Bernerd Dannels, Mayor Town of Estes Park Estes Park, CO. 80517 Dear Mayor Dannels: This letter is written in regard to your letter dated December 5, 1985 (copy attached) concerning the Town's willingness to consider the granting of an easement on the west side of the Hupp Hotel. Your letter was, of course, given as a necessity in our closing the sale of the Hupp Hotel, and the closing did take place on December 17, 1985. Since that time, we have plans to complete a considerable amount of improvements in the retail stores, hotel rooms, heating, plumbing, etc. At this time, we do wish to make formal request that an easement be granted as indicated on the attached plan. This plan also shows the architect's plan for the installation of a sidewalk along the west side of the Hupp Hotel, and we know that this will be a decided improvement in that short block. During that period, the Town has not requested removal of said encroachment. The Town has been approached by representatives of the owners of the property with a proposal regarding the encroachment. It is possible the Town would be willing to consider an easement for the encroachment subject to appropriate terms and conditions. As I'm sure you are aware, this encroachment has existed for some time. I believe' the following facts should be considered carefully as you weigh this request: 1. The drawing attached shows the existing measurements between the Hupp Hotel and the old Estes Park Bank building and between the existing curbs. Presently, there is 27' between the curb lines on Big Horn. If this dimension is maintained, the Hupp Hotel sidewalk would be 4' wide at the north end of the T-.Shirt Shop. The existing width between curbs should be maintained, if possible. Turning movements of vehicles making right turns onto Big Horn Drive and general traffic flow could be vastly improved if the Hupp Hotel did not encroach and/or had an eight foot setback along Big Horn. 2. The Town may require the property owner to construct curb, gutter and sidewalks at any time it is necessary for public safety (12.20.050 of the Municipal Code). 3. If the construction of sidewalk at the Hupp Hotel is desired, it would probably be required to extend the full depth of the Hupp property to the platted alley. This would be approximately 60 feet north of the end of the sidewalk shown on the proposed drawing. P. O. Box 1200 Telephone (303) 586-5331 Public Works Committee April 3, 1986 Page 2 4. Once the sidewalk is extended past the narrowest part of the T-shirt shop, there is no reason to maintain the same alignment; it might be desirable to move the curb line to the east to provide room for parking or loading zones. 5. The owners have also applied to the Board of Adjustment for a variance to allow a structural alteration to a nonconforming building. It is my understanding that this va'riance will be necessary even if the requested easement is granted. In other words, granting of the easement does not remove the nonconformity because the rest of the building will still not have an 8 foot setback. The Town, through its staff and Public Works Committee, has reviewed the situation and this letter is written for the purpose of advising you of the Town's position. The deeded property line of the east boundary of the golf course property is the centerline of Fish Creek. The fence that is located to the north and west of the centerline of the creek is on the golf course property. There are no recorded documents or anv other documents in the Town's possession that grant you or any previous owner of your property any easement west of the creek. The Town is requesting that you remove the fence from the Town's property on or before March 1, 1986. In the event the fence has not been removed at that time, the Town will remove same. P. O. Carl B. Sanborn was president and owner of Estes Park Development Co. both at the time the - company sold the land to the Estes Park Golf and Country Club in 1917 and when the company sold to Paul Van Horn in 1961. The fence was evi- dently erected by or at the direction of Carl Sanborn some time before 1961. Judging from the depth that the trees have grown over the wire and the apparent age of some of the lichen covered posts, the fence is con- siderably older than 25 years or 1961. The Estes Park Golf & Country Club was a private corporation that began as a not-for-profit corporation in 1917 and changed to a profit corporation a few months later. We cannot find that it ever changed back to a non-profit corporation. That fact would not seem to be material to the boundary but might be important to a significant unpaid tax liability that the Town may have assumed along with the. land from the Estes Park Golf and Country Club. The Golf and Country Club corporation did not have the immunity against adverse possession that