HomeMy WebLinkAboutFINE SCHEDULE Estes Park Municipal CourtEstes Park Municipal Court Schedule of Fines This Schedule of Fines, Costs and Fees is authorized and published pursuant to Court Order and shall be prominently posted where fines may be paid pursuant to Colorado Municipal Court Rule 210(b)(5). Pursuantto C.R.S. §13-10-113(1), the Estes Park Municipal Court is a court of record and, for general offenses, any person convicted of violating a Municipal Ordinance may be fined an amount not to exceed $2,650, on each charge, and where any violation is a continuing offense, each day that the violation continues shall be considered and held to be a separate and distinct offense. Unless prohibited by this order, the Town, through its law enforcement and code enforcement officers, is authorized to issue penalty assessment notices for violations of Estes Park Municipal Ordinances and the Court Clerk, or other such persons designated by the Court, is authorized to accept payment for such notices according to this schedule of fines in lieu of court appearance. Except when a mandatory court appearance is required, any person charged with a violation may pay the designated fine and surcharge for the charged violation prior to the date and time set for the first appearance. A. Penalty assessments: A person may pay, at the office of the Court Clerk, the fine and surcharge for specific violations as shown in sections C. and D. below prior to his or her scheduled first court appearance (arraignment). Notwithstanding the foregoing, the following violations may NOT be paid early without court appearance: • Traffic violations allegedly committed by a Defendant who holds a Commercial Driver's License; • Violations involving personal injury or appreciable property damage; • Violations not listed on this schedule; • Violations allegedly committed by a Defendant who is under 18 years of age; or • Except as provided herein, non-trafFic violations allegedly committed by a Defendant who has been convicted of a similar offense within one (1) year. B.
