Community Development Committee Advertising Program Report April 2, 1998 1. Requests for Information As ofFeb. 28, we have received 6,710 requests for information, an increase of 40% over 1997. Graph attached. As ofFeb. 28, requests for information from magazine ads are at 1,325, an increase of 38.16% over the same period in 1997. 2. Incoming 800 calls As of Feb. 28, our incoming 800 line calls are at 6,658, a decrease of 13% compared to the same period in 1997. Graph attached. 3. Virtual Visitors Guide As ofMarch 30 (Monday), we had received 1,377 e-mailed requests for information Compared to 132 e-mailed requests last year. 4. Research Projects A. 1997 Conversion Study is in Draft form at this time, and will be presented during the Joint Board Meeting on April 23. B. The first ofthree focus group sessions took place last Wednesday, March 25, attended by Art Anderson, Al Wasson, Rich Widmer, Tom Pickering, David Thomas, Peter Marsh. C. The next sessions are scheduled for Wednesdays, 4-8 (Aurora facility) and 4-15 (Thornton hotel). Exhibit Opening Ranches and Rodeos, the Museum's summer exhibit, will open Friday, April 24 with a free public reception from 5 to 7 p.m. Refreshments for the reception are being donated by the Estes Park Brewely. A concurrent reception will be held at the Art Center ofEstes Park. Included in the exhibit are historic items from the MacGregor and Mac(}raw ranches, among others. Among the activities connected with the exhibit is a boot contest. The contest will begin April 3 and will be featured on Channel 8, in the Trail-Gazette, and on KRKI. Participants will identify the local owners of boots loaned for the exhibition. Winners will receive their prizes, donated by local merchants, at the April 24 opening. Also in conjunction with the exhibit will be a show of Western art at the Museum by Estes Park intermediate school students, taught by Cyndi Elkins. On July 9, Gary O'Connor willtead a behind the chutes tour at the Fairgrounds. 2. Other Programs As part of our federal Conservation Project Support grant, conservator Eileen Clancy ofDenver will conduct a training program on paper conservation for our volunteers and staff on April 6. Professionals from other area museums have been invited to attend the session. The multi-media program Women ofthe West, originally scheduled for March 18 (the day of the blizzard), has been rescheduled for Friday, April 10 at 7 p.m. The free program will be held in Mun. Bldg. room 203. Rocky Mountain National Park Chief of Interpretation Bill Gwaltney will give a free program on Rocky Mountain trappers and mountain men on April 28 at 7 p.m. in room 203. Visitors have a last chance to see the Prints of Lyman Byxbe exhibit during a free day on Sunday, April 5 from 1 to 5 p.m. 3. Colorado Getaways The Museum will be featured in a Colorado Getaways segment to air on Channel 4 at the end of April. Also featured will be the Stanley Museum at the Stanley Hotel. The segment was arranged through a contact at the Colorado Historical Society made during our Museum's marketing brainstorming session in 1996. 4. 4. Staff Resignation Assistant curator Michelle Zupan has resigned to take a position with the Roswell Museum and Art Center in Roswell, New Mexico. Her last day will coincide with the Ranches andRodeos exhibit opening on April 24. Michelle was instrumental in the Tracks in Time exhibit renovation project and in developing the collections rehousing project currently undenvay. We invite everyone who knows and worked with Michelle to wish her well at the Ranches and Rodeos reception. Museum Admission Policy A. General Admission: 1. Groups and Tours: Same as above, except group and tour rates are M the normal rate if scheduled two weeks in advance. In addition: Group tours for Estes Park school children, their instructors and assistants are free. Groups will be charged even if some are Friends of the Museum members. With children's groups, a ratio of one adult per every ten children is expected. Museum Memorial Policy The Estes Park Area Historical Museum welcomes gifts to the Museum in memory of area residents or visitors. Family members should meet with the Museum director or designated staff member to discuss appropriate uses for monetary gifts or ideas for donation of physical items as memorials. The director or staff member will then recommend the designated memorial use to a committee of Advisory and Friends Board members for approval. Estes Park Area Historical Museum Collections Management Policy (revised 1997) The Estes Park Area Historical Museum, a department of the Town of Estes Park, a Colorado municipal corporation, hereby establishes this Collections Management Policy to best serve the public interest by establishing and maintaining professional standards for the acceptance, use, storage and care of museum artifacts. The Estes Park Area Historical Museum Advisory Board is appointed by the Mayor of Estes Park to be advisory to the Mayor and Town Trustees in matters relating to the development and use of the Estes Park Area Historical Museum. I. Mission Statement The Estes Park Area Historical Museum operates for the purpose of collecting, preserving, interpreting, and exhibiting local history for our residents and visitors. II. Collections Objectives The Museum's intent is to ensure that the collections adhere to the purpose of this institution, namely, to discover and collect only those materials which establish or illustrate the history of the Estes Park area, defined as a circle with a 15 mile radius centered on the town of Estes Park. Generally, art and artifacts acquired should be more than 40 years old, created or used in this or adjacent counties or be representative of material created or used in this area, and be appropriate for research, comparison, and exhibit. More recent