Box 536 Estes Park, CO 80517 Dear Sir: On May 28, 1987, the Town was informed by the owner of Lots 7, 8 and 9 and West half of Lot 10 of Websters Resubdivision, Estes Park, Colorado, that there was a fence encroaaching upon the alley dividing Lots 7 through 12 and Lots 1 through 6 of Websters Resubdivision. The Town has reviewed this matter and determined that the alley between the aforementioned lots has been dedicated to public use and, therefore, is titled in the Town of Estes Park. The Town Public Works Committee considered this on June 24, 1987. The Town Board approved this action at its meeting of July 14, 1987. Please remove all encroachments on the alleyway on or before September 15, 1987. The exact location of the 16 foot wide alley should be defined by existing property pins. Please be advised that if your encroachments are not removed by the above date, the Town will remove the same and bill you for the costs. Box 1200 Estes Park, CO 80517 Dear Dale: Pursuant to your request, I am providing you with an opinion regarding certain aspects of vacating public alleys in Estes Park. 1. Section 43-2-303 C.R.S. provides that the Board of Trustees may by ordinance vacate any of its public roadways, including alleys. However, no alley may be vacated so as to leave any land adjoining said alley without an established public road connecting the land with another public road. 2. The above section also provides that the vacation ordinance may reserve continued use of any existing utility lines, including telephone. The vacation ordinance would have to specifically provide for that reservation. It is my opinion that the Town may not reserve any future utility easements. However, once the alley is vacated, the abutting land owner could dedicate future utility easements. 3. Section 43-2-302 C.R.S. pr6vides that less than the entire width of the alley may be vacated. As there will be construction on both sides of Fall River, two work areas are required. The north bay of the Dark Horse Parking Lot will be closed; however, access /parking will still be available to the Nagl Bridge. The enclosed area is shown on the attached sketch. R. C. Heath Construction Company will be responsible for returning the lot surface to its original condition following project completion. The Continental Oil Parking Lot will be used as a paver, rock wall, and sandstone storage area during the first four months of construction. As work is completed on the north side of Fall River, it will become the project management site. Box 1200 Estes Park, Colorado 80517 Dear Mr. Widmer: This opinion is written pursuant to the request of the Public Works Committee that I review the situation concerning the possible vacation of a Town street or right-of-way located in the University Heights Section of the Town. My opinion is based upon the following understandings: 1. The Town street or right-of-way is a dedicated public right-of-way. 2. Said public right-of-way has not been maintained by the Town, and the Town has not accepted the right-of-way for maintenance purposes. 3. The owners of Lots 5, 6, and 10 of University Heights have asked the Town to vacate the street abutting their property with the understanding that they will provide a private access easement for access to their Lots and Lot 2 of Sanders Resubdivision. 4. The owner of Lot 2 of Sanders Resubdivision has objected to the vacation and indicated that he will protest any attempted vacation of the public right-of-way. Section 43-2-303(2) C.R.S., 1973 provides that no roadway shall be vacated as to leave any land adjoining said roadway without an established public road connecting said land with another established public road. It is my opinion that the vacation of the public right-of-way would violate the provisions of this Section of the State Statutes. This opinion is based upon the understanding that 47 .. Mr. Richad Widmer September 16, 1987 Page Two the owner of Lot 2 would not consent to the vacation in return- for the establishment of the dedicated private right-of-way. However, it is my opinion that if the owner of Lot 2 does consent to the dedication of the right-of-way and waives any claims against the Town for the vacation of the public right-of-way, the Town may go ahead and vacate the road as proposed. This is based on the fact that all landowners abutting the roadway would consent to the vacation of the road. - As a part of this opinion I would like to direct your attention to the accompanying exert from McQuillin Municipal Corporations, Section 30.31, which discusses the opening of a public street. As you can see from the discussion in this Section, it is within the discretion of the Town whether or not to open any dedicated public street. Since the Town has never opened the street and maintained the same, the Town has no responsibility to maintain or open this street. It is my understanding that the owner of Lot 2 may be relying on his belief that the Town will maintain this street with regard to his opposition to the vacation of the street. Estes Park, Colorado 80517 BY...- Dear Mr. Widmer: I am writing in advance of your meeting scheduled for September 17 to again go on record relative to the future of the Town's alley which adjoins my property in University Heights. While I believe that Mr. Crow and Mrs. Adams are basically in agreement with my position, there has not been time since our return to Omaha to contact them further. I am, therefore, speaking for myself as follows. 1. I am strongly opposed to upgrading this alley so that it becomes more attractive to the casual motorist. I believe that all four property owners cherish the privacy which we now enjoy. In general, I would like to preserve the natural setting of the roadway with trees, bushes and rock outcroppings. 