RECORD OF PROCEEDINGS Regular Meeting of the Estes Valley Board of Adjustment October 2, 2007, 9:00 a.m. Board Room, Estes Park Town Hall Board: Chair Wayne Newsom; Members Cliff Dill, Chuck Levine, John Lynch, and Al Sager; Alternate Member Bruce Grant Attending: Chair Newsom; Members Levine, Lynch, and Sager; Alternate Member Grant Also Attending: Director Joseph, Planner Shirk, Planner Chilcott, Recording Secretary Roederer Absent: Member Dill Chair Newsom called the meeting to order at 9:00 a.m. He welcomed Planner Chilcott back from maternity leave and congratulated her on the birth of baby Kathryn. 1. PUBLIC COMMENT None. 2. CONSENT AGENDA a. Approval of the minutes of the September 11, 2007 meeting. There being no changes or corrections, the minutes were approved as submitted. 3. METES AND BOUNDS PROPERTY LOCATED AT 2025 MORAINE AVENUE, Applicants: Steve Eck & Steve Williams — Request for variance from Estes Valley Development Code Section 7.5.F.2.b(6) to allow portions of a driveway to be placed within the required arterial -street landscape buffer at a distance of 11.5 feet from the property line In lieu of the required 25-foot buffer Planner Shirk summarized the staff report. This is a request to allow portions of an access drive to be located within the required 25-foot arterial setback/landscape buffer zone. The property is zoned A —Accommodations and is currently undeveloped. The applicant contemplates future development of nine units on the site, which would require a development plan. However, this variance hearing in no way constitutes review of a development proposal, nor would approval of the variance imply approval of any future development plan. The applicant's intent to preserve significant trees if the property is developed as contemplated, including a 24-inch-diameter ponderosa, pushes portions of the access drive into the setback. Planning staff suggests that the required setback should be further reduced to allow the interior driveway to be twelve feet wide rather than ten feet wide and recommends approval of the requested variance with the requirement that district -buffer landscaping standards apply. This would provide approximately twice the amount of landscaping as that required to meet arterial -street landscaping standards and would require installation of evergreens rather than deciduous trees. Staff recommends this district -buffer landscaping be planted along approximately two-thirds of the highway frontage. Correspondence opposing this variance request was received from neighboring property owners Dave Ranglos of Glacier Lodge, 2166 Highway 66, and Cheryl Wagner, 1986 Dallman Drive, #5. A letter was also received from applicant Steve Eck. RECORD OF PROCEEDINGS Estes Valley Board of Adjustment 2 October 2, 2007 Public Comment: Zach HansonNan Horn Engineering and Surveying was present to represent the applicants. Board members did not have any questions for Mr. Hanson. Dave Ranglos/2166 Highway 66 stated he is the owner of two adjacent parcels located across the river from the applicant's property. He reviewed the information provided in his letter opposing the variance request. He stated the applicant could build fewer or smaller units to comply with required setbacks. He expressed concern about driveway -spacing requirements and the effect the applicant's proposed access may have on an existing easement across the subject property that provides access to his property. His concerns also included a possible retaining wall and fill that may be placed on the site with future development, impacts on the direction of the river flow, previous evidence of river water flowing through the middle of the lot during peak runoff periods, substantial and detrimental changes to the character of the neighborhood, disruption of the tranquillity of the river corridor, possible detrimental effect on his rental business, and lack of appropriate transition between the valley and the national) park as required by the Comprehensive Plan. Chair Newsom stated the Board is only reviewing a request to decrease the required setback from the road for a future driveway. Planner Shirk stated a letter received from Traci Downs of Larimer County Engineering indicates the county has no concerns with this variance request. The appllicant's submitted plans show the ingress/egress point to be approximately 300 feet from Mr. Ranglos' easement, which is greater than the 250-foot separation required. If a development plan for nine units is submitted in the future, it will be reviewed at the staff level); eleven or more units must be proposed in order for a development plan to be reviewed by the Planning Commission. Steve Eck/applicant stated the placement of the driveway access was designed to accommodate Mr. Ranglos' easement and is 340 feet away. River water will not be diverted onto Mr. Ranglos' properly. He is proposing nine residences; Mr. Ranglos' property includes 36 rental units. Cheryl Wagner/1986 Dallman Drive expressed dismay that neighbors have so little say in devellopment proposals. She urged the Board to consider