MACHINERY- To transport and smooth the snow. The last two years we were fortunate to get a road grader, dump trucks and even the use of the water pumper truck. With this equipment and the manpower we were able to set up an excellent course that proved to be very stable. HISTORY- The weight pull held last year at Estes Park ranked fourth Internationally in course evaluation and Handler/dog participation. MEMORANDUM TO: Rich Widmer - 1 FROM: Dick Gerstberger . 1, DATE: January 19, 1987 SUBJECT: Fawn Lane Paving Project Requests for proposal (RFP's) were sent to the four local surveying firms on January 2, 1987. The project consists of two phases. First, the contractor will conduct a survey and prepare a topographic and planimetric drawing of the existing property and rights-of-way necessary for the design and paving of Fawn Lane. When the street design has been completed by city staff , the contractor will prepare a legal description, field locate the final right-of-way centerline, and monument right-of-way and property corners. Schedule for the project was set by the RFP at eight weeks for Phase I and three weeks for Phase II. Proposals were received January 16, 1987. The estimates range from $1,690 from Precision West to $5,208 from Rocky Mountain Consultants. TOWN OF ESTES PARK BY............................,....._.- ....... THIS AGREEMENT made this day of , 1987, by and between The Upper Thompson Sanitation District, a special district organized under the laws of the State of Colorado, hereinafter called "UTSD", The Town of Estes Park, a municipal corporation, hereinafter called "Town", and Larimer County, hereinafter called "County", is made upon the following terms and conditions: The following statements of fact are a material part of this agreement: A. UTSD was organized for the purpose of furnishing sanita- tion services to properties located within its district, includ- ing construction, operation, maintenance and repair of sewer collection lines. B. The Town and County both own property situated on Elm Road, located in the Town of Estes Park, which includes mainte- nance shops for both governmental bodies. C. Elm Road is an existing public· right-of-way in the Town of Estes Park and is owned and under the jurisdiction of the Town. D. It is for the benefit of both the Town and the County that an eight inch sewer collection line, presently located in the right-of-way of U.S. Highway 66, be extended onto Elm Road, so that service can be available to both properties owned by the Town and County. E. The parties agree that they will participate in con- structing the extension of the eight inch sewer collection line, based upon the terms and covenants contained in this agreement. NOW, THEREFORE, in consideration of the mutual promises and covenants hereinafter set forth, the parties agree as follows: 1. Extension of Existing Sewer Collection Line. The exist- ing eight inch sewer collection line on U.S. Highway 66 shall be extended on Elm Road for an approximate distance of 2,285 feet, the cost and the method of construction of which shall be in accordance with this agreement, as hereinafter provided. 2. Cost Of Construction. The cost of construction is hereby defined to include all costs for engineering, labor, materials, legal publications, attorney fees incurred in the preparation of this document and costs for any performance and/or payment bond as may be required under either the construction contract or by statute for public works contracts. The term "cost of construction" shall not include any work performed by UTSD, Town or County or any of its employees in the project. The term also shall not include any supervisory services furnished by UTSD as hereinafter provided. Any easements which may be reasonably required for the line shall be furnished, without compensation, by the parties to this agreement that have an interest in the land in which the easement will be located. Unless otherwise provided herein, the total cost of construction, as herein defined, is estimated to be $54,000.00. Each of the parties hereto shall pay one-third of the cost of construction. 3. Inspection and Course of Construction. UTSD agrees to supervise the entire project, which shall include: (a) Employment of engineers. (b) Providing all of the bidding documents, which shall be in the form customarily used by UTSD in sewer construction pro- jects.
(C) Award the contract, provided, however, that the apparent successful bidder and the terms thereof, including the contract price, shall be submitted to the County and Town for approval before such contract is awarded. (d) Establish schedules for periodic payments to be made under the terms of the contract, which shall be on a monthly basis. (e) Act as disbursing agent for the collection of payments due from the other parties to this agreement and to make payments to the engineers, contractors and any other persons involved in the project, pursuant to the contract so awarded, and to make an accounting of all such payments to the County and to the Town. (f) Devise and provide for schedules of progress and completion of the work. The final completion is estimated to be May 1, 1987. The parties ackowledge receipt of copies of the proposed bid documents, including the proposed form of contract as used by UTSD, and do hereby approve the same. UTSD further agrees to comply with all statutory requirements for bidding of public works projects, including publications and bond requirements, and shall further require that ten percent (10%) of all payments to be made under the contract of construction ,shall be retained un- til final inspection, approval and acceptance of the lines, as hereinafter provided. Requests for periodic payments shall be made on a monthly basis, and the Town and County agree to promptly make such payments to UTSD. UTSD shall, with each request for payment, furnish a copy of the contractor's request for payment, together with a summary of all work completed to that time. Written notice of UTSD's approval of the request shall also be given to the Town and County. The parties further acknowledge that Estes Park Surveyors & Engineers, Inc., have been employed as the engineers for the job and for the purpose of performing engineer- ing services in the project. The amount for such services ren- dered to date is $3,305.00 and is to be paid immediately or shortly after the signing of this agreement. By signing of this agreement, the parties approve the employment of the engineers and acknowledge that the execution of this agreement is deemed to - be the first request for payment. UTSD shall also supervise the progress of construction and shall inspect the completed line prior to acceptance thereof. The Town and/or County may also inspect the progress of the con- struction, as well as the completed line before acceptance. Provided, however, that since UTSD will become the owner of the line as hereinafter provided, UTSD shall have the final determi- nation whether the line has been completed in a good and workmanlike manner and in accordance with the contract specifi- cations and documents. 4. Ownership of Line. Upon completion of construction, final inspection and acceptance by UTSD, UTSD shall be deemed to be the owner of the line. As such owner, it shall be the sole responsibility and obligation of UTSD to maintain, repair and replace the line. If requested by UTSD, the County and the Town agree to execute such documents as may be required by UTSD to evidence such ownership. However, the ownership shall extend only to the line and not to any interest in the land in which the line is located, except as may be granted by the easements, as aforesaid. 5. Tap Fees and Service Charges. The participation by the Town and County in the cost of construction shall not include the tap fees and service charges as adopted by the Board of Direc- tors of UTSD. The Town and County shall be obligated to pay the tap fees for hooking onto said collection line and further pay -2-
. I 6 . service charges as established from time to time hereafter by UTSD. All such tap fees and service charges shall be consistent with those charged to and paid by all other users of said line. 6. Miscellaneous Provisions. The parties further agree as follows: (a) In the event that any party should enforce the terms of this agreement in a court of competent jurisdiction, the prevail- ing party in such litigation shall be entitled to its reasonable attorney fees and expert witness costs and any other court costs reasonably incurred in the prosecution of such litigation. (b) This agreement has been duly approved by the governing bodies of the three parties to this agreement at meetings properly held pursuant to statute and/or procedures duly adopted by said governing bodies. (C) All contract documents and specifications are incorpo- rated herein by this reference and shall be deemed to be a part of this agreement.
