NOTICE OF APPEAL

Address all communications to the Building Inspector, Post Office Box 1200, Estes Park,
Colorado 80517.
This is a petition for a variance of the zoning ordinance. It must be on file at the
office of the Building Inspector, Town of Estes Park, 10 days before any meeting of the
Board of Adjustment.
A $25.00.(twenty-five dollar) fee to cover costs of processing appeals and requests for
variances shall be paid to the Town Clerk prior to any hearing.
The Petitioner or Representative should be present at the meeting.
All variances granted by the Board of Adjustment shall become null and void if a build-
ing permit has not been issued and paid for and work thereunder commenced within four
months from the date the variance was granted.

SESSIONS - ALTERATION OF A NONCONFORMING BLDG.:
Mr. Bill Van Horn, representing the owners, appeared to request
a variance to allow the structural modification of a nonconfoiiuing
building, the former Gypsy Baron Restaurant, Tract 11, Beaver Point
Addition. (Section 17.68.070). The height of the building is
presently 341/2 feet high which exceeds the Town's Building Code
limitation by 41/2 feet. Mr. Van Horn explained that the building
was constructed under the County Building Codes and they do not
have a height limitation. The owner of the property is requesting
the opportunity to modify an already existing nonconforming building.
The following letters in favor of the use of the structure were
received as follows:

Member Al Sager stated that these letters regarding "use" of the
structure were irrelevant to the Board of Adjustment's decision.
Chairman Robert Wagner recognized Curt Thompson and Gene Oliver
who spoke in opposition to the use of the structure. Member Richard
Wood stated that the Board of Adjustment's sole issue was whether
the building could be altered and on that basis he moved for approval
of the variance. Member Al Sager seconded the motion and it passed
unanimously.
There being no further business, the meeting adjourned.