2. You have in your possession an engineer's drawing which shows the location of the present roadway in contrast to the location of the dedicated alley. I call attention to the unrealistic contour of the dedicated alley and the fact that the east boundary on my lot #6 is located 4 feet from my garage and less than 14 feet from my front steps. I would like very much to dedicate part of my lot #9 for the public alley as it exists in exchange for the Town's vacating the awkward, acute angle which adjoins my lot #6 on the platted public alley. I know that Mrs. Adams likewise is in favor of a slight trade-off on the northernmost portion of her lot #10. Please advise me further if there are steps that can be taken toward this end. I wish to take this opportunity to thank you and the Town Board for consideration of this matter. I regret that the owner of Sanders Addition feels that he was not consulted by the other property owners. As a matter of record, I would point out that at no time during our 3 months stay at 1024 University Drive did said owner make any attempt to speak to me, let alone discuss the problem. Ravesloot's property Dear Mr. White: The intent of this letter is to reaffirm our position that C.R.S. 43-2-303(2) controls the Town of Estes Park's ability to vacate the above referenced alley. As I recall our telephone conversation, you stated you did not agree with my interpretation of this statute. I feel however, that the plain meaning of the statute speaks for itself. The statute uses ordinary words and unless there is clear legislative intent to the contrary, these words are to be given their usual, common meaning. Therefore, a statute stating that no roadway or part thereof shall be vacated so as to leave any land adjoining said roadway without an established public road connecting said land with another established public road, means just that. In addition, Roth v. Wilkie, 354 P2 510 (Colo. 1960) states that a landowner has special private property interests in continued maintenance of the street to his property and has the right of recovery against those upon whose application the street was vacated. If the Town of Estes Park or Dr. Ravesloot's neighbors make an application for the vacation of this alley, and the vacation is granted, the Dr. may take steps to recover the damage he incurs due to this vacation from his neighbors or the 7,wn of Estes Park. Box 1200 Estes Park, Colorado 80517 Dear Mr. Widmer: I am writing as owner of property at 2850 Fall River Road, Estes Park, Colorado which we purchased in May 1980, regarding the notice of closure of the cul-de-sac that is part of the fishery project. It was my understanding at the time of purchase that access around the cul-de-sac had been available to all the property owners for over twenty-three years. Therefore, I feel our right-of-way should be "grandfathered" because after so many years of use I believe the law allows permanent access. Please give your utmost consideration to this matter, as closure of this road on such short notice will cause all property owners to be financially hurt. Dear Sir; In reference to your recent letter concerning the fencing of the turn-around on Fall River Road, as a landowner at 2852 Fall River Road I am hereby opposing such action. If the homes along this road are de- prived of a turn-around at the west end of the one lane road, this could cause inadequate police and fire protection to these residents of this area. I realize that the turn-around is on city property, but it should be remembered that it has been continuously used through the years--to my knowle dge before 1960. Requests for proposals (RFP's) were sent to the four local surveying firms on July 20, 1987, seeking proposals for the surveying, monumentatlon and mapping. One of the two responses received for the surveying work proposed an alternate to include design Of the street that was less expensive than the surveying work alone. After analyzing the proposal, I concurred with the consultants position that there may be surveying costs that could be saved by combining the design and surveying work. A new RFP was issued on August 24. 1987 that requested proposals for the entire design and surveying project with the end product being plans and specifications ready for bid. Three proposals were received and are compared below along with the responses from the first REP. Inc. to survey, design, and prepare contract documents for the Moccasin Circle street project. FROM: Richard Widmer ~ DATE: September 16, 1987 RE: Woodworking Shop Dust Collector The 1987 budget contains a $6,000 expenditure for a sawdust collection system for the Public Works woodworking shop. This is the area where all new wooden street signs are cut, routed, and sanded. A large amount of potentially hazardous wood dust is created and an adequate dust removal system is mandatory. Varous systems have been evaluated, and two bids have been received from vendors: DCE, Inc $3,538 + wiring Air Sentry 4,137 + wiring This price includes a ducted collection system for three machines. The Air Sentry system is preferable to us because the collection motor and fan is outside the shop, resulting in a much quieter operation. The DCE system will have to be mounted in the vehicle maintenance area, resulting in additional noise and space limitations in this area. In addition, the Air Sentry ductowork is air-tight soldered connections while the DCE is spiral wound duet with taped joints. We therefore recommend the bid of Air Sentry in the amount of $4,137 + wiring (approximately $500) be accepted. ESTES PARK PUBLIC WORKS DEPARTMENT .
