Box 1200 Estes Park, Colorado 80517 Dear Mr. Widmer: Pursuant to your letter of July 17, 1987, regarding maintaining an alley located adjacent to our property in University Heights, the undersigned wish to make the following ooservations, comments, and recommendations thereto: Whereas, the subject alley has not been maintained by the Town of Estes Park in the past, and Whereas, the Town has no real obligation to do so, and Whereas, such maintenance and improvements as outlined would tend to make the alley more attractive to casual outsiders, and Whereas, such improvements should be made in accordance with the location of the alley as platted which differs substantially from the location of the existing roadway, and Whereas, such improvement would require a turn-around to be located on someone' s property at . its south end, and Whereas, we wish to minimize unnecessary use thereof as well as preserve our relative isolation from such casual use, and Whereas, we recognize the necessity of guaranteeing access by motor vehicle to all four of the adjacent property owners so that no one becomes landlocked, We do hereby suggest and recommund that the alley as shown on your enclosed map be vacated by the Town of Estes Park and be legally transferred to the property owners, and That such property owners grant a permanent access easement to the present and future owners of any and all lots touched by this easement, and That this easement shall use the roadway as it exists today rather than as platted, and That any maintenance and graaing due to washouts or encroachments shall become the responsibility of the adjacent property owners, ana That a legal, unobtrusive sign be posted at the north end of the alley stating "Private Drive." f r / It is our understanding that the Town attorney would take care of the legal work involved at no charge to us, but that a surveyor t would have to be hired to survey the proposed easement for the legal description. It is our proposal that the four (4) present property owners share equally in this expense as beneficiaries of this proposal. The undersigned are taking this step without the input of the owner of Sanders Addition inasmuch as he is reportedly out-of-town. We do recognize that this document does not resolve his desire for free snow removal, but we do feel that this course of action will avoid considerable expense, will result in a straighter roadway, and will preserve our relative privacy. We respectfully recommend that any necessary plowing of snow be contracted for by the desiring party, at his or her expense. We wish to further state that the foregoing is based on our present understanding of what probably is a complicated issue. We would be pleased to be part of a further discussion which would involve all property owners and representatives of the Town of Estes Park. Respectfully submitted, Roger B. Ravesloot's property Dear Mr. Widmer: This letter is to inform you that our law firm is representing Dr. Ravesloot in the above-referenced matter. Your letter to Dr. Ravesloot of July 17, 1987, states that, to your knowledge, the town has never maintained the alley adjacent to his property. For your information, last year, at Dr. Ravesloot's request, the town did remove snow from this alley. The town's authority to vacate this alley is controlled by Colo- rado Revised Statute 43-2-303. C.R.S. 43-2-303(1)(a) states that a city council or other similar authority of the city or town, by ordinance, may vacate any roadway or part thereof located within the corporate limits of said city or town, subject to the provi- sions of the charter of such municipal corporation and. the con- stitution and statutes of the State of Colorado. C.R.S. 43-2-303(2) states no roadway or part thereof shall be vacated so as to leave any land adjoining said roadway without an establish- ed public road connecting said land with another established public road. Therefore, your statement that the town's vacation of this alley could only be accomplished if adequate access easements were granted, so that no property would become landlocked, is incor- rect. These improvements include paving Axminster Lane from the end of pavement within Devon Hills to the Southern boundary of proposed Woodlands Subdivision and from Pine Knoll Drive within One Thousand Pines to the northern boundary of proposed Woodland Subdivision. The subdivider shall install such electric service and distribu- tion system and such street lightin system, as shall be d atermined by the town. Where the public , sanitary sewer system, in the opinion or tne town, the Estes Park sanitation district, the Upper Thompson sanitation district, and the county health department, is reasonably accessible, the property owner shall construct a complete sanitary sewer system, in accordance with the specifications of the state, the Estes Park sanitation district, the Upper Thompson sanitation district, the county health department and the town, including a connection for each lot. Where lots cannot be served by the extension or an existing public sanitary sewer, the property owner shall obtain approval of lot sizes from the town and the county health department for individual septic tanks and disposal fields, or approval of ... a neighborhood disposal system. The provisions or Enis section shall not waive the requirements of nor compliance -- with any provisions of the Estes Park Municipal Code, or the requirements of the county health department, relating to sewers, septic tank and disposal fields. The subdivider shall install adequate conduits, drains and provisions for storm water drainage as may be required and approved by the town. The drainage study should be revised to size the Axminster Lane culverts for the entire upstream basin for a 100 year storm. The study should also use the runoff coefficients developed in the Prospect Mountain drainage master plan. When the final drainage study is submitted with the final plat, it should also analyze the 2-yr frequency storm and should size the detention pond outlet to release historic 2 yr flows as well as 100 yr flows. 2. Roadside ditches should not be used on Woodland Lane due to erosion potential on this 10% grade. Instead, the Town should require asphalt curbing along this street. In the event the drainage is to flow in the natural swales across the middle of the lots, a drainage easement should be provided. 4. The right-of-way width for Woodland Lane could be reduced to 50 feet. 5. A landscaped island may be left in each of the cul-de-sacs. In addition, Woodland Lane may be designed to retain mature trees if safety hazards are not created. 6. Maintenance of the proposed detention pond is a concern. If feasible, it should be maintained by a homeowner's association or similar entity. It should be located upon an easement which allows emergency access and should be designed to handle overtopping without failure. 7. The developers will be required to pave Axminster Lane and h install a 6" water line from Pine Knoll Drive to the existing asphalt of Axminster Lane in Devon Hills. 8. Box 1200 Estes Park, Colorado 80517 August 3, 1987 1 Dear Mr. Mayor: I am writing to you requesting that a guard rail be installed on the outside curve of Peak View Drive between Longs and Twin Drives. I feel that this guard rail is very necessary in order to prevent more property damage or a possible death on this curve. Peak View Drive is no longer a City street. It is a highly traveled thorough-fare where auto's, trucks, and motor cycles are often exceeding the speed limit and driving recklessly. I have had my fence distroyed 6 times. I have pictures showing the damage of sections of my fence distroyed. This has hapnened 3 times in the last 10 months, the last being Sunday morning 8/2/87 at 2:11 AM. A Toyota was air-borne for 25 feet, leveling the telephone utility box, taking out hi sections of our fence, turning over, and coming to rest in our yard. I have tried to make this curve more visible by installing 11 reflectors, and keeping the bar pit mowed and free of tall weeds. As you can see, this has not helped. I am very concerned, tired of the expense, tired of the work, and tired of the excitement and stress this has caused. It is now up to the Town of Estes Park to do something to prevent this property damage, injury, and possible death due to this "high speed" curve. We have inspected the situation in the field (a map is attached for reference). It is our recommendation, after reviewing the situation, that a guardrail not be installed but the speed limit be reduced instead to 25 mph from Longs Drive east to Highway 7, and that the curve be marked more distinctly with large chevron arrows. A guardrail installation would be relatively expensive ($2,500-$3,000 for 100 lf) and, if justified at this location, would be equally appropriate at dozens of other locations around Town.