the impacts of the future residences and retaining wall to the environment and area wildlife. She expressed concern about density and increases in traffic and noise. Chair Newsom pointed out that the subject property is zoned for this type of development; if the applicant's proposal meets zoning guidelines it can not be disapproved. It was moved and seconded (Levine/Sager) to approve the variance request for the Metes and Bounds property located at 2025 Moraine Avenue, to allow portions of a driveway to be placed within the required arterial landscape buffer at a distance of 10 feet from the property line in lieu of the required 25-foot buffer, with the findings and conditions recommended by staff, and the motion passed unanimously. CONDITIONS: 1. District -buffer landscaping standards shall be applied in place of arterial) -street standards. 4. LOT 2, GOOD SAMARITAN SUBDIVISION, 2000 PTARMIGAN TRAIL, Applicant: Shepherd of the Mountains Lutheran Church — Request for variance from Estes Valley Development Code Section 1.9.E to allow a steeple structure and cross to extend 12 feet above the maximum slope -adjusted height limit of 32 feet, 9 inches Planner Chilcott summarized the staff report. This is a request by the Shepherd of the Mountains Lutheran Church for a twelve -foot variance to the maximum slope -adjusted height limit of 32.75 feet in order to construct and install a 45.25-foot steeple and aluminum cross. The Estes Valley Development Code (EVDC) Section 1.9.E establishes the maximum height limit but excepts residential chimneys and telecommunications facilities, with some limitations. In considering whether special circumstances exist, the Board should consider that a steeple is typically an integral part of a church. There is no practical difficulty with this site; RECORD OF PROCEEDINGS Estes Valley Board of Adjustment 3 October 2, 2007 a structure could be built to comply with the height limit. Building plans submitted with a Special Review for this property, which was approved in 2002, showed a church building and cross structure that complied with the height limit; the plans have since been redesigned. The Board must consider the protections offered by the Religious Land Use and Institutionalized Persons Act. Planning staff suggests that if the impact of the steeple structure and cross would be similar to that of a chimney or telecommunications facility, the Board should consider the variance request. A letter of objection was received from the North End Property Owners' Association stating approval of the variance will have significant impact on the neighborhood even if the cross is not lit and is not shiny. In response to questions from Board members Levine, Grant, and Sager, Planner Chilcott stated the building meets the height limit; only the steeple structure and cross will exceed the height limit. The applicant's architect has indicated the cross will not be lit. The property was not posted with a variance notice as required; the applicant is responsible for posting this notice. Public Comment: Steve Lane/Basis Architecture was present to represent the applicant. He stated he is aware of the requirement to post a variance notice and apologized for the failure to post the notice. He prepared a photo survey for today's meeting and presented it to the Board. The applicant wanted a more traditional church architecture, including a steeple, than that shown with the Special Review in 2002. The proposed steeple structure is five feet tall and will match the architecture and roof coloring (a natural brown) of the church building. Although the cross will be constructed of aluminum, it can be anodized or powder -coated so as to provide a matt finish. The color has not yet been selected but will be a natural color, such as bronze, that fits the color scheme of the building. There will not be electric power in the steeple structure and the cross will not be lit. The contours of surrounding lands and the structures already in place on neighboring properties, including the Good Samaritan development and condominiums in the area, will largely block views of the cross from the north and the west. The impact of the requested variance will be similar to that of a chimney or communications tower that exceeds the height limit. Director Joseph thanked Mr. Lane for complying with staff's request to provide a photo simulation, noting it is not a requirement for submittal of a variance application. Following Mr. Lane's photo presentation, Planner Chilcott recommended approval of the variance request, subject to the recommended conditions of approval found in the staff report and the additional requirements that the cross not be lit and have a non -reflective, matt finish. Further discussion was held and is summarized as follows. The building is situated below grade; that portion of the building below the original grade does not count toward the height limit. Although the cross could be located on the portico, the congregation voted to locate the cross as proposed. Lighting for the parking tot should be downward directed. The building foundation has been poured; Planner Chilcott will verify that the required height certificate has been provided. It was moved and seconded (Sager/Levine) to approve the variance request for Lot 2, Good Samaritan Subdivision, to allow a steeple structure and cross to extend 12 feet above the maximum slope -adjusted height limit of 32 feet, 9 inches, with the findings and conditions recommended by staff, and the motion passed unanimously. CONDITIONS: 1. Compliance with the submitted application. 