This compares with 1,198 in August of 1999 (851 congregate and 347 Meals on Wheels.) ACTIVITIES/PROGRAMS We have a goal of at least one program per month that addresses Senior health issues. There has been a good balance of presentations by Poudre Valley Hospital Aspen Club physicians and local physicians and service organizations. Recent presentations included Travel/Immunizations, Home Health/Hospice, and Salud Clinic. These continue to meet with good response by the Seniors. In past years the Senior Center was the site for community flu shots. This year we have been advised that this will not be the case due to the shortage of vaccine. Seniors have expressed much concern about this shortage. However, they have been assured that Seniors will be a top priority when making vaccine available. Programs of an entertaining nature have included a children's choir, Improvisation by professional actors, a member's slide tour of Japan, and a video of the Estes Park Car Club's classic car show. Recent social outings included another Rockies game and a trip to Boulder Dinner Theatre for "Evita." Mayor Baudek hosted the Holland Friendship Club at the Center in September. FUND RAISING The Seniors had another Breakfast Buffet on September 9. This was combined with a bake sale, sale of parking for the Scottish Festival, and sale of tickets for the Nativity scene drawing. This was an ambitious effort for the Seniors and netted approximately $1,050. The Senior Board has been exploring the possibility of partnering with another group to help with fund raising. Linda Vogel of the Cultural Arts Council approached the Board to explore the possibility of holding their annual Arts and Crafts sale at the Senior Center on December 2. It was decided to proceed with this event on a trial basis. The Seniors will provide a chili/soup lunch, a bake sale and their own silent auction as fund raisers. The Seniors will again participate in the Women's Club Christmas tree display at the Stanley Hotel. A year-end mail campaign is also being considered. TRANSIT Pick-Me-Up As previously reported, the Pick-Me-Up program was briefly discontinued until summer residents Pete and Linda Hogue stepped up to the plate to become coordinators. There was concern for the program when the Hogues returned to Texas in September. However, we are pleased to report that Angela Welborn has volunteered to take this responsibility for the winter. The Hogues are wanting to provide that service again when they return next summer. Special Transit Special Transit continues to operate at full capacity on their two-day per week schedule allowing the Seniors to access medical services, grocery shopping, and meals and activities at the Senior Center. Recently, due to a small grant, rides to the Center and medical appointments have been free to Estes Park Seniors. Steve Blacksher has indicated that Special Transit is very interested in providing a third day of service to Estes Park residents in January, 200(1. Special Transit will again approach the Town of Estes Park for assistance in funding this program. Box 4034, Estes Park, CO 80517 To: Community Development Committee From: Estes Park Business Advocates Date: September 26,2000 Re: Celebrate in Estes Park We are writing to inform you of developments surrounding "Celebrate in Estes Park" and to request approval of specific aspects and activities involved in this special event. "Celebrate in Estes Park" will be held between noon and 4:30 p.m. Saturday and Sunday, December 9 and 10, 2000. This year "Celebrate in Estes Park" is being organized and supported solely by direct financial contributions of merchants. The town and Chamber Resort Association are i cooperating in publicizing the event but are making no direct financial contributions. Business Advocates has taken the lead in fund raising and in lining up various activities and events. Sharleen Westfield, owner of "In the Groove", has taken on the principle leadership role organizing the 2000 version of "Celebrate in Estes Park". She and Danial Via, Chair of Business Advocates, are the primary contact persons for the event. Activities similar to those of past years are planned with one major exception: Elkhorn Avenue will remain open to vehicular traffic. This will avoid the traffic and access problems of past years when the street was closed and will hopefully spread the benefits of "Celebrate in Estes Park" to businesses and merchants located east and west of the areas of previous street closures. Entertainment and street performers are still being contracted but include singers, dancers, costumed characters, giant puppets and others. Many of these entertainers will be putting on performances at various locations up and down Elkhorn Avenue and may be roaming as far as Barlow Plaza and West Park Center. Since the street will be open to traffic it would be very helpful if the Elkhorn Avenue street parking areas and loading zones from MacGregor Avenue west to Tregent Park could be coned or cordoned off to provide areas off the sidewalks where entertainers could perform. Where room to perform is not otherwise available, the space offered by the