materials will be considered for acquisition if they have clear historical significance for the future or if they are related to important people or events in the history of the area. All materials collected must be illustrative of life, conditions, events and activities of the past and present in the Estes Park area. Although the Museum may collect material relevant to Rocky Mountain National Park, it will not be the primary repository for RMNP material; the same holds for material related to the YMCA of the Rockies, MacGregor Ranch, and Enos Mills, since other museums in the area are dedicated to those subjects. Criteria for selection into the collection will be in accordance with the Museum's Interpretive Plan and will include relevance to the history of the area, historic value of the artifact itself, condition and completeness ofthe artifact, whether the artifact is a duplicate of holdings already in the collection, whether the Museum has identified a need for that type of artifact, and the size of the artifact due to finite and limited storage and exhibit space. The Museum will only accept material it can properly store, preserve and protect. The Estes Park Area Historical Museum maintains three types of collections and will specify which collection will receive the artifact at the time of the donation. The Museum accepts artifacts for its Permanent Collection, Educational Collection, and Reference Collection, but will not engage in indiscriminate collecting. The three types of collections are: ll. Estes Park Area Historical Museum Collections Management Policy Page 2 A. The Permanent Collection consists of artifacts that are relevant to the Museum's purpose and are of historic and cultural value. The Museum is committed to preserving these artifacts as best it can in perpetuity for future generations. Donations to the Permanent Collection must be the best available at the time, fill a recognized deficiency or upgrade existing collections, and be adequately documented as determined by the Curator and the Director and approved by the Collections Committee. B. The Educational Collection consists ofartifacts that are reproductions or duplicates of artifacts in the Permanent Collection that will be used in the Museum's educational programs and that are subject to possible wear and damage. Although th& Museum will make every effort to protect these items, it is understood that materials used for hands-on educational purposes may eventually be damaged or destroyed. Therefore, only artifacts that are reproductions or can be easily replaced will be part of the Educational Collection. C, The Reference Collection consists of materials that will assist with the mission of the museum, but do not have direct historical significance in themselves. This will include documentary materials, particularly secondary sources such as reprints, current history books, maps, photocopies of historic documents, and so forth, which do not have intrinsic value as artifacts but contain historical information. Each of these collections will be managed in a manner appropriate to the materials contained within as specified below. III. Collections Committee The Collections Committee is composed of the Museum Director and Curator and additional members appointed annually by the President ofthe Advisory Board. The legal counsel for the Town of Estes Park may provide advice as necessary to the Committee. The purpose of the Collections Committee is to act as a liaison between the Museum, the Advisory Board, and the Town on collections related matters. Within the Advisory Board's broad scope of responsibility, they have delegated oversight of the collections policy to the Collections Committee, with decision-making powers as delineated below. 'rhis includes general supervision of the collections: namely, approval bf all acquisitions and recommending ~ deaccessions to the Board on a regular basis; assisting staff in development of museum management documents and recommending collections management policies to the Board; and monitoring and reviewing conservation practices. IV. Acquisition Policies & Procedures Acquisition to the Museum's collections, whether by gift, purchase, loan, bequest, excavation, or other means, shall be in accordance with the following rules. 1, The Town of Estes Park is a political subdivision of the State of Colorado and eligible for charitable donations. The donor may be eligible for state and federal tax benefits, however all donors should consult their own tax advisors with regard to the deductibilitiy of any doantion to the Museum for federal and state tax purposes. No acquisition shall be appraised by an Advisory Board member, staff member, or any other person closely associated with either. For the protection of the donor, it is recommended that appraisals bo accomplished by a qualified appraiser before the donation is conveyed to the Museum. 3. All items acquired will be in accordance with the Museum's Collections Objectives listed above. Any material collected by excavation will be in compliance with federal and state regulations. 