Reference: Old Ranger Drive Paving Dear Mr. Widmer: In response to the Public Works Committee questions concerning annexation, I have checked into the issue with several departments and offer the following: 1. The legal opinion seems to be that UNC can make no legally binding committment limiting use or development of the Old Man Mountain property. As this was primarily a concern on behalf of the town, it seems pointless for us to initiate such action. We have no objection to Estes Park initiating the action. 2. UNC has no interest in "urbanizing" the area, nor in "integrating" town services (such as sewer, street lighting, or roads) within the property. The site serves a retreat function for University groups, and we have no intentions beyond maintenance of the existing buildings and property. Again, our concern has been and continues to be access to the property. 3. I have talked with UNC Director of Public Safety, Mr. Gary Bress. Mr. Bress is quite willing to discuss possibilities for Estes Park police protection on the property, which is another concern expressed by the Committee. There seems to be several options open for resolving this issue without annexation. For the above reasons, the University has decided not to pursue annexation at this time. The decision was made not as a serious objection to annexation, but rather that there was insufficient benefit to the University for us to take the initiative. Mr. Richard Widmer Old Ranger Drive Paving Page 2 The problem of access to the property still remains. We feel the only way we can ensure adequate, year around access to our property is to pave the road. Therefore the University of Northern Colorado requests permission to pave that portion of Old Ranger Drive from the end of the existing paving to the Old Man Mountain property line. This will be done at no cost to the town of Estes Park. We will make every effort to meet local requirements for such work, in cooperation with your department. Priorities have been set, as in the past, by using the Pavement Management Study done for the Town in 1983, along with engineering judgement and field inspections. This year's project proposes about two miles of overlay, three areas for new paving, miscellaneous curbing, a seal coat for streets overlaid in 1984 and 1985, an overlay of the American Legion parking lot, paving of some of our gravel park paths and some pedestrian path widening and overlay, at the estimated prices shown. If bid prices vary significantly from the estimate, the project list will be modified to bring the project in line with the budget. P O. Baylis, purchased Lots 7, 8, 9 and the west 1/2 of Lot 10 of Websters Subdivision in Estes Park. I am writing at his request and in his interest. Our intent is to develop the property and in order to make the best use of the land would like to use the alley down the center of the subdivision. At least two other land owners in the subdivision have expressed the same intention to me. However, some of the owners have fenced off the alley and made this impossible at this point. We were told that this was likely a civil matter, but in researching the access status of the property we discovered the enclosed documents that clearly show that this alley has been dedicated to public use and seemingly would be under the authority of the Town of Estes Park. We, as well as other owners, would likeverymuch to use this alley as it was intended. Would it be possible for the town to enforce the intended use and get the encroachments removed? Enclosed please find a map of the subdivision with the approximate locations of the encroachments that I know of. Please note that our fence is also in the alley about 3 feet and that we will move it to the property line in the near future.
