Widmer (Lm¢/ Director of Public Works DATE: July 3, 1986 RE: 1986 Street Improvement Program Bids Attached is a bid tabulation for the 1986 Street Improvement Program. Low bid received from Coulson Excavating of Loveland of $127,641 was 18% below the estimate originally approved by the committee and 8% below the engineer's estimate. The overlay prices this year are about 11% below last year's. I recommend the contract be awarded to Coulson Excavating. Due to proposed water line construction next year, I suggest that Stanley Avenue not be overlaid this year but deferred to next year. Deferral of this item coupled with the bid prices, will result in a savings of about $36,000 over the amount budgeted. Following the Town Board's adoption of their Resolution on June 10, 1986, Dean Lehman, on behalf of the newspapers, has for- warded a letter to each representative enclosing a copy of this Memorandum. A map depicting the locations selected by the Town staff, under the original proposed ordinance, will be attached to the Memorandum. We had hoped to have something to present to the Town Board for their meeting on June 24, 1986. This Memorandum can be pre- sented at that time if your desire. When we receive a consent and understanding from each of the papers, we will present the final Memorandum in its final form to you and the town board. Thank you for your cooperation to date. MEMORAN DUM OF UN DERSTAN DING BY NEWSPAPERS WHEREAS, the Town of Estes Park, Colorado, and the Estes Park Urban Renewal Authority have recently completed improvements in the downtown district, and WHEREAS, town staff members have expressed concern about the location and maintenance of some news racks on public property within the downtown district, and WHEREAS, newspaper representatives have pointed out that news racks do provide an important public service and that they have received constitutional protection from courts in the United States, and WHEREAS, there is a desire on the part of the Towh of Estes Park and the newspapers to work cooperatively rather than at odds on this situation, and WHEREAS, on Tuesday, June 10, 1986, the Town Board of Estes Park, Colorado, adopted the attached Exhibit A as a foundation for this agreement, and WHEREAS, representatives of the various newspapers including, but not limited to, Loveland Daily Reporter-Herald, Longmont Daily Times Call, Fort Collins Coloradoan, USA Today, Boulder Daily Camera, Denver Post, Rocky Mountain News, etc., -1-
2 -, 7. V wish to enter into this Memorandum of Understanding in order to voluntarily regulate the placement of news racks in the core downtown area, IT IS AGREED AS FOLLOWS: 1. The above-referenced newspapers hereby voluntarily agree to use their best efforts to mutually cooperate and to place their news racks only in the six spots listed below in the downtown area of Estes Park. 2. This memorandum does not limit or affect the placement of news racks on private property within the Town of Estes Park. 3. It is understood that this voluntary agreement has no effect on areas outside the downtown district and the town has expressed no desire to implement an ordinance or seek voluntary agreement from the newspapers outside the downtown district. 4. The newspapers wish to cooperate with the town and voluntarily control the placement of news racks and, therefore, agree to comply with this memorandum beginning July 1, 1986. 5. In the event other newspapers, at a future time, desire to put news racks in the public right-of-way within the downtown district at locations other than those designated herein, the undersigned newspapers will use their best efforts to seek voluntary compliance with this Memorandum of Understanding through personal contact and negotiation. -2-
: I 6. It is agreed that all signators to this Memorandum will strive to place only top quality news racks Mithin the downtowft district and to keep the same in a good and clean and orderly condition and to refrain from attaching them in any way to any public object or improvement. -3-