4. A receipt will be issued for all artifacts offered to the Museum and conditionally accepted for addition to the collections pending review by the Collections Committee. The Museum assumes no responsibility for non-receipted artifacts left in its care and such artifacts shall be treated as loaned property under the applicable provisions of Section 38-14-101, et. seq., C.R.S. 5. Routine decisions regarding the acceptance or decline of objects offered for acquisition will be made by staff. The Committee recognizes that there is room for individual judgement in decisions made at this level. Non-staff committee members will be consulted when any of the following conditions exist: A. The value of a proposed acquisition is over $5000 B, There is a question about the local significance ofthe proposed acquisition C. The proposed acquisition is potentially controversial or in conflict with existing policy Conflicts which arise at this level of acquisition will be taken to the Advisory Board for discussion and recommendation to the Collections Committee. All donors should be informed that items are accepted subject to the above process. If the artifact is accepted, the receipt form becomes a legally binding donation agreement which transfers ownership from persons having legal title and interest in the subject artifacts to the Museum. Persons transferring title to the Museum shall certify that material was collected or acquired by them legally and shall warrant title to that material. 6, Artifacts receipted by the Museum but not accepted into the Museum's collections shall be deemed abandoned by the donor unless claimed within 120 days after mailing of notice of nonacceptance to the donor by certified mail with return receipt requested at the address provided on the receipt furnished. 7, All acquisitions of the Museum by either donation or purchase after acceptance by the Collections Committee become the property of the Town of Estes Park absolutely and without limiting conditions, to be used in the best interest of the Museum. Artifacts may be used for exhibition, study, research, loan or they may be deaccessioned. 8, In accordance with current copyright legislation, copyright may be maintained by the original artist if the artwork was produced after 1978. However, every effort to obtain copyright or rights to reproduce will be made by the Museum. 9, Artifacts for the Museum's collections may be purchased, provided they fall within the Museum's Collections Objectives. Artifacts may be purchased by the Curator with the approval of the Museum Director. Purchasing procedures must follow those outlined by the Town of Estes Park. Small purchases l3. Estes Park Area Historical Museum Collections Management Policy Page 4 whose cost falls within the annual budget amount for acquisitions may be made by the Museum staff, however, larger purchases may require Collections Committee and Advisory Board approval. 10. The Museum may accept items that do not fit into any of its three collections or under the Museum's Statement of Purpose, to be used by the Museum as functional items in its general operations. These items, such as library reference materials, office furniture and equipment, will not be accessioned into the Museum's collections, and may be disposed ofwithout restriction. 11, The Director or designated staff person shall write a personal letter to each donor, acknowledging gifts on behalf ofthe Museum. The Curator will submit a list of acquisitions to the Advisory Board annually, and to the Community Development Committee at their December meeting. Donations will also be acknowledged in the newsletter. In case of outstanding or valuable donations, the Director may notify the Advisory Board at the next regular meeting so that it may take appropriate action over and above the acknowledgement of the Director. The accession number shall appear on all correspondence relating to any accession, and a copy shall be placed in the accession file. V. Documentation and Care Procedures Accessioning is the formal process used to accept and record an artifact into the collection. 1. The originals of forms or bill of sale which prove the Museum's unqualified legal ownership of the items will be filed by donor's surname or source in the Accessions File by the Curator under the supervision of the Director. 2. All artifacts accepted into the Museum's collections will be documented from information received from the donor and, if necessary, through additional research conducted by the Museum staff. Each artifact shall be accessioned according to professional museum standards. 3, The Museum reserves the right to change the disposition of artifacts donated from the Permanent Collection to the Educational Collection or vice versa. This might be done if subsequently collected artifacts provide the Permanent Collection with higher quality representation, or if an educational artifact is later determined to have become more rare or unusual. Any change in the type of collection will be approved by the Collections Committee. Record of this transaction will be included in the artifact's permanent file. 4, Collections shall be available to the public for study and research in such a manner that their integrity and well-being will be best preserved. All artifacts shall be used and handled professionally during research, study, educational programs and exhibits. The Museum has a policy of changing the artifacts on exhibit in order to protect them from deterioration due to ultraviolet light, dust, and other hazards. The care and safety of collections will be the responsibility of the Curator and· the Director. Procedures to insure proper care and maintenance of the collections will be reviewed periodically by the Collections Committee. 5. Every effort will be made to protect the physical safety and confidentiality of the accession records. The originals will be created on archival paper and stored in a locked fireproof area. Duplicate copies will be stored off-site. VI. Loans and Borrowing Provisions 14. Estes Park Area Historical Museum Collections Management Policy Page 5 No loans, either Incoming or Outgoing, whether part of Permanent, Educational, or other related Collections, and including materials related to the storage, care, conservation, display, exhibition, or interpretation of any Collections artifact or artifacts may be used by any person, employee, volunteer, board member, or member of the public for personal gain or benefit. Incoming Loans: 1. The Estes Park Area Historical Museum may request the loan of specific artifacts or collections from private individuals, organizations or other institutions or museums for specific, temporary display purposes only. The Museum will accept only those items specifically requested and may not accept items on loan for repair, restoration, valuation, or storage. 