This sale's name came from merchants - at the end of the season would go into the backroom and would be surprised at what was left. They would then have an end of the season sale on the sidewalks and were surprised when people would buy what was left, hence the name "Surprise Sale." We have also included formulas created to come up with the numbers for several events. These formulas will provide us with a more consistent attendance count from year to year. BUDGET/COST: N/A ACTION: N/A 1 0 & Event Numbers 2007 • March 3-4 - Estes Park Cup Dog Weight Pull @ Bond Park - *500 attendees • May 19- Safety Fair - 400 total - per PD 300 participants and 100 vendors May 19-20 - Jazz Fest - 1395 total attendance * Saturday- peak 700 and low 450 (575) average * Sunday - peak 450 and low 250 (350) average • We feel with this event that about 40% of the people are there all day. 20% are there ]4 the day. The other 20% turn over about 3 times throughout the day. So the actual numbers for the weekend are: • Saturday- (using the average) 0 40% all day is 230. 0 20% 14 day x 2 is 230. 0 20% changing 3 times is 345. o Total day attendance is 805 people. • Sunday - (using the average) 0 40% all day is 140. 0 20% 14 dayx 2 is 140 0 20% changing 3 times is 310. o Total day attendance is 590. In the late 1970's Dave Davis retired from his Denver ad agency, Broy:es, Ailebaugh, Davis, which held the State of Colorado advertising account promoting Colorful Colorado. Dave retired to Estes Park with his wife Ann. At much the same time the Chamber of Commerce formed its advertising committee to promote Estes Park. Dave volunteered for this committee at that same time. He had established the small ad agency which he named Second Wind, Ltd. (named for obvious reasons). Several years later, Dave died. The Advertising Committee, which was funded by the Town, purchased Second Wind, Ltd. from Ann Davis. The agency had been accredited in the media industry by Dave, and could deduct the standard 15% agency discount on media purchases. The advertising committee over the years has continued to utilize Second Wind to accept third party funds (advertising dollars from the old Accommodations Association, or funds from E.P.I.C. for example) and purchase ad placements at a lower cost than an individual could place the same ad. This was due to the agency discount as well as the volume contracts that the town ad program held. Today, the agency continues to play the same role in running the visitors guide program. All ad sales are deposited to the Second Wind checking account, all sales costs and production expenses are paid from the Second Wind checking account. Signatories on the checking account (two required on any check) are Randy Repola, Steve McFarland, Tom Pickering, and Peter Marsh. Suzy Blackhurst manages the account. Second Wind is a registered Colorado Corporation, and files an "annual report" with the state every two years as required, and Steven Jackson, CPA, files our annual Income Tax returns each year. Current agent for the Corporation is Peter Marsh. Directors of the Corporation are Randy Repola, Steve McFarland, Tom Pickering, and Peter Marsh. One result of her work from 2006 came to us in October when the travel editor of Eltern provided to the state's international representative a copy of the November issue which includes a five-page article about a family hiking vacation in the Rocky Mountain National Park and in Utah's red rock country. The coverage has an ad equivalence of €145,090 or $206,006. The magazine has a monthly circulation of 434,367 parents. September Visitors Center Traffic The center experienced slightly over a 17.5% increase in Visitors Center traffic over September, 2006. We had 47,876 visitors this September, an average of 1,596 people per day. Last year, we saw an average of 1,357 people each day, for a total of 40,731. 2. September Telephone Calls Visitor Services staff fielded a total of 3,088 calls this September, as opposed to 2,797 calls in September, 2006. This is an increase of slightly more than 10% over last year. 3. October Visitors Center Traffic The center experienced a little over a 13.5% increase in Visitors Center traffic over October, 2006. We had 20,511 visitors this October, an average of 662 people per day. Last year, we saw an average of 592 people each day, for a total of 18,061. 4. October Telephone Calls Visitor Services staff fielded a total of 1,797 calls this October, as opposed to 1,191 calls in October, 2006. This is approximately a 45% increase over calls received last October. NOTE: Estimates for visitor traffic and telephone calls were used Odober 26 - 31, in order to complete this report by the deadline. 5. Busy Season Visitor Totals Now that the busy season is ending, it is interesting to note the increases in visitor counts for the months of June - September over the past three years. During this time frame, we saw an increase in visitors of nearly 17% this year over 2006. (For this year through October, the increase over last year is already at over 20%!) The increase in visitors in 2006 over 2005 for the months of June - September is quite remarkable: a whopping 55%! It is important to note, when looking at this percentage increase, that in the old Information Center, people entering the public restrooms where not counted, whereas, here in the new building, they are included in our counts. This fact has an effect on the increase, but unfortunately we have no way of knowing the actual numbers. Wth that being said, this is a huge increase and the beautiful presence of our new building and other factors (besides the inclusion of the restroom counts) contributed to the large percentage increase in visitors between 2005 and 2006 for the time-frame of June - September. 