RE: Prospect Avenue Reconstruction — Request to Accept Permanent and
Temporary Easements
I
Background:
As this road construction project moves forward, additional temporary and permanent
easements are required from residents affected by the reconstruction.
Cornerstone Engineering and Surveying have designed and drafted the attached
easements, signed and attested by the property owners, which include:
PERMANENT EASEMENTS:
An access, utility, and drainage access easement for construction and maintenance has
been dedicated to the Town by 401 Elm LLC for the property located at 401 Elm
Avenue.
An access, utility, and drainage access easement for construction and maintenance has
been dedicated to the Town by 411 Elm LLC for the property located at 411 Elm
Avenue.
An access, utility, and drainage access easement for construction and maintenance has
been dedicated to the Town by 408 Fir LCC for the property located at 408 Fir Avenue.
A construction and maintenance of underground electric, telephone, fiber optics and
cable has been dedicated to the Town by Elley Family Partners, LLC for the property
located at 880 Comanche Street.
TEMPORARY EASEMENTS:
A construction easement has been dedicated to the Town by 401 Elm LLC for the
property located at 401 Elm Avenue.

A construction easement has been dedicated to the Town by 411 Elm LLC for the
property located at 411 Elm Avenue.
A construction easement has been dedicated to the Town by 408 Fir LLC for the
property located at 408 Fir Avenue.
An easement for the undergrounding of overhead utilities has been dedicated to the
Town by Elley Family Partners, LLC for the property located at 830 Elm Avenue.
An easement for the undergrounding of overhead utilities has been dedicated to the
Town by Elley Family Partners, LLC for the property located at 880 Elm Avenue.

Recommendation:
The Public Works Committee recommends acceptance of the attached permanent and
temporary easements to the Town Board, to be included on the Consent Agenda at the
February 9, 2010 Town Board Meeting.

EASEMENT FOR ACCESS, UTILITY AND DRAINAGE
RECEIVED OF THE TOWN OF ESTES PARK, COLORADO, the sum of 1.00 Dollar, in
consideration of which 401 Elm LLC, hereby grants unto said Town, its successors and assigns, a
permanent easement to construct, operate and maintain access, utility and drainage for the use of
the public across land situated in Estes Park, Larimer County, Colorado and more particularly
described as follows:
PERMANENT EASEMENT FOR ACCESS, UTILITIES AND DRAINAGE STRUCTURES
CONSTRUCTION AND MAINTENANCE
A permanent easement for access, utility and drainage structures, located on a parcel of land as
described as being located in Tract 1, Deats Resubdivision of Lots 1,2, and 3, Block 1, Country
Club Manor Addition. Town of Estes Park, in the Northwest 1/4 of the Southwest 1/ of Section 30,
Township 5 North, Range 72 West of the 6tb P.M., the County of Larimer, State of Colorado and
being more particularly described as follows:
Considering the North line of Block 1 of said Country Club Manor Addition to the Town of
Estes Park as bearing S 89°11'00"E and all bearings being relative thereto:
COMMENCING at the northwest corner of said Tract 1;
Thence along the northerly property line South 89°11'00" East a distance of 10.88 feet, said
point being the TRUE POINT OF BEGINNING;
Thence along the northerly property line, South 89°11'00" East a distance of 17.67 feet;
Thence leaving said northerly property line along the arc of a curve to the left (radius of said
arc being 50.00 feet, chord of said arc bears South 50°50'12" West a distance of 31.87 feet) a
distance of 32.44 feet;
Thence parallel to and 4-feet from the western property line, South 00°27'00" West a distance
of 59.49 feet to a point on the southern property line;
Thence along said southern property line North 89°11'00" West a distance of 4.00 feet to the
southwest corner of said tract 1;
Thence along said westerly property line North 00°27'00" East a distance of 70.90 feet;
Thence along the arc of a curve to the right (radius of said arc being 10.00 feet, chord of said arc
bears North 50°46'07" East a distance of 14.14 feet) a distance of 15.71 feet more or less to the
TRUE POINT OF BEGINNING.
The above described parcel contains 495 square feet, more or less.

