This is a petition for a variance of the Zoning Ordinance. It must be on file at the office of the Building Inspector, Town of Estes Park; 10 days before any meeting of the Board of Adjustment. A $25.00 (twenty-five dollar) fee to cover costs of processing appeals and requests for variances shall be paid to the Town Clerk prior to any hearing. The Petitioner or Representive should be present at the meeting. All variances granted by the Board of Adjustment shall become null and void if a building permit has not been issued and paid for and work thereunder commenced within four months from the date the variance was granted. Durward re- questing a continuation of the hearing regarding his off-street parking variance request. Member Palmer moved the hearing be continued to May 10, 1978. Member Herzog seconded the motion and it passed unanimously.. BROWN - SIDEWALK STRUCTURE IN SETBACK - 205 PARK LANE: Bill Van Horn, on behalf of petitioners Ross and Gary Brown, requested to install an elevated sidewalk into the 8' setback from Virginia Drive. The 8' wide precast, prestressed twin-T walkway would extend 24' from the second story of the building at 205 Park Lane (formerly known as "Prospect Inn") to Virginia Drive. Because it is elevated, the side- walk could be interpreted to be a structure which would then require a variance to allow it to extend into the 8' setback required in C-1 Com- mercial zones. The portion of the sidewalk extending into the setback would be the same grade as Virginia Drive and the proposed railing and post would not extend into the setback. Member Sager moved the variance be granted allowing the elevated side- walk to extend into the 8' setback provided it does not interfere with any future sidewalk in the setback. Should it interfere or require an adjustment, it will be the property owner's responsibility to change it at his own expense. Member Palmer seconded the motion and it passed by the following votes: Those voting "Yes" Members Sager, Herzog, Palmer, Sutter. Those voting "No" none.
