The BOARD OF ADJUSTMENT meets at 8:00 a.m. on the first Tuesday of each month (as needed), in the
Board Room (Room 130) of the Municipal Building.
This is a petition for a variance of the zoning ordinance. It must be on file at the Community Development Office
(Room 210), Town of Estes Park, twenty-one (21) days prior to the Board of Adjustment meeting. A $50 fee to
cover cost of processing appeals and requests for variances shall accompany the application. Checks should be
made payable to TOWN OF ES'1'LS PARK.
All variances granted by the Board of Adjustment shall become null and void if a Building Permit has not been
issued and paid for, and work thereunder commenced within four (4) months from the date the variance is granted.
It is understood that only those points specifically mentioned are affected by action taken on this appeal. The
Petitioner or Representative should be present at the Board of Adjustment meeting.
Your Application must include a Statement of Intent, 12 copies of a Site Plan, drawn at a scale of 1" = 20',
1 reduced copy (11"x17") that includes the following: Property lines with dimensions, all structures, trees,
rock outcroppings on the lot, topography, edge of street traveled way, adjacent structures within 100' of the
lot boundaries, and any other pertinent information.

We are requesting from 'the Board of Adjustment a variance from Section l7.20.040,
8, l, b which requires e ten -foot setback from the side (north) property line
of Lot 12' Block 7, Country Club Manor. This will allow oonatruot1on of : deok
with a setback of live feet from Raid property line.
It is our intention to build u omulI deoh (8 feet by 16 feet) on the north otdr
of our property and sale residence (621 Landers Street). This deck will be
located on the upper level of our hi -level houae/ 8 feet above the ground.
We own both Lot 12 (nu whiuh the residence is built) and Lot 11. We have donated
a oonaervation easement covering both lots to Eaton Volley Land Trust. This
easement prohibits any new building on Lot 11. The easement ellnwa only
continuing upkeep and possible enlargement of the existing family reR1denoe for
Lot 12. (?he Estes Valley Land Trust has sent the easement to he re"orded; the
?rust will be happy to forward to the Town a copy of this easement.)
We seek a varianoe to the oethacb requirements, rather than a ohonye oI the
property line, because it is the most simple solution to the 7ovo'a zoning
regoiremeuQ and to our own needs. Additionally, beuenae the use of the property
is uooircummoribed by the oonaervatiuo easement, e variance nill pose :o yroblem
in any future plzno for the pro9ertieo.

I. SITE DATA
Existing Zoning: RM - Residential Multi -family
Existing Land Use: Single Family Residence (Lot 12) and Vacant (Lot 11)
II. PROJECT DESCRIPTION
The applicant is requesting a sideline setback reduction from ten feet to five feet for a
new deck on an existing home.
III. PROJECT REVIEW
The applicant owns the adjacent lot to the north, so it would be possible to avoid this
variance request by amending the plat and moving the property line so that the new deck
conforms with the required setback. The applicant is dedicating a conservation easement
on the adjoining lot and is taking the position that this easement will be an adequate
substitute for relocation of the lot line.
V. STAFF RECOMIlVIENDATION
A motion for approval should include the following condition:
1. The conservation easement shall be dedicated and recorded on Lot 11 prior to
granting this variance request. This easement shall prevent any future improvements on
Lot 11.