Upon the terms and conditions hereinafter set forth:
1. The terms of said easement shall be perpetual.
2. 401 Elm LLC reserves the right to cultivate, use and occupy said premises for any purposes
consistent with the rights and privileges above granted. In case of the permanent
abandonment of said easement, all right, title, and interest herein granted shall end, cease
and terminate.
3. 401 Elm LLC by grant of the foregoing easement does not assume any responsibility for the
construction, operation, and maintenance of the access, utility and drainage structure or
liability for damages of any nature arising directly or indirectly from the construction,
operation, maintenance, and use of the sidewalk herein provided.
4. Town of Estes Park agrees to install signing that would limit parallel parking along Fir
Avenue, adjacent to 411 Elm, 408 Fir and 401 Elm for the use of the adjoining tenants. The
signing is to include wording such that violators will be towed at the violator's expense.

FIBER OPTICS AND CABLE
RECEIVED OF THE TOWN OF ESTES PARK, COLORADO, the sum of 1.00 Dollar, in
consideration of which Elley Family Partners, LLC, hereby grants unto said Town, its successors
and assigns, a permanent easement to construct, operate and maintain underground electric,
telephone, fiber optics and cable utilities, including structures associated therewith, for the use of
the public across land situated in Estes Park, Larimer County, Colorado and more particularly
described as follows:
PERMANENT EASEMENT CONSTRUCTION AND MAINTENANCE OF UNDERGROUND
ELECTRIC, TELEPHONE, FIBER OPTICS AND CABLE
Located on a portion Lots 16 and 17, Amended Plat of Thomas Resubdivision of a part of Lot 41,
Little Prospect Mountain Addition to the Town of Estes Park, Colorado, located in the Southwest
1/4 of the Northwest 1/4 of Section 30, T5N, R72W, 6th p.m. Being more particularly described as
follows:
Considering the south line of said Lot 16, Amended Plat of Thomas Resubdivision of a part of lot
41, Little Prospect Mountain Addition to the Town of Estes Park, Colorado, bears South 89°11'00"
East, with all bearings relative thereto:
Lot 16
The southern 10-feet of said Lot 16, Amended Plat of Thomas Resubdivision. Said easement
containing 500 square feet more or less.
Lot 17
COMMENCING at the south east corner of said Lot 17, Amended Plat of Thomas Resubdivision,
said point being the TRUE POINT OF BEGINNING; thence along the easterly property line of
said Lot 17, North 00°59'27" East a distance of 10 feet; thence leaving said easterly property line,
North 89°11'00" West a distance of 9.74 feet to a point on the westerly property line of said Lot
17, thence along said westerly property line, South 43°20'00" East a distance of 13.94 feet more or
less to the true point of beginning. Said easement containing 49 square feet more or less,
(See attached Exhibit 'A')
Upon the terms and conditions hereinafter set forth:
1. The terms of said easement shall be perpetual.
2. Elley Family Partners, LLC reserves the right to cultivate, use and occupy said premises for
any purposes consistent with the rights and privileges above granted. In case of the
permanent abandonment of said easement, all right, title, and interest herein granted shall
end, cease and terminate.

3. Elley Family Partners, LLC by grant of the foregoing easement does not assume any
responsibility for the construction, operation, and maintenance of mentioned utilities or
liability for damages of any nature arising directly or indirectly from the construction,
operation, maintenance, and use of the said utilities herein provided.
4. Town of Estes Park in consideration of the easement, agrees to replace the existing power
pole located on Lot 1, Elley Subdivision with a either a steel or concrete pole and remove
the existing guy wires and guy anchors located outside of the easement area.