the law affords municipal and quasi-municipal corpora- tions. The fact that the Town was a majority stock holder of the corporation and the Recreation District a lessee of the land, did not transfer their immunity to the owner of the land. I cannot help but believe that the people perpetrating this dispute are~ ~f ,' ; ·, the same ones who tried to make an issue of my placement of fill on the prop-.. ' erty last year and that the real problem is my involvement with Stanley Village. Anyone familiar with the golf course has been aware of the fence. It is a strange coincidence that now is the time that the issue is being brought up. ..: . It is discouraging from a private point-of view to see how"the Towil quickly issues 30-day ultimatums to a private land owner regarding these. issues (the* - case of the alleged flood plain violation at the same time the Recreation District was pushing trash into the river) and then is so slow to follow through when it is proven that they erroneously took land by a faulty flood plain designation (re: my letter of July, 1985). :0 ... I am tired of litigation that I have to pay'for as an individual ahd also pay for as a taxpayer. In an effort to avoid such litigation, we offer to trade the Van Horn land along Fish Creek adjacent to the Community Church for clear title to the land within the Van Horn fence at the Van Horn Engineering office property. -I t·~ ., 1 - 7(14. 9.841-.t " t"·*r·:t Tor·nt ..1 -f·:· ..,.-- Some of the advantages to the Town of the trade besides avoiding litigation /. would be to have title to both sides of Fish Creek for nearly 600' allowing ·-. it to be improved for a trail or pond as indicated to us by Dick Castleberry and Jim Beauchamp last summer. The Town would also gain 5801 of frontage along Fish Creek Road at a location that would provide easy access to the Country Club land should it ever be desirable. 9.....· ·. · «·., ·..,. c If the trade is not acceptable to the Town, we will file suit to quiet the - title of both properties to the historic fence lines. The detailed bid tabulatiohs are attached. The Town received eight bids with five of them below .the engineer ' s estimate of $320,460. Low bidder was Weinland Construction of Loveland with a bid of $256,208.15, 20% below the engineer's estimate. I recommend the town accept the bid of Weinland and authorize the Mayor to sign the contract. Widmer 2«) Director of Public Works DATE: April 2, 1986 RE: Employee Incentive Award The Public Works Department budgeted $8,250 in this year's budget for a 1/2 ton pickup truck for use by the Parks Department for crew transportatioh and maintenance work. Early this year Gary Shanafelt proposed that instead of buying a new vehicle for this purpose, we convert the 1- ton flatbed formerly used by Stanley Park (G-22) 9 install a hydraulic lift, and recondition the truck. The idea was that we would end up with a more versatile vehicle at a significant cost savings to the town. The Public Works Committee approved this suggestion in January. The conversion has now been completed at a total cost of $4,021. This represents a ve'ry real savings to the town of $4,229 from the amount budgeted. I believe' this suggestion and its support by the Park Superintendent, constitute outstanding service to the Town and I therefore nominate both Gary Shanafelt and Dan Speedlin for incentive awards, in accordance with the town's personnel policies. I suggest that an appropriate amount that might be considered would be $250 for Mr. Shanafelt and $50 for Mr. Speedlin. RDW:ca P. O. (Board of Trustees - October 9,1984.) The evaluation will be completed by supervisors for each employee below the level of Department Head, following prescribed format. Completed evaluations Will be discussed by the supervisor with each employee to point out strengths and weaknesses in employee performance and to recommend ways of improvement. Merit pay increases will be based on performance evaluation in a manner to be determined by and with the approval of the Board of Trustees. c Department Supervisors are permitted to give new employees a CZE 5 1. ene-step merit increase following their six-month evaluation should this evaluation indicate superior performance. The annual cost of this six-month merit increase shall be in addition to the annual merit cost limits set by the Board of Trustees each year. (Board of Trustees - September 16, 1985). In addition to merit pay increases based upon performance, ~ Town of Estes Park Standing Committee, as designated in the Municipal Code, Section 2.08, may, upon recommendation of the Department Supervisor, award special employee incentives in 4- r~ recognition of outstanding service to the Town of Estes Park. This award may be monetary or otherwise. Final approval for Incentive Awards will be given by the Board of Trustees.
