LETTER OF UNDERSTANDING The following shall serve as the understanding between the Town of Estes Park, hereafter referred to as the "Town", and Connie Boschen d/b/a/, Connie's Cartoons, hereinafter referred to as " Coordinator", regarding coordination of the 2001 Christmas Parade, hereinafter referred to as "the Parade" or "the Event". 1. The Town will pay $ 11,000 to the Coordinator in return for services as Christmas Parade Coordinator for 2001. Said sum shall be pid on November 23, 2001. 2. It is understood that the services to be rendered by Coordinator include coordinating the efforts of the various entities and individuals; administering the contracting for services, equipment and personnel and submitting invoices on a monthly basis; planning the general character and presentation of the Parade; directing the general character and presentation of the Parade; directing its information; and causing it to be presented at the appointed time. The appointed time is agreed to be approximately dusk on the evening of Friday, November 23, 2001. Coordinator shall not be responsible for acts of God and conditions beyond the control of Coordinator, which may delay, postpone or cause cancellation of tile Parade. 3. Tlie Town agrees that Coordinator shall have option to coordinate Christmas Parades, or such similar activities and celebration as may replace the Christmas Parade, in 2002 and 2003 subject to the Town and Coordinator agreeing on the terms and conditions of the coordination of those events. 4. It is understood that the proposed budget to be submitted by Coordinator on or about January 3, 2001 will be tentative in nature, and that amounts associated with specific line items may be substantially adjusted. However, Coordinator will not contract for rentals materials or services in amounts totaling more than $25,000 without the express written authorization of the Town. The $25,000 is in addition to and separate from the above- referenced $11,000 for services. The $25,000 shall be disbursed as set forth on Schedule A . 5. It is understood and agreed that the $25,000 budget is essentially for items associated With tile staging of the Parade. This includes such items as lights, generators, sound systems, stages, decorating, sanitary equipment, decorations for street and stages, purchase of costumes and props, creating and constructing sponsored floats and/or characters, obtain materials, and for labor involved in the construction of the floats and/or characters. 6. The Special Events Department will attempt to obtain "sponsorship" of floats, characters and combination thereof, by soliciting funds from merchants, lodging establishments, and otlier business people and organizations. All funds shall be retained by the Town. 9. AGREEMENT . The weather was great. Growth is always dependent on weather. COMMENTS: The parade quality was extremely good. Police did an excellent job with traffic. The drivers and volunteers are much appreciated. Many merchants had their best sales day ever! Day-time activities continue to be successful and necessary. I would consider this year to be the "Best" Christmas Parade Connie and we have produced. June 27,2000 Richard Wood read a letter at the Town Board Meeting concerning use of the downtown parks. 2. Letter was referred to the Special Events Department and placed on the July Community Development Meeting Agenda. Comments were heard from Richard Wood, various other downtown merchants and several Bond Park event organizers. 3. At the October Community Development Meeting I presented proposed Event Organizer Regulations. Discussion followed by both the Trustees and public. I was d i rected to respond to the concerns and wordage changes and present again at a Trustee Work Session. 4. At the November Trustee Work Session there was considerable discussion of the proposed Event Organizer Regulations and also future use of the downtown parks. Changes were suggested. Budget N/A Action Request consideration of the approval of the revised Special Events Policy Manual to the ':Park Use Regulations Section" (copy of the additional Event Organizer Regulations attached). - /3. Revised 11-28-00 Event Organizer Regulations Town Parks Definition of Event - any form of organized activity lasting longer than two hours. No new events will be given use of the park on holiday weekends or summer tourist season. All shows using Bond Park which sell vendor spaces will be limited to: 95 10 X 10 spaces. Only vendors selling original products will be allowed. Organizers using any Town Parks will: 1. Mark spaces the day prior to the event. 2. Will be on site 3 hours prior to the given time of set-up. 3. Inform vendors that no RV's will be allowed overnight in any of the public parking lots. 4. Ensure that all sales tax information is distributed to the vendors and that the vendors show proof of payment on the forms provided. Failure to collect and remit sales tax will result in the vendor not being allowed to sell at any future shows in the Estes Park area. 5. Provide public restroom location information to all vendors. 6. Monitor sound levels to ensure sound is not above 60 decibels at the Park boundary during the day, and 55 during evening hours. 7. Provide adequate trash dumpsters at the corner of the park. No bags are to deposited outside the dumpsters. 8. Make sure that the Park is left litter free, tables placed in their original positions and ready for public use. 9. Notify the Health Department if food is to be sold. 10. Provide insurance coverage as stated. Additional regulations for organizers using Bond Park: 1. Obtain license plate numbers of each vendor's vehicle to monitor and strictly enforce no parking around Bond Park. 2. Instruct vendors to park north of Park Lane on MacGregor Avenue. If Event failures to adhere to the above regulations, future use may be denied. - 14.