1401 Elm LLC (OWNERS), does hereby grant a Temporary Construction Easement to the Town
of Estes Park and its employees, consultants and contractors permission to enter the property
described below and grants the exclusive rights to perforiii construction activities necessary for the
reconstruction of Prospect Avenue and adjoining side streets, including the removal of existing
asphalt, adding additional parking stales off of Elm Ave. with concrete sidewalks, removal of
existing asphalt parking off of Prospect Ave./Fir Ave. and that the parties agree as follows:
The temporary construction easement is described as follows: located at 401 Elm Avenue, on a
Portion of Tract 1, Deats Resubdivision of Lots 1,2, and 3, Block 1, Country Club Manor
Addition. Town of Estes Park, in the Northwest 1/4 of the Southwest 1/4 of Section 30, Township
5 North, Range 72 West of the 6th P.M., the County of Larimer, State of Colorado and being more
particularly described as follows:
Considering the North line of Block 5 of said Country Club Manor Addition to the Town of
Estes Park as bearing S 89°11'00"E and all bearings being relative thereto:
The eastern 28.00 feet of said Tract 1
The above described parcel contains 2216 square feet, more or less.
Together with:
The western 25.00 feet of said Tract 1
The above described parcel contains 1979 square feet, more or less.

The Owner also grants to the Town, its successors, assigns, agents, contractors, and employees the

following condition of entry:
1. DAMAGE TO PROPERTY: Shall exercise care to avoid damaging the property in any
manner not consistent with the purpose for which this agreement is issued.
2. COOPERATION WITH OWNER: Shall at all times cooperate with owner(s) and
comply with reasonable requests not inconsistent with the purpose for which this
agreement is issued.
3. CLEANUP: Shall spread material uniformly over the construction site, seed and
fertilize. Upon completion of the existing asphalt removal, shall clean all the ground
occupied of all rubbish, excess material, temporary structures and equipment.

THIS EASEMENT is made this /Lday of W 2010 by and between Elley Family
Partners, LLC as owners of 830 Comanche Street, Estes Parc, Colorado (hereinafter referred to
as "Grantor"), successors and assigns, and Town of Estes Park, Colorado, a municipal
corporation (hereinafter referred to as "Town").
The Grantor hereby grants unto said Town, its successors and assigns, a temporary access
easement for the replacement of overhead utility services, the right to enter upon the said
property hereinafter described for replacement of overhead utilities within the permanent utility
easement located on the described property, located in the Town of Estes Park, County of
Larimer, State of Colorado, to wit:

A temporary access easement for replacement of overhead utilities in the Southwest '/ of
the Northwest 1% of Section 30, Township 5 North, Range 72 West of the 6th P.M. on
property described as Lot 1, Elley Subdivision, A Resubdivision of Lots 13, 14 & 15,
Thomas Resubdivision, Town of Estes Park, County of Larimer, State of Colorado.
Together, with the right to enter upon said property (excluding the months of April through
September), to access the existing Utilities Easement for the replacement of the existing power
pole and overhead utility lines. No work will be allowed between the months of April through
September without special coordination with the tenant to minimize disturbance to the business.
The easement rights herein granted shall terminate December 29, 2010, or upon completed
installation of the overhead utility services, whichever is sooner.
The work will consist of removal and replacement of the existing power pole with a steel or
concrete pole, removal of the existing guy wires and anchors. Boring and construction of a new
concrete pier within the easement and replacement of existing overhead utility lines. The work
on the said overhead utility services shall be done with care, and all damage to any
improvements on said property caused thereby shall be restored to preconstruction conditions at
the expense of the Town.
The tenants of 830 Comanche Street will be notified two (2) weeks prior to beginning
construction to allow for coordination.

installation of the underground utility services, whichever is sooner.
The work on the said underground utility services shall be done with care, and all damage to any

The tenants of 880 Comanche Street will be notified two (2) weeks prior to beginning
construction, to bring in drivers. The tenants will also be allowed to park busses at the Stanley
Park Fair Grounds during installation of the underground utilities, to allow workers access to the
site.