2. All loans will be made for a specific time period, not to exceed one year; the Museum will not accept artifacts for indefinite loan. 3. Allloans will be insured by the EPAHM for the duration of the loan. Transportation to and from the lender will be paid by the Museum unless other arrangements are made. 4, Loan requests will be initiated by the Curator, with the approval of the Director, and the Collections Committee if necessary. Appropriate paperwork will be handled by the Curator, with an appropriate lender's signature secured on the loan form. 5. Condition reports will be prepared both upon receipt of the loan and upon its return. Deviations or damage to the loaned object will be noted, the lender notified and the insurance company contacted if necessary. 6. Artifacts left on loan and not claimed after the term of t:he loan has expired and written notification has been sent pursuant to Section 38-14-104, C.R.S., shall result in the loss of all rights of the lender in said property. Outgoing Loans: 1. Upon request, the Museum may make loans from its collections to other museums, cultural, historical, or educational institutions provided they meet the requirements for security, general care, use, insurance, transportation, packing and crating as established by the Estes Park Area Historical Museum. Loans will not be made to individuals. 2. Borrowing institutions shall be responsible for insurance and transportation. The Museum may require proof of insurance or of financial responsibility for the loan, and may charge packing and crating fees. The Curator will prepare appropriate paperwork, for the approval of the Director. 3. Loans may be made only for exhibit purposes. Loans for research, photography, advertising, or promotional purposes must be approved in advance by the Museum Director, and a fee may be charged. 4. Only those artifacts that are in satisfactory condition, and which will not suffer adverse effects 15. Estes Park Area Historical Museum Collections Management Policy Page 6 from travel or exhibition, will be recommended for loan. Condition reports will be required upon leaving the Museum, arriving and leaving the borrowing institution and upon return to the Museum. The Museum must be notified immediately of any damage. VII. Deaccessioning Rules No accessioned object or collection shall be removed from the Museum's register and physically disposed of except by strict conformity with the following rules. 1, Artifacts in the collection will be retained as long as they meet the mission of the Museum, and can be properly stored, preserved and interpreted. Artifacts which do not meet the mission of the Museum are liabilities and are subject to deaccessioning. Reasons for deaccessioning include: item lacks historical significance or relevance to the Estes Park area, is a duplicate or deteriorated, or was broken, stolen, or adequate storage space is not available, or othenvise found to be incompatible with the Museum's mission and policies. 2. Museum ownership of an artifact must be established before the artifact will be recommended for deaccessioning. Abandoned property such as non-receipted items, items not accepted by the Collections Committee and not reclaimed by donors or unclaimed loans, may be deaccessioned following the procedures outlined in the State of Colorado Abandoned Property legislation. 3, No donated object shall be deaccessioned for any reason for two years after the date of its acquisition, in order to comply with IRS regulations regarding the U.S. Tax Reform Act of 1984. 4, Artifacts in the collections will be deaccessioned upon the recommendation of the Collections Committee members with approval ofthe Advisory Board. 5. Deaccessioned artifacts may be transferred to the Educational Collection or donated, traded or sold to another tax-exempt institution where they will serve the purpose for which they were acquired by the Museum. Most appropriate placement will depend on the artifact. Preference will be given to placing deaccessioned artifacts in other museums, cultural, historical or educational institutions in the state of Colorado, Objects whose origins or historical significance is not within the state of Colorado will be offered to the state historical societies or other appropriate repositories in their home states, 6. It is the policy of the Estes Park Area Historical Museum to sell as little of its collection as possible. However, artifacts that cannot be placed in another tax exempt institution may be sold or traded in a manner that will best protect the interests, objectives and legal status of the Museum. The number of items to be sold shall be held to a minimum and may be sold discreetly out of the geographic area. 7. Artifacts for which no other disposition can be found will be appropriately disposed of, after removing collectable value from the object. Artifacts containing potentially hazardous materials will be disposed of in accordance with state regulations concerning those materials, 8. A collections fund shall be created to which all net proceeds resulting from deaccessioning are deposited, and from which, with Collections Committee approval, withdrawals are made only for collections purchases and conservation. 