No. 532 qI PETITION The Presbyterian Church of Estes Park, a Colorado non-profit corporation, and Key Investors, Inc., an Ohio corporation, hereby petition the Planning Commission of the Town of Estes Park, Colo- rado, to recommend to the Board of Trustees of the Town of Estes Park, Colorado, that the provisions of Title 16 of the Estes Park Municipal Code be waived, and that the said Board of Trustees waive same so as to permit the dividing of the following described real property into two parcels as shown on the plat attached hereto: Commencing at the NE corner of the SE 1/4 of Section 30, Township 5 North, Range 72 West of the 6th P.M., thence S. 0°24' E. 572 feet; thence N. 89°11' W. 1304 feet to the 1/16th section line; thence S. 00°07' W. along the 1/16th section line 1060 feet to the true point of beginning; said point being the SW corner of the Estes Park School District land; thence S. 00°07' W. along the 1/16th section line which is the East boundary of the Bonnie Brae Addition to'the Town of Estes Park, Colorado, 536.5 feet; thence S. 89°01' E. along the North boundary of the Estes Park Golf and Country Club property 1889.7 feet to the intersection of the Westerly right of way of 1954 Larimer County Location for Fish Creek Road; said point also bears N. 54°25' E. a distance of 706.5 feet from the SE corner of said Section 30; thence along Fish Creek Road right of way N. 09°41' E. 604.3 feet to the SE corner of the Estes Park School District land; thence W. 1990 feet to the true point of beginning, Larimer County, Colorado, and assigns the following reasons for this request: 1. Petitioner, the Presbyterian Church of Estes Park, Colorado, at some time in the future, intends to build a church on the smaller parcel, and has entered into a contract with petitioner, Key Invest- ors, Inc., for the purchase of the larger parcel. Petitioner, Key Investors, Inc., intends to build a nursing home and retirement housing on said parcel. 2. There are special circumstances or conditions affecting the property in that the Town of Estes Park is in need of such facilities as a nursing home and retirement housing, and that such development will be located a short distance from the Elizabeth Knutsson Hospi- tal. 3. The exception is necessary for the preservation and the en- joyment of a substantial property right of the petitioners. 4. The granting of the exception will not be materially detri- mental to the public welfare or injurious to the property of the neighborhood in which the property of petitioners is situated, or in conflict with the purposes and objections of said Title 16.
