LOCATION: The site is located at 521 Lone Pine Drive, within the Town of Estes Park. APPLICANT/OWNER: Russ Bartz (Professional Support Services, Inc., Loveland), Talking Teddy (Steve Swickard) STAFF CONTACT: Dave Shirk APPLICABLE LAND USE CODE: Estes Valley Development Code DISCUSSION: This is a request by Russ Bartz of Professional Support Services, Inc, a catering company out of Loveland. Mr. Bartz intends to provide outdoor food service, consisting of hot dogs, chips, and soda, on Saturday, June 14, 2003 in the parking lot of The Arc of Estes. Mr. Bartz is to provide this service in conjunction with The Arc’s “talking teddy” activities. This is a one-day event, to be set up that morning, and all equipment removed no later than the following day, Sunday June 15. As of Tuesday, June 10, 2003, Professional Support Services, Inc., has not received a business license to operate within the Town of Estes Park, and must do so prior to Saturday. Failure to obtain a business would be in violation of the Municipal Code, resulting in citation to Municipal Court. REVIEW CRITERIA: Pursuant to Section 3.11 “Temporary Uses and Structures”, subsection C, the following standards for review shall apply: 1. The proposed site is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic that such temporary use will or could reasonably generate; Staff Comment: The site is located at the corner of Lone Pine Drive and Big Thompson Avenue (US Hwy 34). This is a commercial neighborhood; the additional traffic should have no impact. 3. Adequate parking to accommodate vehicular traffic to be generated by such use will be available either on-site or at alternate locations; and Staff Comment: The applicant will use the parking already available on –site, and has arranged with the Inn at Estes for any overflow parking. The submitted site plan shows the kiosk to be set up in existing parking spaces. This should be relocated to an area that is not in a parking space. This will help ensure adequate parking, and will minimize pedestrian/vehicle conflicts. The kiosk should be set up in the area in front of the garage opening of the main building. 4. The operation of the requested use at the location proposed and within the time period specified will not jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare. Kiosk Location Portable Toilets Page #3 – “The Arc” Temporary Outdoor Food Service Staff Comment: The proposed timeframe is to set up on the morning of Saturday, June 14, operate during normal operating hours, and remove the kiosk and portable restrooms on Sunday, June 15. STAFF DETERMINATION: Staff has APPROVED this request CONDITIONAL TO: 1. The applicant shall obtain a business license for the Town of Estes Park. 2. No equipment set up shall occur before 7:00 AM, Saturday June 14, 2003. The portable toilets may be set up after noon on Friday, June 13, 2003. 3. All equipment, including portable toilets, shall be removed from the site no later than noon on Monday, June 16, 2003. 4. All food sales shall occur on Saturday-Sunday, June 14-15, 2003, and shall not occur before 8:00 AM or after 8:00 PM. 5. The food kiosk and portable restrooms shall be located as indicated in the above diagram, and shall not occupy any parking space. 6. This temporary use permit does not include the use of any outdoor display such as balloons and/or banners.
