The BOARD OF ADJUSTMENT meets at 9:00 A.M. on the first Wednesday of each
month (as needed), in the Board Room (Room 103) of the Municipal Building.
This is a petition for a variance of the zoning ordinance. It must be on
file at the office of the Building Official, Town of Estes Park, twenty-
one (21) days prior to the Board of Adjustment meeting.
A Fifty Dollar ($50.00) fee to cover cost of processing appeals and
requests for variances shall accompany the application. Checks should be
made payable to TOWN OF ESTES PARK.
All variances granted by the Board of Adjustment shall become null and void
if a building permit has not been issued and paid for, and work thereunder
commenced within four months from the date the variance is granted.
It is understood that only those points specifically mentioned are affected
by action taken on this appeal.
The Petitioner or Representative should be present at the Board of
Adjustment meeting.

II. PROJECT DESCRIPTION
Applicant is constructing a new convenience store, restaurant
and gas station. As part of this construction, new parking is
being constructed to the south of this building. Due to the
grade change, an opportunity exists to create a lower level
below the parking surface. The parking area would be a deck,
and serve as the roof for the lower space.
Section 17.20.040 B.b requires a 15' sideyard setback.

The lower level and elevated deck are structures, and are
required to meet this setback.
There is a small encroachment at the NW corner. There is a
fairly significant encroachment along the east lot line.
In a separate, but related request, Applicant has submitted an
Amended Plat to adjust the lot lines between these two lots.
III. STAFF RECOMMENDATION
It is Staff's opinion that the Application materials submitted
have not addressed Section 17.36.010, D.1.b, which sets forth
conditions upon which a variance may be granted.
1. Approval of the setback variance at the NW corner.
2. Denial of the setback variance along the east lot line.
The Applicant is advised to modify the eastern lot line
with the Amended Plat, to allow for a 15' setback.