2. A registered land surveyor shall set the survey stakes for the foundation forms. After the footings are set and prior to pouring the foundation, the surveyor shall verify compliance with the variance and provide a height certificate. 3. The cross and steeple shall not be lit. 4. Legal Description: Bugle Point on Fall River, Phase II Condominiums, and Creekside Suites Condominiums APPLICANT: Elizabeth Blanchard, Estes Park Condos PROPERTY OWNERS: Both properties are condominiumized and land is owned in common by ail condominium unit owners. STAFF CONTACT: Alison Chilcott and Carolyn McEndaffer APPLICABLE CODES: Estes Valley Development Code (EVDC) and Estes Park Municipal Code (EPMC) REQUEST: The petitioner is requesting variances to allow off -premise signs to be located at 1400 David Drive and 1516 Fish Hatchery Road. If approved, the signs will advertise five condominiumized accommodations properties: Bugle Point on Fall River; Bugle Point on Fall River, Phase II; Creekside; Creekside Suites; and Antlers Pointe. The rental management company, Estes Park Condos, operates offices at the two above -mentioned addresses. If granted, the applicant would remove the existing Bugle Point entry sign and replace it with a larger, 56-inch-by-48-inch sign. Sign Proposed at Creekside Suites Condominiums 1400 David Drive The applicant requests variances to the following three Code sections. 1. Estes Park Municipal Code Section 17.66.060(13), which prohibits off - site signs from being permitted, erected, or maintained in the Town. 2. Estes Park Municipal Code Section 17.66.110(3)b, which establishes an eight -foot minimum setback from any property line for freestanding signs. 3. Estes Valley Development Code Section 7.6.E.1.a.2 River Corridors (b) Exception for Lots Developed Prior to the Adoption of this Code, which states, All buildings and accessory structures shall be set back at least thirty (30) feet horizontally (plan view) from the annual high- water mark of river corridors or, if not readily discernible, from the defined bank of the river. If granted, the applicant will modify the existing sign. The sign would remain 7.34 feet from the front property line and 26.15 feet from the annual high-water mark of the river. The sign dimensions, 110-inches-by-130- inches, will not change. II. REVIEW CRITERIA All variance applications shall demonstrate compliance with the standards and criteria set forth in Chapter 3.6.0 and all other applicable provisions of the Estes Valley Development Code. All applications for variances from Chapter 17.66 Signs shall also demonstrate compliance with Section 17.66.160 of the Municipal Code. This variance request does not fall within the parameters of staff -level review and will be reviewed by the Estes Valley Board of Adjustment. REFERRAL COMMENTS This request has been submitted to all applicable reviewing agency staff and neighboring property owners for consideration and comment. The following reviewing agency staff and/or adjacent property owners submitted comments. Estes Park Building Department See Carolyn McEndaffer's memo to Alison Chilcott dated October 26, 2007. Town Attorney See Greg White's letter to Alison Chilcott dated October 24, 2007. V. STAFF FINDINGS Staff finds: 1. Reviewing Agencies. This request has been submitted to all applicable reviewing agency staff for consideration and comment. All letters and memos submitted by reviewing agency staff, referred to in Section IV of this staff report, are incorporated as staff findings. 2. Section 17.66.160(3) of the Municipal Code states, in every case in which a request for a variance from the requirements of this Chapter [17.66 Signs] has been filed, the Board shall not grant a variance unless it specifically finds each and every one of the following conditions to exist. a. There are special circumstances or conditions, such as the existence of buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent public right-of-way, which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions must be particular to the particular business or enterprise to which the applicant desires to draw attention and to not apply generally to all businesses or enterprises. Staff Finding: The applicant's statement of intent describes the special circumstances they believe exist. These reasons include, but are not limited to: • The five properties function as one with one on -site rental management company. Page #5 -Variance Requests for 1400 David Drive and 1516 Fish Hatchery Road • Traffic in the neighborhood will be reduced by providing signage that