STOCKER 303.667-lo2n October 24 , 1988 Mr. Gary Klaphake Town Administrator TOWN OF ESTES PARK Post Office Box 1200 Estes Park, CO 80517 Dear Gary: On September 26, 1988 , the Stanley Park Committee requested a legal opinion from me concerning guidelines for group selection for use of Stanley Park and placement of ads by private groups prior to Town Board approval of the use of Stanley Park. 1 . Guidelines for Use of Stanl ey Park. It is the general rule that mun c pal t es can establish regulations for use of public parks and fairgrounds . Said rules and regulations must be reasonable and drafted in such a manner to only restrict or prohibit use of the public facility in the interest of public safety, health and welfare. The following is a list of possible areas of regulation which I feel do not discriminate against any group in an unlawful manner: (a) . Ts Stanley Park capable of physically handling the size of the group and/or use proposed? (b) . Is the size of the proposed group too small to promote economical use of Stanley Park? (c) . Is the group' s use of the facilities compatible with the design of the facilities, i. e. horse shows and rodeos? (d) . Does the proposed use of the facility raise public safety concerns, including, but not limited to fire hazards, • noise , pollution, increased police security or traffic problems? (e) . Does the group allow the general public admission to the proposed events? Notes The deed conveying Stanley Park to the Town contains a reverter clause that states : "The Town may permit such lands to be used for public entertainment upon such terms and conditions and for such rental as it may deem proper. Stanley. The group using Stanley Park may charge admission fees for its events but may not exclude the public. 2 . Review of Ads. It is my opinion that the Town does not have the legal _right to review any advertisement placed by a private group in any publication.
