LETTER OF UNDERSTANDING The following shall serve as the understanding between the Town of Estes Pal:K hereafter referred to as the "Town", and Leslie Botha, hereinafter referred to as "Coordinator", regarding coordination of the 2006 Chfistmas Parade, hereinafter referred to as "the Parade" or "the Event". 1. The Town will pay $11,000 to the Coordinator in return for services as Christmas Parade Coordinator for 2006. Said sum shall be paid on November 24,2006. 2. It is understood that the services to be rendered by Coordinator include coordinating the efforts of the vaiious entities and individual~ administering the contracting for services, equipment and personnel and submitting invoices on a monthly b,sis; planning the general character and presentation of the Parade; directing the general character and presentation of the Parade; directing its inforination; and causing it to be presented at the appointed time. The appointed time is agreed to be 5:30 pm. on the evening of Friday, November 24,2006. Coordinator shall not be responsible for acts of God and conditions beyond the control of Coordinator, which may delay, postpone or cause cancellation of the Parade 3. The Town agrees that Coordinator shall have option to coordinate Chfistmas Parades, or such similar activities and celebration as may replace the Chtistmas Parade, in 2007 and 2008 subject to the Town and Coordinator agreeing on the terms and conditions of the coordination of those events. Coordinator will be subject to an evaluation of quality and creativity after the 2006 Parade. 4. It is understood that the proposed budget to be submitted by Coordinator on or about March 31, 2006 will be tentative in nature, and that amounts associated with specific line items may be substantially adjusted. However, Coordinator will not contract for rentals mal]efials or services in amounts tomling more thin $25,000 without the express written authorization of the Town. The $25,000 is in addition to and separate from the above- referenced $11,000 for services. The $25,000 shall be disbursed as set forth using the guidelines on Schedule "A". 5. It is understood and agreed that the $25,000 budget is essentially for items associated with the staging of the Parade. This includes such items as lights, generators, sound systems, stages, decorating, sanitary equipment, decorations for street and stages purchase of costumes and props, creating and constructing sponsored floats and/or characters, obtain materials, and for labor involved in the construction of the floats and/or characters. , I 6. The Special Events Department will attempt to obtain "sponsorship" of floats, characters and combination thereof, by soliciting funds from merchants, lodging establishments, and other business people and organizations. All funds shall be retained by the Town. 7. It is undersmod and agreed that the Town shall own the salvageable portions of the floats and characters, whether in whole or in part, as well as the creative design of the floats and characters, and sponsorship rights to any floats or characters shall be limited to this yeafs parade. 8. It is understood and agreed by the parties hereto that Coordinator is an independent contractor. This Ittter of Understanding shall not be construed as establishing the relationship of employer/employee, joint venture, partnership, or any other like legal entity, with regard to the relationship between the Town and Coordinator. 9. It is understood and agreed that the Town shall be responsible for obtaining liability insinfance for the parade. Said insurance shgll be through the Town'g cutrent insurance arrangements with CIRSA. As an independent contractor, Coordinator shall be responsible for providing vplunteers woikers' compensation insurance coverage forall volunteers of Coordinator involved in Coordinator's duties and responsibilities pursuant to the terms of this Letter of Understanding. Coordinator shall provide the Town with a Certificate of Insurance for said coverage by October 1,2006. 10. It is understood and agreed that the Town shall also be responsible for the following: a. all adverlising and promotion as previously planned in the 2006 Town approved budget b. postage and copying costs of Coordinator relating to coordinating the event c personnel to drive floats and other vehicles associated with the Parade or its presentation; and construction and transportation of stages, stands, and/or related structures; d. supervisory personnel and facilities for parking; e. a convenient storage area for equipment, costumes, characters and other matefial< related to the event; 11. Coordinator, as part of her contracted services, shall provide the following. a. a minimum of twenty floats with a minimum of four new float designs and an update on all other floats. b. a minimum of ten animal/character costumes and heads with one new costume. and head and restoration of the rest of the animal/character costumes and heads. c. North Pole decorations. The Director of Sperigl Events for the Town will monitor the design, construction, and restoration of the above projects to insure that the quality of such projects is consistent with the amount of funds budgeted for the projects. Calls to the Visitors Center are double last January. 2. Guide Downloads Up 281% (15,348) over last year increasing our reach considerably! 3. Magazine advertising generated leads are up by 7.82% (162) over last year. 4. Internet advertising (Google Ad-Words campaign) generated 8,525 pay-per-clicks (not available last January-February). This program was expanded by many times during March, and the results should be available for next month's report. 5. Program Planning Ad Committee continues development of the new television commercial to be produced prior to the fourth quarter. 6. Second Quarter Insert is in production this week and next week. The insert will be carried by the Sunday papers in Boulder, Longmont, Loveland, Greeley, Fort Collins and Cheyenne. 