better directs guests to the rental management office. It will also assist Town and emergency personnel in locating the correct office. In regards to the Creekside Suites sign, staff finds that the eight -foot front property line setback for signs and the thirty-foot river setback overlap at the comer of the lot where a sign would draw the most attention to the property. The impact of the sign to the river corridor is minimal. b. The variance would be in general harmony with the purposes of this Chapter, and specifically would not be injurious to the neighborhood in which the business or enterprise to which the applicant desires to draw attention is located. Staff Finding: The Board should use their best judgment to determine if this variance would be in general harmony with the purposes of Chapter 17.66 Signs. Neighbors have not commented that the proposed signs are injurious to the neighborhood. c. The variance is the minimum one necessary to permit the applicant to reasonably draw attention to this business or enterprise. Staff Finding: The Board should use their best judgment to determine if these are the minimum variances necessary. 3. Section 17.66.160(d) No variance for maximum sign area on a lot or building states, other provisions of this section to the contrary notwithstanding, the Board shall not have any jurisdiction to hear, nor the authority to grant, any variance from any section of this Chapter which limits the maximum permitted sign area on a single lot or building. 4. Section 17.66.160(e) states, the Board may grant a variance subject to any conditions, which it deems necessary or desirable to make the device which is permitted by the variance compatible with the purposes of this Chapter. Staff Finding: If the Board chooses to approve this variance, staff has recommended a number of conditions of approval. Page N6 -Variance Requests For 1400 David Drive and 1516 Fish Hatchery Road 5. In addition to the review standards in Section 17.66.160 of the Municipal Code, the following review standards from the Estes Valley Development Code Section 3.6.C. apply. a. Whether there can be any beneficial use of the property without the variance. Staff Finding: The existing use can continue. b. Whether the variance is substantial. Staff Finding: The Board should use their best judgment to determine if the variance requests for the off -premise signs are substantial. Staff does not find that the setback variance requests for the Creekside sign are substantial. c. Whether the essential character of the neighborhood would be substantially altered or whether adjoining properties would suffer a substantial detriment as a result of the variance. Staff Finding: The Board should use their best judgment to determine if the variance requests will substantially alter the essential character of the neighborhood. Staff has not received comments from adjoining properties concerning the impacts of the requested variances. d. Whether the variance would adversely affect the delivery of public services such as water and sewer. Staff Finding: At this point in time, the variances will not affect the delivery of public services; however, the applicant should be aware that both signs are located within easements and the future use of the easement may require relocating the signs outside the easements at the expense of the property owner. e. Whether the Applicant purchased the property with knowledge of the requirement. Staff Finding: This standard addresses whether or not the Code requirements changed during current property owners' ownership of the property. This standard is not intended to address whether or not the property owner reviewed Code to determine which regulations are applicable to his/her property. Page #7 Variance Requests for 1400 David Drive and 1516 Fish Hatchery Road Staff has not reviewed the purchase history for all unit owners. However, based on the dates these properties were condominiumized, it is reasonable to assume that the majority of unit owners purchased their units after the February 1, 2000 effective date of the Estes Valley Development Code and after the adoption of the current sign code found in the Estes Park Municipal Code. Since these are public documents, the majority of the property owners purchased the property with knowledge of the requirements. f. Whether the Applicant's predicament can be mitigated through some method other than a variance. g• Staff Finding: An option that would not require an off -premise sign variance is to add only "Estes Park Condos" to each of the two signs and instruct guests to look for the "Estes Park Condos" sign. No options exist for locating a visible sign for Creekside Suites at the comer of Fall River Road and David Drive that complies with the setbacks. No variance shall be granted if the submitted conditions or circumstances affecting the Applicant's property are of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulation for such conditions or situations. Staff Finding: Staff does not find that a regulation should be adopted to address this situation. h. No