THIS GRANTOF UTILITY EASEMENT is made this r t day of d a,s1-; 2022, by and between Cynthia
Fleischer (Grantor), whose address is 770 Larkspur Road with legal description of Lot 21, Division 7, High
Drive Heights Subdivision Estes Park, Colorado, and George D. Kent and Louise A. Kent (Grantee), whose
address is 709 Columbine Drive, with legal description of Lots 2 and 3, Division 7, High Drive Heights
Subdivision Estes Park, Colorado.
WITNESSETH
For good and valuable consideration, the adequacy and receipt of which is hereby
acknowledged, Grantor has this day bargained, sold, conveyed, transferred and delivered unto the
Grantee, its successors, and assigns, in perpetuity, a permanent exclusive utility easement and right-of-
way in, over,under, through and across the real property described below for purposes of operating,
construct, install, lay utilities and thereafter use, operate, inspect, repair, maintain, replace and remove
utilities or other appurtenances thereunto required at a certain parcel of real property lying and being
situated in Larimer County, Colorado, a more accurate description of said property being attached
hereto and made a part hereof as though fully copied herein in words and figures and marked exhibit
"A". Utilities being above and below ground wires, lines, cables, conduits and any other equipment
appurtenances associated with electric and communications.
This permanent utility easement and right-of-way is subject to all easements and right-of-way of
record in the office of the Clerk and Recorder of Larimer County, Colorado.
It is understood and agreed thatthis easement and right-of-way shall give and convey to the
Grantee and Grantee agents, herein the right of ingress and egress upon the lands above described for
the purpose of constructing, maintaining and repairing utilities for Grantee property.
It is further understood and agreed that the consideration above mentioned shall be in full
settlement of all claims, grants or rights of action accrued, accruing or to accrue to the Grantor herein.
The Grantee covenants that following construction of utility improvements it will return the
surface to as near original condition as possible.
It is further understood and agreed that this instrument constitutes the entire agreement
between the Grantor and the Grantee, there being no oral agreements or representations of any kind
made between the Grantor and Grantee.
The grant and other provisions herein described shall constitute a covenant running with the
land for the benefit of the Grantee, its successors and assigns.