7. WATS line calls have finally stabilized. After experiencing 25% annual declines since 1996, the first two months of 2006 are at a decline of only 7.8%. ACTION ITEM: None BACKGROUND: N/A BUDGET/COST: N/A RECOMMENDATION: N/A .. PR Equivalency (the value of Colorado newspaper articles in relation to the same size paid advertisements) Total PR Equivalency* through February 28,2006: $ 31,405.72 - The amount is an increase over the same reporting period in 2005. A year ago the equivalency rate for Estes Park stories placed by the CVB was $22,433.14 Totals for March will not be available until after April 20. *A calculation equating free publicity in publications that are members of the Colorado Press Association for events covered in news columns, had the CVB paid for the same amount of space. 2. Colorado Newspaper Press Placements through February 28,2006: 128 Number of story places is an increase of 20 over the same period in 2005. 3. Web site Press Room Downloads through March 31, 2006: 1,919 2005 Press Room Downloads through the same period: 358 4. Special Requests fulfilled through March 14, 2006: 14 5. Other Press Coverage Received All copy and 6 of the 13 photos used in the eight-page special CVB section in the March 31 edition of the Trail Gazette were the work of the Communications Coordinator. 6. Anticipated Coverage in the coming months Boulder Magazine, Mountain Living Magazine, Colorado Meeting Events Magazine, Colorado Wilderness Society. Rooftop Rodeo and RV parks in the Estes Park area have been spotlighted in Colorado Tourism Organization public relations efforts. ACTION ITEM: None TOWN OF ESTES PARK Office Memorandum To: Community Development Committee -Trustees Doylen, Levine, Pinkham From: Teri Weldin, Visitors Center Coordinator I)ate: March 31, 2006 Re: March Visitors Center Report REPOR'l': 1. February Traffic at the Visitors Center The total number of visitors who came through the center in February was 2,063, an average of 74 people each day. 2. February Telephone Counts The total number of telephone calls received in February was 1,275, an average of 47 telephone calls per day. This average number of calls per day is exactly what we received in February last year. 3. March Traffic at the Visitors Center The total number of visitors who came through the center in March was 4,652, an average of 150 people each day. (We are not yet able to make comparisons to our numbers last year, for our people counters were not installed until late April, 2005). Please Note: In order to complete the January report, visitor and telephone call estimates were necessary during the last two days of the month. For the record, actual visitor counts for January totaled 2,284, an average of 76 people per day and actual telephone counts totaled 1,121, an average of 37 telephone calls per day. 4. March Telephone Counts The total number of telephone calls received in March was 1,495, an average of 50 telephone calls per day. This number shows a slight decrease from the average number of calls per day at 54, received last March. 5. 2006 CVB Services As we close our first quarter, $132,400 has been sold in CVB services, which includes: website listings, brochure rack space, "Book-now" links, referrals and leads. At the close of last year, our total sold was $88,500; therefore, we have already surpassed 2005 CVB services sales by 50%. Twenty-eight out-of-town properties have opted to become CVB members to date. Last year, seventeen properties decided to join. The member fees associated with the 2006 memberships currently totals $34,630. 6. Seasonal Staff Advertisements have been placed to recruit several seasonal staff to assist at the Visitor Center mid-May through early October. We expect to have our seasonal staff selected by the end of April and trained in early May. . 7. Lodging and Retail Tours The Ambassador Organization and CVB staff will organize and participate in Lodging Tours, planned to take place May 10, 11,16, and 17. A firm date has not yet been selected for the Retail Tours, but we expect the tour to take place in early June. ACTION ITEM: None BACKGROUND: N/A BUDGET/COST: N/A RECOMMENDATION: N/A K p I , TOWN OF ESTES PARK Office Memorandum To: Community Development Committee - Trustees Doylen, Levine and Pinkham From: Betty Kilsdonk and Russ Franklin I)ate: April 6,2006 Re: O'Connor Picnic Shelter - Request Approval to Purchase Picnic Tables BACKGROUND: Last month we introduced a proposal to purchase fourteen 8' long, metal picnic tables for use at the Fall River Picnic Area by the Town and outside renters. The Parks Department recommended metal-armor coated picnic tables from Recreation Plus of Golden. These tables are more expensive than the polyvinyl rolled expanded metal top tables available from other vendors. The Committee directed us to return this month with more research on whether other sources were available for the metal-armor coated tables, and a justification for the more expensive table purchase. We learned that Recreation Plus of Golden is the sole sales agent in Colorado and Wyoming for the metal- armor coated tables, which are manufactured by Wausau Tile using a patented process.. The coating has been independently tested in comparison to standard PVC and powder coatings for appearance, color retention and durability, and shown to be superior. It is crack and chip resistant, graffiti resistant, and environmentally safe. Polyvinyl rolled expanded metal tops, which are the table type available from the other vendors listed, are more prone to vandalism, and once vandalized, are prone to rust. Attached is more information on the metal-armor coating. The metal-armor coated finish is currently used on some Town trash cans including cans located outside the Municipal Building BUDGET/COST: $20,000 was budgeted for 14 tables (12 standard and 2 ADA) at the O'Connor Picnic Shelter from the Larimer County Open Space Fund. The Parks Department obtained three bids for the tables. As you know, Estes Park Senior Citizens Center Inc. is funding the vehicle purchase and has recently received a $34,435 grant from the Coleman Foundation to assist with the project. ($70,316.50 total price). For your information, the Senior Center van use policy (for Town of Estes Park staff) and the day trip registration policy (for trip participants) are attached to this