The original contingency for the project was $30,000. The November 1 change orders 1-5 totaled $10,844.17 leaving us a contingency balance of $19,155.83. The January Change orders are listed below. They total a credit of $83.39 leaving the contingency fund balance through January at $19,239.22 Change Orders: November change order balance $19,155.83 # 6 Fasteners and Framing $21490.22 #7 Fire Hydrant credit ($2398.00) #8 Additional electric $989.39 #9 Retain parking/walk ($20,165.00) January change order balance $19,239.22 BUDGET: Contingency Fund balance as of January 1 $19,239.22 ACTION: Approve Visitors Center change orders 6-9 Town of Estes Park Memorandum Date: January 9,2006 To: The Honorable Mayor Baudek & Town Trustees From: Tom Pickering, Estes Park Convention & Visitors Bureau Re: Proposed 2006 out of town CVB membership fees BACKGROUND The 2005 CVB policy advisory committee would like to recommend for your approval the fees for out of town CVB members as follows: All out of town businesses located within the 12.5 mile regional boundary may become members of the Estes Park Convention & Visitors Bureau and participate in all of the services at the same rate as in town businesses by paying the following membership fees: Retail, Restaurants and other non accommodations businesses will pay the annual membership fee of $495.00 Home based, non accommodations, businesses located in the same region may join at the annual membership fee of $295.00 Accommodations located in the 12.5 mile region may join by paying a base fee of $295.00 and an additional fee of $40.00 per hotel/ motel unit, an additional $80.00 per condo/cabin/house. R.V. and campgrounds located in the 12.5 mile region will pay a base fee of $295.00 and an additional fee of $10.00 per campsite / R.V. site. BUDGET: Revenue projections for an estimated 15 members will be $32,000. ACTION: Approve the 2006 fee structure as proposed Estes Park Convention & Visitors Bureau Association Membership Policy The Estes Park Convention & Visitors Bureau may accept memberships by local associations following the criteria outlined below. 1. The local association represents businesses or organizations from the Estes Park Region with at least 75% of those members having an Estes Park region address (12.5 mile radius of Estes Park). 2. The Association must include all of the regional businesses or organizations that want to belong. 3. The association will pay the Estes Park Convention & Visitors Bureau the association membership fee for their services annually. 4. For the membership fee the association will receive the following. a. A free listing in the association/ organization category of the business directory on the CVB website. b. The option to annually purchase brochure racks in the lobby of the Visitors Center at the current rates. c. A free link to the organizations web site. The association membership does not allow buying the leads or referrals for the organization or any additional services offered except for those listed above. 5. The Estes Park Convention & Visitors Bureau policy advisory committee has the right to review this policy and make changes as necessary. Estes Park Convention & Visitors Bureau Policy Reciprocal Distribution of Regional Travel Partners Visitors Guides The Estes Park Convention and Visitors Bureau has entered into an agreement with our regional travel partners (Colorado' s Front Range Region) to share in distributing each others Convention & Visitors Bureau's visitors guides. It will be the policy of the EPCVB to distribute through the visitors center the primary travel piece for the towns of Fort Collins, Greeley, Loveland, Longmont, Boulder, plus Grand Lake. The following criteria have been established to qualify for the free distribution program. 1. Each of the above CVBs will supply the single primary piece that is produced to market their community as a tourism destination. 2. Each of the CVBs listed above have agreed to distribute, at no charge, the Visitors Guide produced by the Estes Park CVB in their visitors centers. 3. The Estes Park Visitors Center will designate a shelf in the visitor' s center for the distribution of the regional travel partner' s materials. 