts Inventory Value $10,325 x 10% = $1,033 2. Parts Warranty - Many parts have a warranty period. The system has the capability to tract warranty periods and flag warranty failures that allow the defective part to be retrieved and returned for credit. Estimated Yearly Savings: 8% of Total Parts Inventory Value $10,325 x 8% = $826 3. Preventive Maintenance - An effective automated P.M. scheduling program will reduce field breakdowns, decrease maintenance costs, and decrease fuel and oil consumption. Estimated Yearly Savings: 5% of Total Parts, Labor, Outside Costs $21,031 x 5% = $1,052 4. Labor Productivity - Reporting of work done against industry standards. Estimated Yearly Savings: $51,700 x 5% = $2,585 5. Acquisition - Use of system information allows more accurate evaluation of replacement candidates and decreased downtime as well as replacement at opportune moments in the life cycle. Estimated Yearly Savings: 5% of Total Equipment Acquisition $243,500 x 5% = $12,175 6. General Operatons Improvement - Through increased management control, there has been shown to be a general productivity increase over and above these savings for the total operation.
