3. LOT 1, SILVER LANE STABLES ADDITION, located at 621 Big Thompson Avenue —
Request for a variance from §5.1.0.4.a of the Estes Valley Development Code, which
requires that service stations and quick lubrication service uses shall be located at
least one hundred (100) feet from the property boundary of any residential zoning
district.
Staff Report:
Planner Chilcott stated Safeway is proposing to construct a service (fueling) station and
car wash on the current Silver Lane Stables site, at the corner of Highway 34 and Steamer
Drive. The applicant has also submitted a development plan application for construction of
the service station and car wash, which is being reviewed at staff level with a decision by
July 21, 2009.
Planner Chilcott stated that staff reviewed the variance request for compliance with Estes
Valley Development Code Section 3.6, which includes evaluating whether or not special
circumstances and practical difficulty exist in complying with the code standards from
which a variance is requested. Staff finds that special circumstances exist and practical
difficulty may result from strict compliance with Code standards.
The Estes Valley Development Code (EVDC) requires that service station, car wash, and
quick lubrication service uses be located a minimum of one hundred feet from the
boundary of a residential zoning district. The setback requirement for this use is
significantly larger than typically required between commercial and residential uses. For
any other commercial use, the setback would be 15 or 25 feet, depending on zoning. The
R-zoned property in question is an outlot of the Stanley Hills subdivision and contains
postal cluster boxes and a driveway leading to the boxes. This outlot is available for future
roadway if a deed of dedication from the Stanley Hills Subdivision HOA was submitted.
The closest single-family lot to the proposed service station and car wash is approximately
135 feet away, with the closest house being about 370 feet away.
The setback is intended for a buffer between a service station, car wash, and/or quick
lubrication service use and a residential use, but in this case the buffer will never serve its
intended purpose, To layer on this increased setback adds a further and significant
development constraint to the property.

Member Newsom questioned why staff recommended the variance be valid for three
years, rather than the typical one-year time period.. Planner Chile stated staff
recommended this lbecause Safeway does not plan on constructing the car wash
immediately, if at all. A three-year period gives Safeway a longer timefrarne in which to
construct the car wash without reapplying to the Board of Adjustment,
Public Comment:
Jeff Fergot/Corporate Architect representing Safeway stated Safeway wants make sure
they have the entitlement in place for the car wash so they can construct it in the future if
there is a need or desire for it. He stated Safeway typically finds the highest demand for
car washes is during the winter months, which are Estes Park's slowest months Safeway
would like to evaluate the need for the car wash after the gas station is constructed. If
built, the car wash will be a closed system with water reclamation.
Leslie Peng/Discovery Lodge owner has concerns about the effect on the water supply for
the Discovery Lodge fish pond. This water supply runs underground through the stables
property. Director Joseph stated this concern is valid and Community Development will try
to address the issue during the staff development plan review,
Greg Wheeler/Stanley Village has had positive experiences working with Safeway fueling
stations at other shopping centers. He believes Estes Park would benefit from this facility.
Member Newsom has a concern about canopy lighting. Director Joseph stated this
concern will be addressed in the development plan review. There is an illumination plan
for this project.
It was moved and seconded (Newsom/Sager) to APPROVE the request for a variance
from EVDC §5.1.0.4.a to allow construction of a fueling facility and car wash within
100 feet of the property boundary of a residential zoning district, with the following
conditions:
CONDITIONAL TO:
1. Approval of Safeway's development plan application #09-05.
2. Failure to apply for a building permit and commence construction or action with
regard to the variance approval within three years of final development plan
approval shall automatically render the decision of the Board of Adjustment null and
void.
3. Exterior lighting under the canopy will be completely recessed.
The motion passed unanimously.

Safeway, Inc. is proposing to construct a service (fueling) station and car
wash on the current Silver Lane Stables site located at the corner of Big
Thompson Avenue (Highway 34) and Steamer Drive and has submitted a
request to allow these uses to be located less than one hundred feet from an
R-Residential zoned outlot immediately to the north of the property.
Specifically, the applicant is requesting a variance to EVDC Section
5.1.Q.4.a, which applies to service station, car wash, and quick lubrication
service uses, and which states, "The use shall he located at least one
hundred (1)0) feet from the property boundary of any residential zoning
district."
The zoning maps below show the CO -Commercial Outlying zoned lot on
which the service (fueling) station and car wash are proposed and the
adjacent R-Residential zoned outlot.
The applicant has also submitted a development plan application for revie
which will be reviewed by staff with a decision by July 21, 2009..

