This is a petition for a variance of the Zoning Ordinance. It must be on file at the office of the Building Inspector, Town of Estes Park; 10 days before any meeting of the Board of Adjustment. A $25.00 (twenty-five dollar) fee to cover costs of processing appeals and requests for variances shall be paid to the Town Clerk prior to any hearing. The Petitioner or Representative should be present at the meeting. All variances granted by the Board of Adjustment shall become null and void if a building permit has not been issued and paid for and work thereunder commenced within four months from the date the variance was granted. RECORD OF PROCEEDINGS Board of Adjustment January 16, 1987 Board: Attending: Also Attending: Absent: Chairman Laing, Members Brown, Habecker, Lamson, and Sager Chairman Laing, Members Sager Planner Stamey, Building Allman, Secretary Jones Members Brown, Lamson Habecker, Inspector RICHARD & KATHLEEN HANNIGAN - 1787-1799 OLYMPIAN LANE, VARIANCE TO SECTION 17.20.040, 2.a. - SETBACKS Mr. Richard Hannigan appeared before the board requesting a variance for Lot 5, Block 5, 1st Addition, Lone Pine Acres, to allow a 10' side and rear setback instead of the 25' setback presently required under the new zoning regulations. He stated that by using 10' side and rear setbacks, 15 feet of area is possible adjacent to each building along each side of the center driveway and more green space would be available. Mr. Hannigan also stated that landscaping would be installed along the south property line. Correspondence was received from Cheryl Danielson, owner of Lot 2, indicating no objection to the variance request. Byron & Ruby Dobbins, adjacent property owners, spoke in opposition to the variance request. They felt they would be directly affected if the 25' setback is reduced to 13'. They were concerned about the density of the proposed development and also were concerned that dumpsters, trailers, etc. would be placed in this setback area. Member Habecker suggested that possibly a 15' setback would better position the units adjacent to the Dobbins' lot and moved that this variance request be allowed with the condition that the building setback along Lot 1 be a minimum of 15'. Member Sager seconded the motion and it passed unanamously.