16. Estes Park Area Historical Museum Collections Management Policy Page 6 notification has been sent pursuant to Section 38-14-104, C.R.S., shall result in the loss of atl rights of the lender in said property. Outgoing Loans: 1. Upon request, the Museum may make loans from its collections to other museums, cultural, historica[, or educational institutions provided they meet the requirements for security, general care, use, insurance, transportation, packing and crating as established by the Estes Park Area Historical Museum. Loans will not be made to individuals. 2. Borrowing institutions shall be responsible for insurance and transportation. The Museum may require proof of insurance or of financial responsibility for the loan, and may charge packing and crating fees. The Curator will prepare appropriate paperwork, for the approval of the Director. 3. Loans may be made only for exhibit purposes. Loans for research, photography, advertising, or promotional purposes must be approved in advance by the Museum Director, and a fee may be charged. 4. Only those artifacts that are in satisfactory condition, and which will not suffer adverse effects from travel or exhibition, will be recommended for loan. Condition reports will be required upon leaving the Museum, arriving and leaving the borrowing institution and upon return to the Museum. The Museum must be notified immediately of any damage. VII. Deaccessioning Rules No accessioned object or collection shall be removed from the Museum's register and physically disposed of except by strict conformity with the following rules. 1. Artifacts in the collection will be retained as long as they meet the mission of the Museum, and can be properly stored, preserved and interpreted. Artifacts which do not meet the mission of the Museum are liabilities and are subject to deaccessioning. Reasons for deaccessioning include: item lacks historical significance or relevance to the Estes Park area, is a duplicate or deteriorated, or was broken, stolen, or adequate storage space is not available, or otherwise found to be incompatible with the Museum's mission and policies. 2. Museum ownership of an artifact must be established before the artifact will be recommended for deaccessioning. Abandoned property such as non-reipted items, items not accepted by the Collections Committee and not reclaimed by donors or unclaimed loans, may be deaccessioned following the procedures outlined in the State of Colorado Abandoned Property legislation. 3. No donated object shall be deaccessioned for any reason for two years after the date of its acquisition, in order to comply with IRS regulations regarding the U.S. Tax Reform Act of 1984. 4. Artifacts in the collections will be deaccessioned upon the recommendation of the '.7. Estes Park Area Historical Museum Collections Management Policy Page 7 9. An adequate record ofconditions and circumstances under which artifacts are deaccessioned and disposed of must be kept as part of the Museum's collections records. Lists of deaccessioned items will be reported to the Board and included in their meeting minutes. 10. No deaccessioned item may be conveyed in any manner to present or former members of the Museum Advisory Board, Collections Committee, Museum staff, Museum volunteers, interns, members of the Friends of the Museum Board, employees of the Town of Estes Park or to their representatives. VIII. Security and Insurance The Collections Committee will make recommendations of insurance coverage and limitations to the Town of Estes Park. The Committee will also approve means of determining insurance valuations and reviewing those valuations on a regular basis to keep them current. IX. Access and Disclosure Although the public must have reasonable access to the collection on a nondiscriminatory basis, the Museum assumes as a primary responsibility the safeguarding of its materials and therefore may regulate access to them.The Museum's collections are available to the public through the exhibits in the Museum buildings, and by appointment for materials held in storage. Access to storage areas and files is prohibited unless accompanied by a museum staff member. Photographs and artifacts held in the Museum's collections may be reproduced under established guidelines only. Many museum operations are a matter of public record and will be listed in the Museum newsletter as appropriate. X. Ethics The Estes Park Area Historical Museum staff, Friends and Advisory Board members, and volunteers abide by and operate under the current codes of ethics for museum professionals documented in "Museum Ethics" published by the American Association of Museums, the Association for State and Local History, and the statutes of other national and international organizations pertaining to museums. XI. Other Provisions Changes may be made to this policy from time to time on the recommendation of the Collections Committee, acting for the Advisory Board, and with the approval of the Trustees of the Town of Estes Park. 1 Y. The Stanley Park Fairgrounds operates on a seasonal basis under the direction of the Estes Park Special Events Depart- ment, Town of Estes Park. 2. Lease of any facility at the Fairgrounds is by contract between the user (tenant) and Stanley Park Fairgrdunds. 3. The Town charges for use of the facilities. Fees will be reviewed and adjusted as needed to reflect changes in operating costs. 4. It is the tenant's responsibility to be aware of and abide by all policies, rules, and regulations pertaining to use of the Fairgrounds. Rules are included in this policy. 