parking and loading areas would be used to avoid congestion or blockage of sidewalks. In addition to these wandering street performers, we wish to use both Bond Park and Tregent Park for specific, fixed events and activities. A Christmas version of this summer's "Campfire-Singalongs" is planned for Bond Park, making use of the newly installed gas fired firepit and surrounding area. Brad Fitch, the same entertainer who did the summer singalongs, will perform again. The giant puppets, who also performed in Bond Park this summer, will perform again in Bond Park and other locations as weather and conditions permit. As in previous years there will be carriage rides offered. Don Gardner, the same carriage ride operator who provided service on Elkhorn Avenue during weekend evenings-this summer, will follow basically the same foute used this summer with the exception of using the street parking spaces in front of Bond Park as the pickup/dropoff point. In addition to permission to-use this space for pickups/dropoffs, we request that the nativity and "Christmas in Bugville" displays be located so as not to obstruct access or views of activities in Bond Park, or to block the carriage ride pickup/dropoff area. Tregent Park will be the home of Santa Claus. We plan to use the temporary "Santa's House" that was placed on the closed Elkhorn Avenue in previous years, but will place it, and Santa Claus, in Tregent Park where it and he will ·be close to parking and restrooms. Again, having the loading zone in front of Tregent Park closed off will provide extra space for performers and any groups or lines of people waiting to visit Santa. Plans for "Celebrate in Estes Park" are fairly firm at this point, but details are still being worked out and additional activities may be added. We will keep you informed and request appropriate clearances and permission in as timely a manner as possible. AGREEMENT THIS AGREEMENT, made and entered into this day of , 2000, by and between the TOWN OF ESTES PARK, a Colorado Municipal Corporation, hereinafter referred to as "Town" and POWDER RIVER RODEO .PRODUCTI-eNS; iNG:, hereinafter referred to as "Rodeo". ; LLC #4- WITNESSETH: 1. Rodeo shall produce for Town a rodeo to include six (6) performances, commencing on the 10th day of July, 2001 at Stanley Park, Estes Park, Colorado. Performances shall be as follows: No. of Shows Dates Time 1 July 10, 2001 7:30 P.M. 1 July 11, 2001 7:30 P.M. 1 July 12, 2001 7:30 P.M. 1 July 13, 2001 7:30 P.M. 1 July 14, 2001 7:30 P.M. 1 July 15, 2001 7:30 P.M. Rodeo shall also produce a rodeo to include six (6) performances in July of 2002 and 2003 under the terms and conditions of this Agreement. The Town shall notify Rodeo on or before October 1, 2001 of the specific dates and times for the 2002 performances and on or before October 1, 2002 of the specific dates and times for the 2003 performances. 2. Rodeo shall furnish all supervision, quality stock, personnel and equipment- necessary for the six (6) major rodeo events, including but not in limitation thereof the following: pickup men, timekeepers, arena directors, arena secretary, announcer, soundman and sound equipment, arena and chute help, rodeo music, 2 bullfighters, and a specialty act to also perform as the barrel man. The Town shall furnish chutes, rodeo grounds, and approved PRCA Rodeo Judges. All personnel and equipment shall be subject to the approval of Town and the Professional Rodeo Cowboy's Association, Colorado Springs, Colorado, and shall comply with said Association's rules and regulations. Rodeo agrees that quality stock shall be stock of the same quality and condition of stock provided at other rodeos in the Northern Colorado area during the term of this Agreement. 3. The Town shall also furnish to the Rodeo seventeen (17) tons of hay and four (4) tons of grain. (2) 4. Town shall deliver to Rodeo one day prior to the start , of the first performance in each year the sum of Fourteen Thousand and 00/100 Dollars ($14,000.00) as prize money which is to be disbursed by Rodeb, together with all contestant's entry fees. Rodeo shall collect all the Contestants entry fees. All prize money agreements are to be subject to the approval of said Professional Rodeo Cowboys Association. In the event that the number of shows is increased or decreased by the Town, the amount of prize money shall be adjusted on a pro-rata basis. 5. Town shall pay to the Rodeo for the production of said Rodeo, as herein agreed, the sum of Thirty Seven Thousand, Four hundred and 00/100 Dollars ($37,400.00) to be paid upon complete performance of Rodeo. 6. Town agrees to furnish the facilities at Stanley Park for the Rodeo. 7. Town shall arrange for an ambulance at the rodeo grounds during all contests. 8. Town shall have the overall authority, control and supervision of Stanley Park, except the production of the rodeo portion thereof, as hereinabove provided, which shall be under the sole supervision, control and responsibility of Rodeo. 