III. REVIEW CRITERIA
All variance applications shall demonstrate compliance with the standards
and criteria set forth in Chapter 3.6.0 and all other applicable provisions of
the Estes Valley Development Code.
This variance request does not fall within the parameters of staff -level
review and will be reviewed by the Estes Valley Board of Adjustment.
IV. REFERRAL COMMENTS
This request has been submitted to all applicable reviewing agency staff and
neighboring property owners for consideration and comment. The following
reviewing agency staff submitted comments.

I. Special circumstances or conditions exist (e.g, exceptional
topographic conditions, narrowness, shallowness or the shape of the
property) that are not common to other areas or buildings similarly
situated and practical difficulty may result from strict compliance
with this Code's standards, provided that the requested variance
will not have the effect of nullifying or impairing the intent and
purposes of either the specific standards, this Code or the
Comprehensive Plan.
Staff Finding:
Staff finds that special circumstances exist and practical difficulty may
result from strictcompliance with Code standards.
This is a commercially zoned lot with prime highway frontage; however,
the site is physically constrained in two significant ways; first by the
triangular shape of the lot and second by the steepness of the lot.
The Estes Valley Development Code requires that service station, car
wash, and quick lubrication service uses be located a minimum of one
hundred feet from the boundary of a residential zoning district. This is a
significantly larger setback than typically required between commercial
uses and residential uses. A twenty -five-foot minimum
building/structure setback is required when a CO -zoned property abuts a
residentially zoned property. For a CO -zoned lot that abuts another CO
zoned lot the setback is fifteen feet.
As described in more detail below, the one hundred foot setback would
not serve the setback's intended purpose, i..e. to provide a buffer
between a service station, car wash, and/or quick lubrication service yse
and a residential (.(..w, such as household use of a single-family home. To
layer on this increased setback adds a further and significant
development constraint to the property. The plan below shows the
proposed development and the location of the 1.00-foot setback.

In this case, the portion of the residentially zoned outlot adjacent to the
proposed service (fueling) station and car wash contains postal cluster
boxes for the Stanley Hills subdivision and a driveway leading to the
postal cluster boxes, as shown in the below aerial photo taken
approximately three years ago and the photo taken on June 29, 2009.

2. In determining "practical difficulty," the BOA shall consider the
following factors:
a. Whether there can be any beneficial use of the property without
the variance.
Staff Finding: Staff finds there can be a beneficial use of the
property without the requested variance. The existing stables use
could continue on the lot.
b. Whether the variance is substantial.
Staff Finding: Staff finds that the variance request is not substantial.
The one hundred foot setback would not serve the setback's
intended purpose, i.e. to provide a buffer between a service station,
car wash, and/or quick lubrication service use and a residential use,
such as household use of a single-family home. The increased
setback would provide a buffer against a lot that in the future could.
become a portion of the Steamer Drive right-of-way.

property..
d. Whether the variance would adversely affect the delivery of
public services such as water and sewer.
Staff Finding: This application was routed to providers of public
services, such as water and sewer, and no concerns were expressed
about. adverse impacts of this variance application to the delivery of
public services.
e. Whether the Applicant purchased the property with knowledge
of the requirement.
Staff Finding: This standard addresses whether or not the Code
requirements changed during current property owners' ownership of
the property. For example, did the property owner purchase the
property prior to adoption of the required setbacks?
This standard is not intended to address whether or not the property
owner reviewed Estes Valley Development Code to determine which
setbacks are applicable to his/her property.
The applicant has not purchased the property and is aware of the
requirement.
f Whether the Applicant's predicament can be mitigated through
some method other than a variance.
Staff Finding: The applicant cannot build as proposed without the
requested variance.
3. No variance shall be granted if the submitted conditions or
circumstances affecting the Applicant's property are of so general
or recurrent a nature as to make reasonably practicable the

4. No variance shall he granted reducing the size of lots contained in
an existing or proposed subdivision if it will result in an increase in.
the number of lots beyond the number otherwise permitted for the
total subdivision, pursuant to the applicable zone district
regulations.
Staff Finding: The variance would not reduce the size of the lot.
5. If authorized, a variance shall represent the least deviation from the
regulations that will afford relief.

