Estes Park, CO 80517 Dear Rich: This letter is written pursuant to your letter of October 24, 1985 concerning vacation of a portion of Pine Road. Section 43-2-302 C.R.S. provides that whenever any roadway which consti- tutes the exterior boundary of a subdivision is vacated, title to said roadway shall vest in the owners of the land abutting the vacated roadway to the same extent that the land included within the roadway was a part of the subdivided land. In the event that Pine Road was a part of Lot 1 at the time of tke subdividing of James-Mcintyre Subdivision, the entire portion of Pine Road would become a part of Lot 1 of the Subdivision. Since I have no other reference than the James-Mcintyre Subdivision Plat, I assume that this is the case. However, Section 43-2-302, Subsection 2, provides that no roadway or part thereof shall be vacated as to leave any land adjoining said roadway without an established public road con- necting said land with another established public road. From looking at the plat, it appears that Lot 6 would not have any access to a public road. Although I realize from Mr. and Mrs. Nichol's letter that they also own Lot 6, the statutory provision would prohibit the Town from vacating Pine Road. The only solu- tion would be to either provide other access to Lot 6 or combine Lot 6 and Lot 1 into one lot. It is my opinion that this Section is mandatory and the mere granting of an easement would not be effective, as the Statute provides for an "established public road connecting said land with another established public road". Widmer TOWN OF ESTES PARK Post Office Box 1200 Estes Park, CO 80517 Re: Golf Course Boundary Matter Dear Rich: On September 26, 1985, you wrote me concerning a letter from the EVRPD regarding the golf course boundary. I have reviewed the letter and the accompanying material and have the following comments: 1. The doctrine of avulsion, which is applicable to this case, provides that where the boundary of a piece of property is the centerline of a creek and the course of the creek is changed by a sudden event, the boundary line remains the former course of the creek. If the County has changed the course of Fish Creek, the Eastern boundary of the golf course has not been changed by that event. A determination should be made as to where the former course of Fish Creek was as compared to the present course of the creek. 2. Since the deeded boundary of the golf course is the centerline of Fish Creek, the purported claim of Mr. VanHorn to the property lying West of Fish Creek is adverse to that of the deed. His claim would have to be based upon adverse possession of that portion of the property. Section 38-41-101(2), C.R.S. 1973 provides that there can be no adverse possession of property owned by a municipal or quasi-municipal corporation. VanHorn's claim would have to be based upon adversely possessing the property for 18 years prior to the deeding of the property from the Estes Park Golf and Country Club to the Town when the Country Club was dissolved. Also, there are other problems associated

It would be my recommendation that an attempt be made to deter- mine who.placed the fence and when the fence was placed. Both of these facts would be important in determining whether or not there is any validity to VanHorn's claim of ownership of the questioned property. 3. It is also my recommendation that Mr. VanHorn be noti- fied in writing to move the fence or allow the fence to be moved to the Eastern side of Fish Creek. This would toll the running of any claim by Mr. VanHorn with regard to adverse possession of the property on the West side of the creek.