6. Bond Park Cabin The Bond Park Cabin closed for the season on October 1, after Elkfest weekend. The cabin was open in September on Saturdays and Sundays only, for five hours each day, from Noon - 5P on Saturday, 11A - 4P on Sunday. As mentioned last time, we saw a decrease in visitation at the cabin over last year. (Please recall that the cabin hours in 2006 were Noon - 6P; therefore, we are unable to compare apples to apples exactly and must factor that into our analysis of the counts.) In September there were 931 people who visited the 1 cabin, an average of 93 per day (based on 10 open days), as opposed to 1,161 people in September, 2006, 4. '' an averageof 97 people per day (based on 12 open days). 7. Estes Park 2007 Visitor Guide: Distribution from the Visitors Center We have distributed over 37,000 Visitor Guides through the Visitors Center to date. This distribution includes both walk- in visitors and Estes Park businesses. 8. Visitor Center Hours The Visitors Center resumed off season hours, effective Sunday, October 7; therefore, our daily hours of operation are now from 9A - 5P, Monday through Saturday, and 10A - 4P on Sundays. During this time of year, our Ambassador volunteers work at the visitor information counter on weekends only. Center Services Memo To: Community Development Committee - Trustees Pinkham, Levine and Eisenlauer From: Lori Mitchell, Senior Center Director Date: November 8,2007 Re: Estes Park Senior Center - General Report SPECIAL TRANSIT ADVISORY COMMITTEE The Estes Park Special Transit Rider Advisory Committee meets every quarter at the Senior Center. This is a group organized by Steve Blacksher, Director of Customer Relations of Special Transit. Participants this month included riders, staff from Crossroads, Salud and the Senior Center, two Senior Center board members and Special Transit staff. As of the end of July 2007, there have been 3175 one-way trips in Estes Park. This is up 8% from last year at the same time. Transit staff is predicting a total of 5440 rides by year-end. Special Transit is handling about 450 rides a month in Estes Park. Steve Blacksher noted that "no where else do we do this level of service" in terms of volume. Last year Special Transit saw a 24% increase in rides in Estes Park. Special Transit has offered service in Estes Park since 1999. Other use statistics were reported. On average, 94% of Estes Park riders are able to obtain the ride they need. Conversely, only 5.8% of riders are denied a ride due to booked van schedules. This averages about 26 ride denials a month. Historically, Special Transit had been offering a ride to either Longmont or Loveland on the third Thursday of each month. Lately, there have been no requests for this service. Also discussed was the newer Special Transit bus service to Loveland every Wednesday. This is a grant-funded program by Crossroads and Larimer County. It was reported there have been only 3-4 riders per week using the service. Carolyn Evans from Crossroads is heading an effort to promote the service more, hoping to obtain 8 to 10 riders weekly. Crossroads worked with Larimer County to extend the Wednesday service through the end of March 2008, at which time it may be discontinued if rider numbers do not reach a minimum of 9 people per week. Staff offers the following recommendation based on past practice. A clarification aimed at eliminating discrimination as requested by the CD committee last month is now provided: The population being served is the general public and is not subject to any pre-qualification other than a need-based qualification. Recommendation: The following entities may be exempted by the Community Development Committee from Building Permit fees and Planning Review fees (except for direct expenses incurred in outsourcing): 1. public funded government construction (federal, state, county, local); including 2. tax districts / special districts ( e.g. hospital, library, parks and rec.); or 3. private non-profit organizations providing low income health and human services or low income housing Although the fees are not assessed, submittals, permits and inspections are required. The Community Development Committee will use the following criteria in qualifying private non-profit projects: • The permitted project or building will serve or support a currently underserved and needy segment of the community. • A critical service is being provided. • Low income housing is deed-restricted. • The population being served is the general public and is not subject to any pre-qualification other than a needs based qualification. Background information is as follows: 1. Currently, the Clerk's Office mails approximately 1400 Invoices the last week of December. The "due date" is June 30th. On these Invoices, the Clerk's Office states that the fee must be paid in full no later than June 300. 2. The Clerk's Office accepts payments (either M or full payment) through June 300. 3. In May, the Clerk's Office mails approximately 700 "Final Invoice" statements to those businesses that have a "balance due". 4. Typically, the second week of July, the Clerk's Office mails a "Summons and Complaint (certified mail) (approximately 60) that includes an additional $15 processing fee. The court date is specified, and the office accepts payments until the Wednesday prior to the date of their court appearance. For businesses that don't pickup their certified letter, the office authorizes personal service by a Police Officer. 5. The entire process takes from nine to ten months including those that go to court. 6. The Clerk's Office does not have a formal process for Business Licenses paid by a NSF check. The office contacts the business owner by phone and/or mail. If it is not rectified the account is made inactive. This process is time consuming and ineffective. 1 .. The following revisions are being proposed: 1. Clarify the invoice by adding "Annual Business License Due by 3/31/08." 2. Eliminate the Myay option and require full payment by March 31 St 3. Eliminate the 2'1 invoicing. 4. Establish an NSF check fee of $20 to recover staff time and possibly establish a relationship with a company to collect payment for the checks. 