variance shall be granted reducing the size of lots contained in an existing or proposed subdivision if it will result in an increase in the number of lots beyond the number otherwise permitted for the total subdivision, pursuant to the applicable zone district regulations. Staff Finding: The variance, if granted, will not reduce the size of the lot. i. If authorized, a variance shall represent the least deviation from the regulations that will afford relief. Staff Finding: The Board should use their best judgment to determine if the variance represents the least deviation from the regulations that will afford relief. Page #8 -- Variance Requests for 1400 David Drive and 1516 Fish Hatchery Road J• Under no circumstances shall the BOA grant a variance to allow a use not permitted, or a use expressly or by implication prohibited under the terms of this Code for the zone district containing the property for which the variance is sought. Staff Finding: Signs are permitted in the Accommodations/Highway Corridor zoning district. k. Per EVDC §3.6.D, failure of an Applicant to apply for a building permit and commence construction or action with regard to the variance approval within one (1) year of receiving approval of the variance shall automatically render the decision of the Board of Adjustment null and void. VI. STAFF RECOMMENDATION If the Board chooses to recommend APPROVAL of the requested variances. Staff recommends that it be approved CONDITIONAL TO: 1. Compliance with the submitted application, including the proposed sign plans. However, staff shall have the authority to approve minimal revisions to the signs in the future without further Board of Adjustment review. 2. Compliance with Carolyn McEndaffer's comments in her memo dated October 26, 2007. 3. Both signs are located in easements. Future use of the easements may require that the property owner relocate the signs outside the easements at their expense. Page #9 —Variance Requests for 1400 David Drive and 1516 Fish Hatchery Road EM To: Alison Chilcott From: Carolyn McEndaffer, Plans Examiner/Code Compliance Officer Date: October 26, 2007 Re: Estes Park Condos, 1400 David Drive Variance Request The Department of Building Safety has the following comments regarding the Variance Request for the signs located at 1400 David Drive (Creekside) and 1516 Fish Hatchery Road (Bugle Pointe). 1. As incorrectly noted on the application, the Creekside sign permit #2533 issued 6/12/98, but was required per the permit to be located 8 feet off the property line and comply with the 30 foot site visibility triangle. The river setback was not addressed. 2. As noted on the application, revise the requested variances to EVDC 7.6.E.l.a (2) for the river setback. 3. The application states all three resorts are on the same property. According to the Larimer County Assessors database the three resorts are on 5 separate parcels of land and are not contiguous. The addresses are 1515 Fish Hatchery Road (Antlers Point) 1516 Fish Hatchery Road (Bugle Pointe) 1480 David Drive (Bugle Pointe) 1400 David Drive (Creekside) and 1340 Fall River Rd. (Creekside Condos). These are condominium properties with individual ownership. Please see attached Larimer County Assessors map. 4. The Bear Paw/River Stone (2100 Fall River Road) Off Premises sign variance granted June 2, 1998 stated the two lots were owned by the same person, the lots were contiguous and there was a hardship for one lot due to site restraints. 5. I have not been able to locate a sign permit for Antlers Pointe (1515 Fish Hatchery Road). Please check your records. I have included a picture of the sign. If a permit was not obtained, submit for permit so all properties will be in conformance with the code. 6. It's the Department of Building Safety's policy to obtain permission from the property owners for sign permits. The homeowners association for each development should approve in writing (according to their by-laws) the sign location and content. 7. Sign permits are required for every sign that is relocated or revised as required by (Estes Park Municipal Code) EPMC 17.66.140 Permits. 8. If the location for check in is a problem for visitors, I suggest check in location or instructions to be added to the sign. 9. The Department of Building Safety has concerns that granting of this variance may set a precedent for other applications for Off -Premises signs. The Creekside sign was positioned in 1998 to meet each code requirement as close as possible. The sign can not move "back," as there is a 10' elevation change (down) behind the Creekside sign. The embankment drops sharply just behind the sign. Fall River is behind the Creekside sign. (A ttn K) The sign can not move forward, as this will further encroach on the "Property Line Setback" and the "30 foot sight Triangle." 