BY.---- ~4£41 Mr. Rich Widmer Town of Estes Park Post Office Box 1200 Estes Park, CO 80517 RE: Moccassin Bypass Dear Rich: This letter is written pursuant to your request that I summarize in writing our discussion concerning the Moccassin Bypass. 1. In order to comply with the requirements of 31-12-101 et seq., C.R.S., 1973, at least 50% of an area to be annexed needs to sign the annexation petition. The 50% requirement is determined by actual land area, not ownership. In looking at the plat, it appears that through the use of town property, property owned by individuals who would sign an annexation petition, and property owned by individuals who or whose predecessors have signed recorded water tap applications, there is enough property to meet the 50% requirement. It should be noted that there is also a one-sixth contiguity requirement but that appears to be met by any possible configuration of lots to be annexed. 2. In reviewing the appropriate water tap applications, it became apparent there are two different applications. The two applications signed by Mapp and recorded on February 14, 1975 and that signed by McFarlands recorded January 20, 1975 contain language requiring the petitioners to sign annexation petitions if the town so desires. However, said applications do not contain any language allowing the town to sign for the landowners. The application executed by the Tjossems recorded July 14, 1976 contains a provision that allows the town clerk to execute the petition on his behalf if he refuses to do so. It is my opinion that if the individuals on the two earlier petitions do not voluntarily sign the annexation petition, it will be necessary for the town to go to Court to force the h4- Mr. Rich Widmer Town of Estes Park October 7, 1986 Page 2 landowners to sign the annexation petition. Section 31-12-121, C.R.S., 1973, provides that any agreement to annex, such as the two earlier applications, shall be enforceable by an action for specific performance in the District Court. It is my opinion that the later agreement signed by the Tjossems can be enforced, after proper notice, by the Town Clerk signing the annexation petition. The total length of the sewer line discussed, from the District's present line to the entrance of the State of Colorado Shops on Elm Road, is approximately 2,688 feet. Our best estimate of the cost of the line construction is $67,000.00. If an agreement should be reached by the four govern- mental agencies involved, whereas each agency shares an equal cost for the line, the cost per agency would be approximately $16,750.00. All counties are asked to solicit input from cities and towns for inclusion in the request. Attached, for your review, is a list of last years requested projects, the 1995 and 2010 Recommendations from the recently completed North Front Range Corridor Study and a copy of the 1986-1990 Department of Highways Five Year Plan for District 4. Please review this information carefully and advise this office regarding projects on the State Highway system that you would like to see included in future 5 year plans. Any additional description of work or justification for proposed work will help me to complete the necessary forms for each project. In addition to the submittal to the State, I am preparing for update of Larimer County's Short Range Highway Improvement Program and would like input from you. I have enclosed a copy of the current plan (1986 to 1989) for your information. Your input and requests will be considered in prioritization of projects for coming years. Box 1200 Estes Park, Colorado 80517 Dear Sir: Chief Robert Ault, of the Police Department, has requested permission to use my road and install a radio station on Prospect Mountain. He advised me that the station is for the National Law Enforcement (NLEC) frequency. I would be pleased·to cooperate with the Town in this matter, however problems have developed in connection with the Town's present use of the road, which I believe will require a new agreement concerning the maintenance work. On July 20, 1981 I permitted the Town to continue use of the Town's radio base site on Prospect Mountain in exchange for grading the road, cleaning or "pulling" drainage ditches and removing sand, rock and debris from culvert heads; however, for the past five years, following the Town's annual maintenance work, I have inspected the work and found that no work was done on cleaning the drainage ditches and removing debris from the culvert heads. Also, about two years ago the Town built a large concrete water tank on the uphill side of the road. On at least two occasions, the Town drained this tank and wasted thousands of gallons of water which ran down the road and caused a large amount of erosion to the road surface, drainage ditch and also filled two of the culverts with sand and gravel. I discussed these problems with Mr. Richard Widmer on August 8, 1986; however, I have not yet been advised as to what work, if any, will be carried out by the Town. I realize that the Town of Estes Park has a number of different Departments; however, in view of past inaction, I would prefer to carry out negotiations with a single representative of the Town rather than two or more Departments. It is my obinion that the Town is in a position to carry out reasonable mainten- ance work in exchange for use of the road and radio base stations. I would be· pleased to enter an agreement with the Town covering this subject. This will confirm our agreement that no maintenance work should be carried out by the Town until after Gavell Excavating has completed their contract of installing the sewer line down the mountain. Although a firm contract covering this maintenance work was never executed, it has been my understanding that the work covered in the March 14, 1979, letter from Mr. Robert Dekker to Joseph P. Jenkins was agreeable to both parties. A copy of this letter is enclosed. In the past the Town's maintenance crew has confined their work to the road between my gate and the radio base station. Since the new Town reservoir has been installed, there has been occasional drainage of the reservoir which has resulted in some erosion along that road. Also two of the culverts have filled up with sand and gravel. I would appreciate your consideration of extending the maintenance work to include this section of the road.