5. Revise the Ordinance: Chapter 5.20.060 Payment of licen§ee fee. I have taken the opportunity to also amend the business license ordinance provisions to include the requirement that an owner of a business within the Town needs to pay the business license fee but also obtain the business license and to comply with the State of Colorado requirements with regard to Lawful Presence. Also, in reviewing the business license ordinance, the violation and revocation section were not clear with regard to failure to obtain a business license or complete the necessary documentation. BUDGET IMPLICATIONS: There are not budget implications. STAFF RECOMMENDATION: I recommend that the proposed revisions to the Business license Chapter be approved.. 1 I % ORDINANCE NO. -07 AN ORDINANCE AMENDING CHAPTER 5.20 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO TO REVISE BUSINESS LICENSING PROCEDURES & REGULATIONS WHEREAS, it is necessary for Chapter 5.20 of the Municipal Code to be amended with regard to licensing procedures and regulations; and WHEREAS, the Board of Trustees of the Town of Estes Park, Colorado, has determined it is in the best interest of the Town to amend the Municipal Code of the Town of Estes Park, Colorado by the adoption of this Ordinance. The police officer taking the prints is to complete the fingerprint certification form and both the card and form are to be returned to the Clerk's Office for processing. ~ Lawful Presence Affidavit for each individual if sole proprietor or partnership. Procedure: Follow the Checklist for New Liquor License. 2. Liquor License Renewals. The Colorado Department of Revenue issues renewal forms to each licensee approximately two months prior to the license's expiration date. The Licensee is required to complete and submit the forms to the local licensing authority along with two checks: one issued to the Colorado Department of Revenue and one to the Town of Estes Park. The fees vary depending upon the type of license being issued and are listed on Page 6 of this Manual. The Town Clerk's Office will request a background investigation of the licensee from the Police Department, perform a Colorado Bureau of Investigation (CBI) check for each individual on the license, complete the renewal form and submit to the State. Upon receipt of the State liquor license, the Town Clerk will issue the local license and the occupation license and mail all three licenses to the licensee. The State will allow 90 days past the date of expiration for a licensee to submit all renewal paperwork and fees. However, an additional $500 (local fee) will be assessed for this privilege. If the licensee does not renew in that time period, the license will be revoked, and the licensee must apply for a new license. 9 Note: The expiration date deadline refers to all paperwork and fees submitted to the local licensing authority. The State does not require the paperwork to be in their possession by the expiration date. 3. License Changes. The applicant is given the following forms: A. Report of Changes (for changes to name, location and manager, modification of premises, wholesale/retail permits, and optional premises additions). * DR 8442 (Permit Applications and/or Report of Changes * DR 8404-1 (Individual History Record for each individual) * Fingerprint card (for each individual) ~ Lawful Presence Affidavit for each individual if sole proprietor or partnership. Special Events ~ DR 8439 (Application for a Special Events Permit) Procedure: Post the premises for 10 days prior to mailing application to State. Upon receipt of Permit from State, mail cover letter, Permit, and Warning placard to applicant. B. Bed and Breakfast ~ DR 8442 (Permit Applications and/or Report of Changes) 10 Procedure: The premise is not posted, there is no public hearing, and fingerprint cards are not required. The application may be mailed immediately upon receipt. Following issuance of the State Permit, the Town will mail both the local license and State Permit to the licensee. C. Temporary Issued by the Town Clerk during Transfer of Ownership particularly when a current license may expire prior to approval of the transfer. The applicant must submit the Transfer of Ownership Application, Individual History Sheets, and appropriate fees prior to issuance of the Temporary Permit. The term of the Permit is 120 days. 5. Annexations. In the event a liquor-licensed premise is annexed into the Town, the liquor fees levied in Chapter 2, Page 5, of this Manual shall be prorated from the date of annexation to the date of issuance of the license. 6. Refunds. A. Renewal. In the event a license is not granted or renewed by the Town or the State, the occupation tax paid upon the filing of the application or renewal application shall be refunded. B. Suspension/Revocation. A suspension or revocation of a license during any calendar year shall not entitle the operator to any refund of the liquor occupation tax. 7. Stipulation Guidelines. The Town Board initially approved these guidelines on January 13, 1998 and they regulate procedure following a Liquor Code violation and Stipulation Guidelines. 11 06/07 TOWN OF ESTES PARK REQUIREMENT LIST FOR ALL NEW OR TRANSFER OF OWNERSHIP LIQUOR LICENSE APPUCATIONS 1. The "local licensing authority" as referenced in the State Liquor Licensing Documents is the Town of Estes Park. 2. The Applicant must be at least 21 years of age. 3. The fees are as follows: Community Special Event Vendors: 1-3 days $ 20.00 4 - 7 days $ 25.00 8 - 30 days' $ 50.00 +30 days $200.00 These fees are based on a· calendar year (January-December) and are prorated beginning July 1St and October 1st for applicants starting their business during the 3rd and 4~ quarters of the current year. Instructions on the statement require licensees to inform the Town Clerk's office of any changes in the status of their businesses. A summons to court, which includes a $20.00 fee, is sent by certified mail to all delinquent accounts when the fee is not paid in full by March 31St. The licensee may pay all outstanding fees in lieu of a court appearance. For accounting purposes, businesses that become inactive during the year are not removed from the listing, but placed on inactive status and are not invoiced.