96 um i' i111111iIIMom EPMC 17.66.060 (13) —Off Premise Sign We feel the need to place all three properties on one sign for the following reasons: All three resorts are on the same property tt L All three resorts are managed under one management company: Estes Park Condos Both the Creekside Office and the Bugle Pointe Office manage all three properties. Currently, guests aimlessly drive around the neighborhood looking for their "specific" office (either Creekside, Bugle Pointe or Antlers Pointe), not realizing that either office can assist them. The Bugle Pointe sign misleads guests to interpret it is ONLY for Bugle Pointe guests. The Creekside sign misleads guests to interpret it is ONLY for Creekside guests. Currently, there is no office sign for Antlers Pointe. These guests have no idea which office to check in to. We can decrease the amount of driving through the neighborhood by advertising all 3 properties on each of the two signs. This will direct guests immediately, to either the Creekside or Bugle Pointe office, without driving back & forth between Fish Hatchery, David Dr. & Fall River/Hwy. 34. The Antlers Pointe guests need signage to direct them to the Creekside and/or Bugle Pointe Offices. Currently, there is no signage to direct them to either office. Guests drive aimlessly up and down the adjacent roads (Fish Hatchery, David Dr.& Fall River/Hwy. 34), wondering where the office is. Both the Creekside and Bugle Pointe signs are worn and dated. They are not easily read as cars drive by. This slows traffic and increases opportunity for traffic accidents. The proposed new signage is highly visible from the road and can be read easily without having to stop. The Creekside, Bugle Pointe and Antlers Pointe entrances are not visible from the "main" road, Hwy. 34. If the Creekside sign is changed to reflect all three properties, guests will immediately turn onto David Drive where the Creekside Office is located. This will likewise happen for guests arriving from the opposite direction by the Bugle Pointe Office. They will immediately turn into the Bugle Pointe Office, based on the improved, proposed signage. Emergency and town utility personnel have had difficulty finding each of the offices. The assumption is that each property is a different company, so they don't go to the specific office we need them at. If the signage reflects that Antlers Pointe, Bugle Pointe and Creekside are ALL part of Estes Park Condos, there will be no confusion as to where to arrive. Guests continually request that we change our signage to reflect all three properties. They receive a confirmation letter explaining this; however, they become confused when they are driving and see different signage. All 73 owners of the Estes Park Condos property have requested we change our signage for the same reasons mentioned above. NIV.II�mipill � h III EPMC 17.66.060 (13) -- • .'' Signs in the Town of Estes r ® All signs in the Town of Estes Park shall comply with the Estes Park Sign Code, set forth in Chapter 17.66 of the Town of Estes Park Municipal Code, as amended from time to time. The following signs shall not be permitted, erected or maintained in the Town: (1) Signs with visible moving, revolv- ing or rotating parts or visible mechanical movement of any description or other appar- ent visible movement achieved by electrical, electronic or mechanical means, except for time -temperature -date signs, traditional bar- ber poles, and gauges and dials which may be animated to the extent necessary to display correct measurement; (2) Signs with optical illusion of move- ment by means of a design which presents a pattern capable of reversible perspective, giv- ing the illusion of motion or changing of copy; (3) Signs with lights or illuminations which flash, move, rotate, scintillate, blink, flicker, vary in intensity, vary in color or use intermittent electrical pulsations; (4) Strings of light bulbs used in connection with commercial premises for commercial purposes, other than traditional holiday decorations except as provided in Subsection 17.66.050(9); (5) Wind signs and banners; (6) Signs which incorporate projected images, emit any sound which is intended to attract attention or involve the use of live animals; (7) Any sign which is installed or erected in or projects into or over any public right-of-way, except in the case of a sign for which a permit has been issued in confor- mance with the requirements of this Chapter; Zoning Section 17.66.060 (8) Signs not permanently affixed or attached to the ground or to a permanent structure, (for example, banners, sandwich boards and handheld signs). Temporary real estate signs attached to posts driven into the ground and temporary safety barriers are excepted. (9) Any sign or sign structure which: a. Is structurally unsafe, or b. Constitutes a hazard to safety or health by reason of inadequate mainte- nance or dilapidation, or c. Is capable of causing electrical shocks to persons likely to come in con- tact with it; (10) Any sign or sign structure which: a. Obstructs the view of, may be con- fused with or purports to be an official traffic sign, signal or device or any other official sign, or b. Creates an unsafe distraction for motor vehicle operators, or c. Obstructs the view of motor vehicle operators entering a public roadway from any parking area, service