4. The Estes Park Convention & Visitors Bureau policy advisory committee has the right to change or amend this policy as needed. . LEASE THIS LEASE, made and entered into this /014 date of D.,c.1« , 2005, between the TOWN OF ESTES PARK, municipal corporation, hereinafter referred to as Lessor, and the LIONS CLUB OF ESTES PARK, COLORADO, a Colorado Nonprofit Corporation, hereinafter referred to as Lessee. WITNESSETH: Lessor, for and in consideration of the covenants and agreements hereinafter set forth, to be kept and performed by Lessee, has leased and does hereby lease unto Lessee all those premises, situate in the Town of Estes Park, County of Larimer, State of Colorado, known and described as follows to-wit: SEE EXHIBIT A - The bordered areas on the attached exhibit show the areas for the exclusive use of the Lessee and the 3.2 liquor license area. TO HAVE AND TO HOLD, the above described premises with the appurtenances, unto Lessee from January 1, 2006 through December 31, 2007, and Lessee in consideration of the leasing of said premises aforesaid by Lessor to Lessee, covenants and agrees with Lessor as follows: 1. To pay to Lessor, as rent for said premises, fifteen percent (15%) of the gross sales from the operation of Concession Stand on the first $50,000 and ten percent (10%) of the gross sales over the first $50,000. For the purposes of this Lease, gross sales shall be the total amount of funds realized from all sales of food and beverages from the concession stand, less sales tax, sales tax license fee, food license fee, and liquor liability insurance. Lessee shall be entitled to deduct from the yearly rent, an amount equal to the annual license fees paid to the Town of Estes Park and the State of Colorado for the 3.2% beer license. Said rent shall be due and payable to the Estes Park Fairgrounds Manager on or before the lat day of December, during the term hereof beginning on January 1, 2006. 2. To keep complete and accurate records of Lessee's operation of the concession stand and submit to the Town of Estes Park a record of the gross receipts from the Stand for each show. In addition, a table of calculations would be submitted showing the amount due the Town of Estes Park. 3. To be liable for repairs and maintenance of all items identified as property of the Lions Club of-Estes Park as set forth in the inventory list (Exhibit B). The Lessor shall be liable for repairs and maintenance of all other equipment on the inventory;list identified as property of the Town of Estes Park. In addition, the Lessor agrees to pay for maintenance of the interior and exterior of the building in accordance with structural codes and health standards. For general maintenance, i.e. painting and minor improvements, the Lessor will pay for the materials and the Lessee will provide manpower. 4. To keep the Concession Stand and table areas safe ahd clean and in such order as may be required by the regulations of any governmental authority. This will include the picnic tables and surrounding area. Lesser will provide for adequate trash and garbage disposal. 5. Not to alter the structural integrity of the building in any manner, except with the Lessor's written consent. 6. To allow Lessor or its agents to have free access to the demised premises for the purposes of examining or inspecting the condition of the same or the operation of the Concession Stand. 7. To flirnish to Lessor a written physical inventory of the equipment presently located in the demised premises. Lessee shall keep said inventory current by written notice to Lessor, whenever there are any additions to equipment. Each listing shall designate the ownership by either the Lions Club of Estes Park or The Town of Estes Park. 8. Lessee agrees to procure and maintain during the term of this Lease, the following insurance coverages: A. Comprehensive General Liability Insurance of at least $150,000.00 per injury and $600,00.00 per oqcurrence. B. Liquor Liability Insurance for the sale of all alcoholic beverages sold by Lessee of at least $150,000.00 per injury and $600,000.00 per occurrence. C. The Lessee and the Lessor understand and agree that the Town is relying on, and does not intend to waiVe, by any provision of this Lease, the monetary limitations (presently . , $150,000.00 per injury and $600,000.00 per occurrence) or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act 24-10-101 et seq., C.R. S., as from time to time amended or otherwise available to the Town or any of its officers, agents or employees. D. The Lessor shall be named as an additional insured on said policies. 