RE: 2009 Master Drainage Plan:
Prospect Mountain Southeast and Elm Road Industrial Area.
Background: There has only been one prior stormdrain study in 1985 which
addressed approximately 485 Acres (approximately 11% the size of Town). As a result,
two large capital projects were constructed in the North East quadrant in 1986-7 (see
Exhibit A - map).
Staff studied two problem areas due to frequent flooding and private property damage,
and storm water quality concerns. The current Southeast quadrant study area is
approximately 2,150 acres and the Elm Road industrial area, an additional 170 acres.
Total study area is 2320 acres (approx. 50% the size of Town). Exhibit B (2 maps)
represents the suggested improvements in a small portion of the study area.
RG Consulting Engineers, of Denver were the successful consultant following an
extensive RFP process.
The extensive and thorough report was completed in late 2009. These studies identify
problem areas and water quality issues. The study makes recommendations to solve
these issues, and approximate costs associated with the solutions.
• The total cost of proposed improvements within the Prospect Mountain SE area
quadrant is $8,314,966. (see Exhibit C)
• The total cost of proposed improvements within the Elm Road industrial area is
$1,529,893. (see Exhibit D)
Budget: the budget for the Drainage Study was $50,000 (204 — 5400-544.22-02);
total completed cost of the Master Plan study was $48,945.30

RE: CDOT Signal Conduit and Controller Upgrade
Backwmumd:
The Colorado Department of Transportation has been steadily working with PW staff to improve
downtown traffic flow and maximize all available options.
In 2006. [|I]OT [8CODGtR]Ct8d Highway 34 /bvneGs\ as 8 C08t of approximately $2.8'OliUiOO and
the intersection of 34/36 and upgraded that signal system to video detection.
In 2008. CDOTcollaborated with the Town UD the iDte[G8CtiOO realignment at Riverside [)hVe
and BkhOOl Ave. and C}[)OT provided $100,000 in signal upgrades. That work included
replacing the signal system with video detection and 2 new poles and mast arms.
This year they plan to upgrade the iDt8nG8OdOO Of PW0[GiO8 Ave. and BhhO[D AV8DU8. The
CU[ReOt G\gD8|S are limited in their phasing due to the COU8pSRd UDd9FgnDUDd conduit and DO
n3ODl for new wiring. Three legs Of the iRtRnS8{tiOO DlUSt be trenched for this iOSt8U@tiOD.
P8deSt[\8O DlOV8nO8OtG will be modified in @CCO[d8DC8 with O8tiOR8| St8Od8[dG of practice.
Pedestrians will cross with traffic flow which is the standard throughout the country. The project
will also F8\UC@tB the SigO8| cabinet from the SW corner to the NE C0[D8[ of the intersection. The
TOVVD will receive new H/C [8DlpS with 'dome tiles'on three of the four corners.
The project is slated to take 20 days and happen between early March and late April, 2010.
Lane C|OGUFeS will be phased. L8D8S will be C|OGed for Ol8XinUU[D of two days for each phase.
Detours are planned iOdowntown (see Exhibit A,page 10-19Of20.8Sreference OD|y).

Prospect Avenue Bypass Reconstruction
Background: This project is a priority on the Capital Improvement Plan and 3 years of
funding were combined to reconstruct a half -mile of collector street from Stanley
Avenue west to Ouray Drive (which is located west of the Hospital). The design has
been completed by Cornerstone Engineering & Surveying of Estes Park (see Exhibit 1).
The project will improve the alignment and function of the Stanley Ave./Prospect Ave.
intersection, replace and improve the stormdrain system with all new inlets on the steep
'hill streets', add curb/gutter to both sides, and a 6' pedestrian sidewalk to the south
side. There will also be intersection improvements to 5 adjacent streets and a reduction
of on -street parking along the Fir Avenue section. In addition, the entire 2300' section
will be repaved.
A detour will route all traffic onto High Street during construction.
The project will be out to bid on February 1, 2010, and a bid opening is planned for
February 18th.
Construction is planned for March 15 to May 27, 2010.
Light & Power bid out and hired A-1 excavating of Estes Park and is currently installing
underground conduit along the entire project length. That work is approximately 30%
complete.
Budget: The engineers estimate for the project is approximately $800,000