5. Tenants are responsible for damages to the contracted facilities which occur during the contracted period and periods of set-up and take-down. 6. Major policy changes and capital improvements are reviewed by the Special Events Department and are subject to approval by the Town Board of Trustees. OPERATING PROCEDURES Booking Procedures All facilities are reserved on a first-come, first-serve basis. Prospective tenants must contact the Director of Fairgrounds to determine availability. An organization holding the same event on the same date for two consecutive years is recognized as having a "historical date". These dates will be automatically reserved each year for these users. The Fairgrounds does not guarantee anyone's historical dates to be the same each year, as dates periodically change due to placement of weekends within months of the year. The Fairgrounds calculates their annual calendar on a monthly basis, counting full weekends (Saturday and Sunday) within each month, with each weekend in the month counted from one to four. The signed contract and proper proof of insurance are due at least 30 days prior to the event. All signed contracts must provide the name and persons/organizations providing security and stall management. All events are subject to review by the Stanley Park Fairgrounds, Special Events Department, Estes Park Fire Department and Estes Park Police Department. All new users of the Fairgrounds are responsible for familiarizing themselves with requirements for use of the facilities. All users shall set-up an appointment for a walk-through of the grounds with the Fairgrounds Foreman at least 30 days prior to the event, said walk-through to take place at least one week prior to the date of the event. Aa. Payment of Fees A rental deposit may be required. All rental fees shall be payable at the end of the rental date agreed upon. An account unpaid after thirty (30) days shall be charged a finance charge of 1.5% per month, which is an annual percentage of 18%. Insurance Requirements All Fairgrounds users are required to provide the following insurance coverage: - A comprehensive general liability insurance policy with minimum limits of $150,000 bodily and personal injury for each person, with total liability for two or more persons injured in a single occurrence of $600,000; $100,000 property damage for each occurrence. - Liquor liability or broad form endorsement for any event where the contract permits alcoholic beverages. At least 30 days prior to the event, tenant shall provide certificate (s) of insurance to Special Events Department demonstrating that the aforementioned insurance requirements have been met and that such policy or policies will be in effect throughout the contracted period, and at such times before and after the contracted period as tenant may reasonably expect to be conducting activities within the area of the contracted facilities. These certificates of insurance shall indicate the Town of Estes Park as an additional named insured and also contain a valid provision or endorsement that these policies may not be canceled, terminated, changed or modified without at least 30 days written notice to the Town. Tenant Check-In/Check-Out Procedures All tenants are required to check-in at the Fairgrounds Office prior to setting up or otherwise using the contracted facilities. Keys will be checked-out to a responsible party at that time. Keys must be turned in to the Fairgrounds Office immediately following the event unless other arrangements are made prior to event. Tenants must report any damages/problems concerning the contracted facilities at this time. Tenants will be charged $25.00 for each set of keys not returned. 2-3. RULES FOR USE OF ALL FACILITIES 1. Tenant shall ensure that the signed rental agreement correctly states facility use and fee, time event is open to public, admission fees, etc. Events open to the public will be included on the marquee at the Fairgrounds and press releases to local newspapers and radio stations. 2. Tenant is responsible for damages to the facilities which occur during the event and periods of set-up and take-down. 3. Tenant is responsible for any fees/damages owed to the Fair- grounds by their sub-contractors. 4. Tenant is responsible for providing and supervising their own security. Tenant must let the Fairgrounds Office know before the event what and when security will be on grounds. 5. Parking control is mandatory and is the sole responsibility of the tenant. Tenant must provide the Fairgrounds Office with the name of the parking manager prior to the event. First-time parking managers will need to meet with the Fairgrounds Foreman to orient themselves to parking and non-parking areas before the start of the event. Failure to provide parking control will result in cancellation of future events. 6. No parking is allowed in fire lanes or where otherwise · posted "No Parking" . Any vehicle parked in a "No Parking" area will be towed at the owner's expense. Trailers and trucks are to be unloaded or loaded and removed to designated parking area as soon as possible. 7. There will be no parking on the track. Track must be kept open for fire lane and feed delivery. 8. RV camping is permitted at the RV campground areas only.. No tent camping is allowed on the Fairgrounds property. 9. All decorations/personal belongings must be removed immediately following the event. 10. All trash must be placed in proper containers. Glass beverage containers are prohibited on the Fairgrounds property. All barn areas are to be cleaned of trash, using the trash containers before leaving premises. 11. The responsible party or his/her designee must stay at the facilities until all exhibitors and spectators have left the premises. Failure to do so will result in cancellation of future reservations. 12. Fairgrounds maintenance staff are not responsible for any losses incurred with the use of vending machines. NO refunds will be given. 13. It is prohibited to clean vehicles/livestock trailers out onto Fairgrounds property. 14. All hypodermic needles, medical supplies, and/or veterinarian supplies must be disposed of in a safe and proper manner. 15. Fairgrounds Staff will only take directions from the responsible person noted on the contract or his/her designee. 