9. It is agreed by the parties hereto: A. All items on the equipment list owned by the Lessor, all improvements, and all fixtures and equipment shall become the property of Lessor when permanently placed or affixed in the demised premises, and said improvements fixtures and equipment shall be insdked at the Lessor' s expense. B. Lessee shall have the concession for the sale of all food and drink, fdr the Stanley Park Grandstand Area and for the blacktop in front on the Stanley Park Grandstand Area as described on Exhibit ~A" attached hereto and incorporated herein by reference during the term of this Lease. The Lessor specifically reserves the right to allow or license other concessionaires on the Stanley Park grounds other than the area speci fically described on Exhibit "A". The Lessor shall allow other concessionaires only during events which, in the judgment of the Lessor, are deemed unserviceable by Lessee alone. C. Lessee shall operate said Concession Stand at all events scheduled at the Stanley Park Grandstand Area, and when Lessor requests that the Concession Stand be operated for the other events at Stanley Park with reasonable advanced notice. Lessor will provide the Lessee a schedule of events for the season at least three weeks prior to the start of the first event of the season. Changes that effect the operation of the Stand or require the services of the Lessee will be presented to the Lessee and jointly the two parties will negotiate whether the Lessee can handle the situation or event. Lessee agrees to work with the renter of the grounds and comply with their mandatory open hours of operation. D. If Lessee shall fail to comply with the conditions of this Lease, or should not well and truly perform all and every one of the covenants and agreements herein contained on the part of the Lessee to be performed and kept, then this Lease shall, at the option of Lessor, cease and absolutely terminate. Notice of such termination shall be delivered to either the then acting President or the then acting Secretary of Lessee. In the event of a default by either party in the terms and conditions hereof, the non-defaulting party shall give the defaulting party ten (10) days' notice in writing of said default. If said default is not cured within said ten (10) day period, the non- defaulting party shall be entitled to begin legal proceedings, including an action for specific performance and/or damages or terminate the Lease. Damages shall include all reasonable attorney's fees and court costs incurred by the non-defaulting party. E. In the event that changes occur which materially affect the operation of the demised premises, either party shall have the option to request that this Lease be renegotiated. F. Lessee may operate the Concession Stand other than at events scheduled at Stanley Park Fairgrounds by the Town of Estes Park through the Estes Park Fairgrounds Director. Lessee will pay the Town as rent for the events covered by this specific Paragraph five percent (5%) of the gross sales minus sales taxes from the operation of this Concession Stand during these events. For the purpose of this specific paragraph only, gross sales shall be defined to mean the total amount of funds realized from all sales of food, and beverage from the Concession Stand exclusive of sales taxes. 10. Lessee understands and agrees that it is an independent contractor under the terms and conditions of this agreement. As such, the Lessee is not entitled to unemployment or insurance benefits through the Town. Also, the Lessee understands and agrees that it is solely responsible for all Federal and State income tax, FICA taxes and unemployment insurance taxes. Lessee also understands and agrees that it is responsible for worker's compensation coverage and taxes for itself and any employee. 11. All notices, demands or other documents required or desired to be given, made or sent to either party, under this Agreement shall be in writing, shall be deemed effective upon mailing or personal delivery. Greater quantities will be delivered to the new Visitors Center when it opens. 2. General Planner requests for mailed copies are at 50,846, down 6.12% compared to last year at this time. This level has been pretty consistent all fall. Individual planner downloads totaled 118,611. 3. Magazine advertising generated planner requests are down year-to-date by 3.7%. Downloads effect all of the hardcopy request counts. 4. Internet advertising: Our Google Ad-Words campaign has generated 85,918 click throughs to our CVB website. An expanded version of this campaign will be initiated in late January. 5. Search Engine Ranking for a search on the term "Estes Park," www.estesparkcvb.com remains on the first page of results for Google, MSN, AOL Search, and Yahoo - all of which account for over 98.% of our search engine referrals. The rankings above are "natural" rankings as opposed to "ad word" rankings that we get as sponsored links. 6. 