report. o A general inventory of the Senior Center was completed in March. Estes Park Senior Citizens Center, Inc. and Town of Estes Park contents were listed. A copy is maintained with the Town of Estes Park for insurance. o Meals on Wheels fundraising: A fundraising goal of $2500 was identified for the 2006 Senior Center Meals on Wheels program. This goal has been achieved with donations totaling $3496. The Quota Club of Estes Park donated $2212, an anonymous donor provided $1000 and $284 was received in community donations. For 2007 and beyond, we have developed a sustainable fund, held by Estes Park Senior Citizens Center, Inc. that could be used in times of grant shortfalls, program expansion, etc. Excess funds from 2006 donations ($996) have started this fund. Future fundraising goals are yet to be determined, mainly dependent on a pending application with the _United_Way_for-the funding cycle 2007,08,09. United Way allocations are announced in June 2006. Statistics: Attached are statistics through March 31, 2006. Spring programming at the Senior Center: o Regular weekly programming continues (Arts and Crafts studio, Shakespeare II session, Tri Fit, Tai Chi, Body Awareness, Book Club, Treasure Attic, NARFE, Religion and Philosophy Group, cards and games, pool, social opportunities, etc.) Staff is working with an activity committee of Estes Park Senior Citizens Center Inc. on additional programming for 2006. The van is available for use by the Estes Park Senior Center and for the activities of Estes Park Senior Citizens Center, Inc. It is also available for use by other Town of Estes Park departments. RESERVATIONS: The Estes Park Senior Center and Estes Park Senior Citizens Center Inc,_bave_reservation priority.__ Town of Estes Park departments may reserve the van if not previously scheduled by the Senior Center and Senior Center Inc. Reservations are made by contacting the Senior Center Director (Lori Mitchell at 577-3765, Imitchell@estes.orq) or the Senior Center Program Coordinator (Nancy Matson at (577-3769, nmatson@estes.ora). Reservations will be maintained on an Outlook Calendar under the heading Senior Center Van. Senior Center staff will e-mail the reservation confirmation. Reservations may be made up to one year in advance. There are no standing reservations for Town of Estes Park departments except for the Senior Center. In case of conflict, preference will be given to Senior Center trips and then to multi-passenger trips. The van may be reserved for multi-day use only if there is no conflict with Senior Center needs. DRIVERS: All drivers of this van must be Town of Estes Park employees with valid Colorado driver's licenses. All drivers of this van must complete a one-time orientation to the vehicle, conducted by Senior Center staff. Record the beginning odometer reading on the chart located in the van. B. POST-TRIP The Town of Estes Park has its own filling station on Elm Road that is used by all Town vehicles. Please refill the van even after short trips. Return the van to the Senior Center parking lot (south or east side). Complete the post-trip checklist and leave it in the van. Check all doors and windows to see that they are closed and locked. Inspect inside the van for articles participants may have forgotten. If articles are found, return them to the Senior Center. Record the ending odometer reading on the chart in the van. Senior Center staff will bill your department quarterly based on use of the van. Cost of use will be determined by the Fleet Department and will vary based on vehicle operational costs. If you arrive after hours, please return the key in the utility bill drop box on MacGregor Avenue near the police station. If an opening occurs, the top name on the list will be notified in person or by phone; no message will be left on answering machines. V. Departure and Return Policy a. All trips depart from and return to the Estes Park Senior Center/Museum. b. Participants should check in with staff 15 minutes prior to scheduled departure time. c. The current status of this use is that it is prohibited in the Commercial Downtown due to the containment provision that requires all business activity to be contained within a building. However, this use is currently allowed in the Commercial Outlying zoning district. Staff has spent considerable time researching regulations in other municipalities and we find that most cities have no regulations specifically targeted to regulate this use. Also, at the state level there is no applicable air quality emission standard for commercial food preparation. Staff identifies a range of regulatory options: A. Status quo: prohibited in CD district but allowed in the CO district. B. Adoption of setback standards for the CO district in order to mitigate impacts to adj acent property. C. Prohibition of all wood fired smokers in all commercial districts. This regulation would simply prohibit the use of solid fuel in association with commercial food preparation. This would simplify enforcement, since any equipment that is not electric or gas fired would be non-compliant. Budget Impact: none Recommendation: Prohibit the use of solid fuel in association with commercial food preparation. MEMORANDUM Community Development To: Community Development Committee From: Bob Joseph Date: 4-3-06 Subject: Re-submittal Fee Policy Background: Staff is currently experiencing problems with a heavy workload and incomplete submittals for Planning Commission Review. We currently have a process where submittals are reviewed for completeness prior to acceptance for review, but we are flexible with this review, often allowing minor items to be provided later on as the review progresses. We now see the need to tighten up the completeness review, and to reject submittals that are incomplete at the time of submission. This normally adds one month to the applicant's time frame. In addition to this tightening, we see the need to implement a re-submittal fee charge for projects that badly neglect or ignore completion items and conditions of approval. A re-submittal fee of 20% of the original fee charged would deter the neglect we are currently experiencing.