16. Fire codes do not permit booths, vehicles, etc. to block fire lanes, exits, restrooms, storage units, etc. 14. 17. All dogs and other small animals must be on a leash and under the control of the owner or custodian of said animals at all times. The provisions of Chapter 7.12 of the Estes Park Municipal Code will apply to all dogs on the Estes Park Fairgrounds property. Estes Park Animal Control will periodically patrol the premises and have authorization to pick-up and retain any animal running at large at the owners expense. Any animal causing any problems will either be picked-up by the Animal Control Officer or the owner and animal will be asked to leave the premises immediately. 18. Operation of Town owned equipment is not permitted except by authorized Town personnel. 19. The Special Events Department reserves the right to deny any group or person access to the Fairgrounds. 20. The Special Events Department reserves the right to close any part of the Fairgrounds to public access. 21. All manure and bedding is to be placed in the center alley for removal in the old barn area and placed in designated area outside of new barns. NO manure or bedding is to be placed in trash barrels. Fairgrounds staff will scrape outside alleys at 8 am, noon and 8 pm. 23. When Horse Show Management asks for arena maintenance or watering ALL riders must exit the arena. Water trucks or tractors with equipment will NOT enter arena until arena is clear of riders. Trucks will have right of way on property. 24. All water hoses are to be rolled and stored when not in use. 25. Event Manager is asked to provide a "Request List" to the Fairgrounds Office two weeks prior to event. June 20, 1995 TENT RENTAL POLICY 1. Rent only to individuals when they are also renting the fairgrounds facility and only if local rental companies are unable to provide the tents needed. 2. Rent to local non-profits using Bond Park or fairgrounds and only if local rental companies are unable to providd the tents needed. 3. Rental fees should be competitive to that of local rental companies. 4. Tents be set-up only on Town property ie. fairgrounds, Bond Park, etc. 28. PARK USE PROCEDURES The use of Bond Park, Tregent Park.and Riverside Plaza (or any town owned land or parking lot) for an organized event is authorized by the Town of Estes Park Special Events Office. The following procedures must be followed. 1. Obtain, complete and return a Request Form from the Special Events Department 2 weeks prior to event. 2. The Request Form is routed to all departments for their approval. Special note is taken for special requests by the appropriate department. 3. If approved by all departments, a copy is sent to the applicant showing any restrictions. 4. The applicant is held to all use regulations as stated in the Park Use Regulations attached. 5. The Special Events Department is responsible for keeping in contact with the applicant, providing the proper information, answering questions, making sure all requirements are met including the receipt of an insurance policy with the Town of .4 Estes Park added as additional insured. Day of the event Special Events Department will monitor the event and grounds periodically. 2.9. 01/01/93 TOWN OF ESTES PARK PARK USE REGULATIONS PERMIT A Park Use Permit shall be required for all events held in Riverside Plaza, Bond Park and Tregent Park. Application shall be made to the Special Events Department at least two (2) weeks prior to the proposed event--Special Events Department, P. 0. Box 1967/Estes Park Fairgrounds, Estes Park, CO 80517, 586-6104. BOUNDARIES All activity shall be confined to the boundaries of the park and shall not block or impede the sidewalk or traveled area. This includes access to fire lanes and handicapped areas. A location map of all booths, stage, tents, signs, etc." must accompany the application for a Park Use Permit. SOUND LEVEL CONTROL The Special Events Department will have control of the sound level volume at all times, and the permittee will cooperate with said Department to achieve a satisfactory level. SIGNS The Special Events Department will have control of identification signs for all functions/performers. LITTER All litter shall be removed and disposed of by the permittee upon the conclusion of the event, including all fixed and temporary trash receptacles. Failure to do so will incur costs for the Permittee of up to $100.00. DAMAGES Damages incurred by the Town shall be the responsibility of the permittee. 1 3G SALES AND LICENSES Sales of goods and/or services are only permitted for events sponsored by a local, non-profit organization. No solicitation or free-will offerings of any kind shall be permitted. IRRIGATION Requests that grass areas not be watered prior to and during an event is contingent upon approval of the Parks Department. SPECIAL REOUIREMENTS FOR BOND PARK 1. Stakes will not be driven except in so,designated areas. 2. Refer to the attached drawing and contact the Parks Department for assistance in determining where placement of stakes will be allowed; assistance. does not include installation. 3. Foot traffic Will be routed on established gravel wdlkways. INSURANCE REOUIREMENTS 1. General Liability: A Certificate of Insurance in the amount of $600,000 is required. The certificate will indicate either bodily injury or property damage in the amount of $600,000, or bodily injury and property damage combined in the amount of $600,000. 2. Liquor: If an event is to have liquor served , the insurance certificate will include "host liquor liability coverage."A "Special Events" Liquor Permit and " liquor legal liability coverage" will be required. 3. Town Facilities: If the event is to use Town facilities which will be under the control of the participants, not the Town, the coverage will include "all risks legal liability." 