2006 March Magazine ads are being shipped this week. The national ads feature a new visual design, new copy, and a new headline variation on Real Rockies for an entirely new look and feel to our national advertising. ACTION ITEM: None BACKGROUND: N/A BUDGET/COST: N/A RECOMMENDATION: N/A CDC Report - Group Sales January CONFERENCE CENTER We are currently working on the replacement of carpet in the EPCC. With 15 years of wear and permanent staining on the current carpet, it is definitely in need of replacement. This ongoing process will be ready for your review at next month's meeting. We will present a budget, carpet samples and color board for your review. Tom is working with our concrete contractor to replace the capstones that have created leaking in the ceiling ofthe front foyer areas at EPCC. Work should be completed in January. ADVERTISING/MEDIA Colorado Meetings & Events Resource Directory for 2006 was distributed mid-December. Estes Park Conference Center has placed an ad in this directory. (See attached) The Rocky Mountain PCMA magazine The Knowledge Connection Fall issue just came out in late November. EPCC advertised in this trade magazine throughout 2005. I am currently working with Diana Rowe, a freelance writer whose specialty is the meetings travel market. She has included Estes Park and the EPCC in previous articles. She is hoping to visit Estes Park for an overnight stay and tour of our various meeting and conference facilities for an up to date look at Estes Park. She hasn't been here since Fall of 2003. TRADE SHOWS Julie participated in the Destination Colorado Front Range trade show on December 8th in Denver. The show is geared to all Colorado meeting planners, no matter what the market. Approximately 275 meeting planners attended the show. We received numerous leads for small meetings, one lead for a large 'day trip' from a Denver-based conference and three leads for city-wide conferences. Allleads are being followed up; none of these leads were included with the December CVB Group Sales report. Through Tour Colorado, the EPCVB was represented at the annual NTA (National Tour Association) conference. A total of 37 leads were received for tour companies planning Colorado excursions. All will receive follow-up information from Estes Park. GROUP SALES LEAD/REFERRALS Group activity has remained steady as 2005 concluded. We're starting to be able to track the history and should see patterns developing over the next year regarding seasonal fluctuations in the type of group, leads being generated month by month. (See attached end of year figures) ESTES PARK FILM COMMISSION Late November and early December say activity on location requests for upcoming film projects. We saw requests for photos of log homes for a still photography shoot and dams for a Disney movie, mountain luxury estates for an episode of CSI to name a few. Digital photos were taken and forwarded to the various production companies. An upcoming television contest for inventors was received as well. Local papers published information and several residents responded for further information. One local resident attended the interviews in Denver and appears to be in the running for a spot on this nationally televised reality show, which will be filmed in 2006. More details will follow should he make the final Cut. Working with Dr. Durward, information was forwarded to the producers ofthe Ellen Degeneres show. After the short feature on the Tonite Show in 2005, her staff has expressed interest in the 2006 Scottish/ Irish Highlands Festival. 0 49 . I 91. They included the Ambassadors, the Art Center of Estes Park, Brighton Senior Center, Cheley Camps, Colorado Historical Society, Colorado Renewable Energy Consortium, Colorado Women's Press Association, Cub Scouts, Dorsey Museum, Estes Park Car Club, Estes Park. Public Library and Library Foundation, Estes Park Schools, Eagle Rock School, Kiwanis, Loveland Senior Center, Methodist Men's Group, Newcomers, Rocky Mountain National Park, Rocky Mountain Nature Association, Rotary Club of Estes Park, Scottish-Irish Festival, Stanley Museum, and Sunrise Rotary. •Received $20,000 in support by the Friends ofthe Museum Foundation to underwrite advertising, programs, conservation and office supplies, printing and postage, exhibits, professional dues, training, landscaping, and lighting •Forty-eight volunteers gave approximately 1750 hours of service in 2005. For the second year, graduate students from Emporia State spent a week in September at the Estes Park Museum. Filmed oral histories of 14 long-term Estes Park residents. 3. Under a $25,000 federal grant, transferred the last 11,000 of our paper collections records to a computer database. This winter we will be holding workshops to acquaint researchers with the new resource. 4. With the help of dedicated volunteers, completed an inventory of our off-site collections storage facility. All location information has been entered into the new database. 