9. Rodeo shall provide comprehensive general liability insurance with minimum policy limits of One Million and 00/100 Dollars ($1,000,000) for each occurrence and One Million and 00/100 Dollars ($1,000,000) aggregate. The policy shall be applicable to all premises and operations. The policy shall ' include coverage for bodily injury, broad form property damage, personal injury (including coverage for contractional employee's acts), contractional and independent contractors. The Town shall be named as additional insured on this policy. Rodeo shall furnish certificates evidencing the above insurance requirements including the addition of the Town as additional insured on the general comprehensive liability policy, as least thirty (30) days prior to the beginning of the rodeo. The Town shall reimburse Rodeo upon presentation of said Certificate for the cost of this insurance. Said sum shall not exceed One Thousand Five Hundred and 00/100 Dollars ($1,500.00). The parties to this Agreement understand and agree that the Town is relying on, and does not waive, by any provisions of this Agreement, the monetary limitations or terms (presently $150,000.00 per person and $600,000.00 per occurrence) or any other rights, immunities, and protections provided by the Colorado Governmental Immunity Act, 24-10-101 et. seq., C.R.S., as from time to time amended or otherwise available to the Town or Any of its officers, agents or employees. . r . I. (3) Rodeo understands and agrees that they are an independent contractor under the terms and conditions of this agreement. As such, they are not entitled to unemployment or insurance benefits through the Town. Also, the Rodeo understands and agrees that they are solely responsible for all Federal and State Income Tax, FICA taxes and Unemployment Insurance taxes. Rodeo also understands and agrees that they are responsible for Workmen's Compensation coverage and taxes for themselves and any employee. 10. All notices, demands or other documents required or desired to be given, made or sent to either party, under this Agreement shall be in writing, shall be deemed effective upon mailing or personal delivery. In the event that there is a default under any terms and conditions of this Agreement, the non-defaulting party shall give the defaulting party ten (10) days notice in writing df said default. If said default is not cured within said ten (10) day period, then the non-defaulting party shall be entitled to,all damages incurred by the non-defaulting party as a result of said default, including an action for specific performance. Said damages shall include all reasonable attorney's fees and court costs incurred by the non-defaulting party. 12. Rodeo agrees to include the Town on all releases or waivers of liability obtained by Rodeo from the participants, contestants, and/or exhibitors of said show, with Town to be released in the same manner as Rodeo. Rodeo agrees to furnish to the Town a copy of the waiver or release form which Rodeo intends to use for said purpose. 13. Rodeo agrees that Town shall not be liable for any injuries, sickness or damage to any of Rodeo's employees, livestock or personal property, and Rodeo agrees to indemnify and to hold Town harmless therefrom and from any third-party claims for loss, damage, sickness or injury caused or alleged to have been caused directly or indirectly by Rodeo, its employees, agents or animals, or caused or alleged to have been caused directly or indirectly in any manner whatsoever by the herein agreed upon performances by Rodeo. Said indemnification shall include all reasonable attorney fees and costs incurred by the Town resulting from any third party claim. (4) 14. This agreement represents the entire agreement between the parties and shall not be amended by either of the parties hereto without written consent of the other party. 15. This agreement shall be binding upon and insure.to the benefit of this parties. hereto, their successors and assigns. 16. The Town shall have the option of extending this contract for two additional one year periods for 2001 and 2002. The Town shall give Rodeo written notice on or before October 1, 2001 of its intention to extend this Agreement for 2002 and on or before October 1, 2002 of its intention to extend this Agreement for 2003. Also, on or before said October 1st date, the Town shall include within its written notice the date and times of performances. 17. In the event that the Town extends this Agreement for 2002 and 2003, all other terms and conditions of this Agreement shall remain the same as stated. The first two years the event was directed by the Town of Estes Park Special Events Department and the Chamber Resort Association. Year 2000 the event has been organized by Estes Park Business Advocates. Funding has come from business sponsorships. Major change is that Elkhorn Avenue will remain open at all times. 2000 Requests: 1. All Elkhorn Avenue loading zones to coned - same as for Parades 2. Permits for use of Bond Park and Tregent Park have been filed. 3. Request use of the Bond Park fire pit. Use same as for the Sing A Longs They sponsor during the summer. Chief Dorman to verify approval. 4. Request permission for Don Gardner to conduct carriage rides. Mr. Gardner is approved and has been providing rides during the summer of 2000.