drive, private driveway, alley or other thoroughfare; (11) Any sign which obstructs free ingress to or egress from a required door, window, fire escape or other required exit way; (12) Roof signs, except as specifically permitted by Section 17.66.110; 117r30 Supp. 9 (13) Off -premises advertising signs. (14) Signs not pertinent and or not clearly related to the permitted use on the property where located, except for temporary political signs, as permitted and regulated by Section 17.66.070, and except for signs permitted under the provisions of Section 17.66.130. (15) Except as provided in Subsection 17.66.050(8), any sign having direct illumination, including but not limited to visible neon tubing. (Ord. 17-02 §1(part), 2002) 17.66.070 Temporary signs. Temporary signs in all zoning districts shall be subject to the following specific require- ments: (1) Construction signs. Signs advertis- ing subdivision, development, construction or other improvements of a property shall be permitted in any zoning district and shall comply with the following: a. Such signs shall be limited to free- standing, wall or window signs, shall not exceed thirty-six (36) square feet in total area nor eighteen (18) square feet per face, and shall not exceed twelve (12) feet in height. No riders or attachments to such signs shall be permitted. For residential developments consisting of five (5) dwelling units or less, the maximum area permitted for a construction sign shall be three (3) square feet per face for each dwelling unit being constructed. Zoning Section 17.66.110 17.66.110 Sign regulations in nonresidential zones. The following regulations shall apply to all uses in nonresidential zoning districts. (1) Total allowable sign area. a. The total area of all signs on any face of a building shall not exceed one and one-half (1.5) square feet per lineal foot of building frontage at ground level, and three-quarters (0.75) square foot per lineal foot of second story building frontage. b. The maximum allowable total cumulative sign area for any one (1) business shall not exceed one hundred fifty (150) square feet. (2) Signs or uses with multiple frontage. The total area of all signs on any face of a building shall not exceed one and one-half (1.5) square feet per lineal foot of building frontage at ground level, and three-quarters (0.75) square foot per lineal foot of second story building frontage. Supp. 9 (3) Freestanding signs: a. Maximum height: twenty-five (25) feet. b. Minimum setback: eight (8) feet from any property line, four (4) feet from any building. c. Number: One (1) freestanding sign per street frontage, not to exceed two (2) per lot. d. Maximum area: No freestanding sign shall be larger than one hundred fifty (150) square feet. 1 .3,5 The combined total of all freestanding signs on an individual property or single lot shall not exceed one hundred fifty (150) square feet. (4) Signs on canopies, awnings and architectural projections. a. Maximum area: The total area of such signs shall not exceed thirty percent (30%) of the width of the projection multiplied by the vertical height of the projection. b. Projection: 1. The face of any such sign shall not project above or below the face of the canopy, awning or architectural projection. Signs may project horizon- tally beyond the face of a canopy or architectural projection the distance necessary to accommodate the thick- ness of the letters, but no more than twelve (12) inches. 2. Signs displayed on architectural projections which extend fifteen (15) inches or less from the face of a build- ing may be considered wall signs, and are subject to those provisions. (5) Projecting signs: a. Minimum setback: four (4) feet from street property line in the Commercial Downtown (CD) Zoning District, or eight (8) feet from property lines in all other zoning districts, and no closer to a sideline of the building or storefront than to the centerline of the same building or storefront. b. Minimum clearance: Nine (9) feet from the ground to the bottom edge of the sign. General Development Standards § 7.6 Wetlands and Strom Corridor Protection (1) National Wetlands Inventory prepared by the U. S. Department of the Interior, Fish and Wildlife Service; and (2) Colorado Natural Heritage Program maps. b. Unmapped Wetlands. The review of a development proposal may discover a potential wetland that has not been mapped or for which the boundaries have not been clearly established. In such instances, the Applicant shall retain a qualified wetland expert to delineate the boundaries of the wetland a . rding to accepted professional standards. E. Buffer/Setback Areas. 1. Stream or River Corridors. a. Building/Structure Setbacks. (1) Stream Corridors (except in the CD zoning district). All buildings and accessory structures shall be set back at least thirty (30) feet horizontally (plan view) from the annual high-water mark of stream corridors, or if not readily discernible, from the defined bank of the stream, Where defined banks are not readily discernible, the setback shall be m>,sured from the thread of the stream.