5. Completed a structural study ofthe Birch Ruins in the Knoll/Willows preserve via a grant from the State Historical Fund. TOWN OF ESTES PARK Office Memorandum To: Community Development Committee -Trustees Doylen, Levine, and Pinkham From: Lori Mitchell I)ate: January 5,2006 Re: Estes Park Senior Center -January report REPORT: 2005 Review: Estes Park citizens enthusiastically supported the Estes Park Senior Center in 2005. Over 17,000 visits were made to the Center and over 10,000 of those visits were made by participants in programs and activities. Over 14,000 meals were prepared this year. The membership to Estes Park Senior Citizens Center Inc. stands at nearly 500 for the year 2005 compared to 297 for 2004. The Town of Estes Park team welcomed Nancy Matson into the newly created role of half time Senior Center Program Coordinator in January 2005. Since Nancy began, over 65 new programs or classes were offered this year along with the rigorous schedule of weekly activities. Nancy also assumed the role of coordinating the rentals of the Estes Park Museum and the Estes Park Senior Center. There were 12 rentals at the Senior Center with 392 participants and 6 rentals at the Museum with 464 participants. Rentals included events such as anniversary parties, birthday and wedding celebrations and business meetings or club events. There were 19 non-rental group functions using the Senior Center with 1295 participants. Town staff worked collaboratively with over 73 agencies, businesses, groups·and individuals to plan and provide programs. Senior Center members participated in offering slide shows and travel talks, music programs and lectures, Tai Chi and art and craft classes, entertainment and thought provoking experiences. Estes Park Senior Citizens Center Inc., the Estes Park Medical Center, the Aspen Club, Options for Healthy Living, Med X, the Estes Park Public Library and the Estes Park Museum are just a few of the organizations. The Town of Estes Park has valued partnerships with the United Way of Larimer County and the El Pomar Foundation. These agencies provided direg assistance in the form of $13,239.00 in grant awards in 2005 to assist in funding the operation of the meal programs at the Senior Center. Estes Park Senior Citizens Center Inc. funded over $20,000 in projects this year including a defibrillator, construction of a new art sink area, a new exterior lighted sign, volunteer aprons, the construction of a new garden wall with funds from a Kinney Grant as well as support of activities and programs and the support of equipment such as a commercial food processor, fireplace guards, art tables and office chairs. The most exciting accomplishment of Estes Park Senior Citizens Center, Inc. is the decision to fund the purchase of a new wheelchair accessible 14 passenger van for recreational trips offered through the Senior Center. Town staff and the Senior Center Board of Directors diligently pursued this project for over a year conducting research. Bids will be returned to Town staff December 29,2005 and will be reviewed by staff and the Senior Center Board van committee in January. One hundred and thirty-seven Town of Estes Park Senior Center volunteers gave 6385 hours of service in 2005. Multiple fundraising efforts, reception duties, Meals on Wheels volunteers and Board committee work highlighted the volunteer efforts. The program allows area employers to form a pool for workers compensation insurance. The Town has directly benefited from the program through dividends and discounts related to the program. Due to declines in membership at the Estes Park Chamber of Commerce, the program is seeking a change from the Chamber as the sponsoring membership organization to the Town's Convention and Visitors Bureau. Attached you will find information about the program from Insurance Associates of Estes, Inc. and Pinnacol Assurance. The program provides savings and economies of scale for smaller businesses in the area and has provided a substantial savings to the Town on its worker compensation insurance. Transition of the program from the Chamber to the CVB will insure continued availability of the program both for the Town and CVB members. The Town will have certain responsibilities related to the program and those duties will be handled by our Human Resources personnel and the CVB. The primary role of the CVB will be to market the program to members while HR will work with Insurance Associates and Pinnacol to administer the program. The responsibilities that will fall to HR are relatively simple and should not create a burden. Greg White has reviewed the documents related to the program and will approve any final contract. Budget I am unaware of any direct cost to the CVB for sponsorship. However, there is the potential for the CVB to eam a cash dividend depending on how the pool performs on an annual basis.