4. Minor Injuries: In order to provide no-fault coverage for minor injuries, "premises medical coverage" will be required which provides $1,000 worth of medical coverage without regard to liability. 5. In the event the certificate indicates that a broad form comprehensive general liability endorsement is part of the policy, all the aforementioned coverages will be 2 3 1. contained therein. 6. Automobile Liability: Bodily injury, per person, $600,000 and property damage $600,000; or bodily injury and property damage combined $600,000; "garage keepers liability" will be provided where automobiles will be parked on Town property. This coverage will provide coverage for damages to said vehicles. 7. Excess Liability: An "umbrella" of $1,000,000 over and above the primary coverages is required. The Town of Estes Park will be named as an "additional insured" on all the policies. The parties will be required to provide the Town with a copy of the endorsement naming the Town as an additional insured prior to the event. The Finance Department will administer all insurance certificates. Participants required to submit an insurance certificate must do so at least two (2) weeks prior to the event. INSURANCE WAIVER Some events may not be subject to established insurance requirements, to be at the discretion of the Special Events and Finance Departments. 3 31 ENTERTAINMENT PERMIT This Entertainment Permit is subject to all Park Use Regulations with the following exceptions: 1. Person or persons taking responsibility for the entertainment will: A. Fill out Park Use Application B. Jury the entertainers and take responsibility for their quality and character. C. Schedule the entertainers with the Special Events Department 14 days prior to performance (to include date, time starting, time ending, location and type of entertainment). Final decision on entertainers would be with the Special Events Department. D. If complaints are received, for any reason, they will be the applicant's responsibility to to address. 2. Any performance which consists of dangerous acts, performance above ground, jugglers, etc. will be required to furnish evidence of insurance with the Town of Estes Park as additionally insured. Performers such as musicians, story tellers, singers will be required to sign a waiver agreement. 3. No sale of goods or merchandise is permitted. 4. Amplification will be restricted to below 750 Watts. Sound is not to travel further than 50 yards. 5. Entertainers will be required to prominently display signage stating the performance·is "an approved event by the Town of Estes Park". 6. Gratuities would be permitted, if asked for discretely. 7. Banner Location #2 - In the right-of-way area west of the Highway 34/36 Intersection (30' x 3'). Banner Location #3 - On the north face of the Chamber of Commerce Building (4' x 8' maximum). This site shall be terminated when Location #1 is made available. The Special Events Dept. will sanction banners for approved Estes Valley events. REGULATIONS. 1. Banners will be installed, free-of-charge, by the Special Events Department, with the Dept. furnishing sufficient rope and fasteners. 2. The reauest to display banners must be submitted to the Town's Special Events Director at least 30 days prior to the proposed event. 3. Banners for Town-sponsored events will be given first priority. 4. Established, annual events will be given first priority of their choice of banner location. If event sponsors desire to advertise the event at two locations, and the other banner site is available, they may do so. 5. Banners may be "double-sided" at the discretion of the event organizer. 6. Banners may not be installed more than 14 days prior to the scheduled event, and will be removed thereafter. 7. The Special Events Director may refuse the use of a banner, and/or may attach any conditions deemed necessary regarding the use of banners. 8. Event sponsor names are acceptable. 44. 4 9. Should the banner become damaged during display, it will be immediately removed by the Special Events Department. 10. Banners with camp aign or commercial advertising will not be accepted. 11. SPECIFICATIONS. 1. For Banner Location #1, banners may not exceed a maximum of 20' x 3', or be at the discretion of the Special Events Director. 2. For Banner Location #2, banners shall be 30' x 3'. 3. For Banner Location #3, banners may not exceed a maximum of 4' x 8', or be at the discretion of the Special Events Director. 4. Grommets shall be "heavy duty", a minimum of 5/8" ID, no more than 12" apart along the top edge, and no more than 24" apart along the bottom edge. Reinforced 5/8" ID grommets shall also be installed in the four corner edges of all banners. 5. To preclude standard lettering on a solid background, all banners shall include an artistic expression(s). 6. Solid banners are preferred, however, wind-slotted banners will be accepted. 7. Event sponsors should consult banner suppliers to ascertain materials best- suited for their banner application. 8. The Town of Estes Park will not be held responsible for any damages due to wind and/or other causes, including installation, and the like. 2 45. LIGHT POLE FLAGS - Rules: 1. The sponsoring organization for the proposed use must be a local, non-profit organization. 2. The request to display flags must be submitted to the Special Events Department at least 30 days prior to the proposed event. 3. Arrangements for installation and removal should be made through the Special Events Office. The second party shall furnish a show manager, judges, paddock and arena personnel without expense to first patty. The first party shall provide fof the use of the second pam grandstands, water and clecnicity, a public address system complete with microphone, amplifiers and lights for all night performances in Arena A, without expense to second party except as herein provided.