Statement Of Intent

Proposed Safeway Fueling Facility
Lot 1, Silver Lane Stables Addition
Town of Estes Park, CO
Safeway inc. proposes to construct a new fueling facility at the above referenced
location. All existing site improvements will be demolished and a new fueling facility
consisting of a 1,185 square foot (SF) kiosk or convenience store, a 6,075 SF overhead
canopy above 6 multiple product fuel dispensers, and a future 1,275 SF single -bay
automatic car wash.
Vehicular access to the fuel facility is proposed through one curb -cut on Highway 34 and
one curb -cut on Steamer Drive. A new eight foot wide sidewalk will be provided along
Highway 34 with a new six foot wide sidewalk added along Steamer Drive. A
handicapped accessible pedestrian connection will be provided between the
kiosk/convenience store and the new sidewalk along Highway 34.
Extensive landscape buffering exceeding the Town's requirements will be provided
along Highway 34, Steamer Drive, and within the interior of the site. The design of the
fuel facility will utilize the same materials, colors, and architectural detailing of the
existing Safeway grocery store thereby resulting in a visually cohesive and attractive
development.
The fuel facility will be owned and operated by Safeway Inc. and will function as another
department of the existing Safeway grocery store. The hours of operation will be
approximately the same as those of the grocery store. Current plans call for the fuel
facility to open in July 2010 and the future car wash to open within 3 years after the
opening of the fuel facility.
Variance Request
With this submittal, Safeway Inc. hereby requests a variance from section 5.1.Q.4.a of
the "Estes Valley Development Code". Section 5.1.Q.4.a states that for Service
Stations, "The use shall be located at least one hundred (100) feet from the property
boundary of any residential zoning district". Safeway Inc, respectfully requests that
Code section 5.1.Q.4.a be waived for the development of the proposed Safeway Fuel
Facility.
Background Information
The proposed Safeway Fuel Facility site, Lot 1 Silver Lane Stables Addition, is zoned
CO: Outlying Commercial and "Vehicle Service, Limited — Service Station" and "Vehicle
Service, Limited — Car Wash" are uses permitted by right within the CO zone.

The abutting property to the north of the proposed Safeway Fuel Facility is identified as
Lot G of the Stanley Hills Subdivision and is currently zoned Residential. The recorded
plat for Lot G states that "open space lot g' to be held for future dedicated roadway —
0.625 acres".
Proposed Safeway Fuel Facility building/structure setbacks as measured from the north
property line of Lot 1 Silver Lane Stables Addition:
• 56' at canopy, 90' at future car wash, 138' at kiosk/convenience store
Variance Justification
Based on the variance review standards from the "Estes Valley Development Code"
(section 3.6.C) the applicant offers the following:
1. The fact that abutting Lot G of the Stanley Hills Subdivision is intended for future
roadway dedication but is zoned Residential is a special circumstance that results in
practical difficulty for the development of a fuel facility on Lot 1 Silver Lane Stables
Addition.
2. Factors relating to the "practical difficulty" described above are:
a. without a variance, the development of a modern fueling facility meeting market
demands and expectations on the subject property will not be possible
b. due to the fact that the adjacent Lot G of the Stanley Hills Subdivision is intended
for future roadway dedication, the requested variance is minor in nature
c. the essential character of the neighborhood will not be altered and adjoining
properties will not suffer a substantial detriment as a result of the variance
d. the delivery of public services such as water and sewer will not be adversely
affected by the variance
e. this issue will need to be resolved prior to Safeway Inc. purchasing the property
f. Town staff has identified a variance as the preferred means of mitigating the
Applicant's predicament
3. The circumstances affecting the subject property are a unique situation.
4. The requested variance will not result in the reduction of any lot sizes nor an increase
in the number of lots.
5. If authorized, this variance will represent the least deviation from the regulations that
will afford relief.
6. The proposed uses are permitted within the CO zone district and this variance
addresses the 100' separation requirement only.
7. The applicant recognizes that the BOA may require certain conditions of approval if
needed.

3. Schools and Day Care Centers as Accessory Uses:
a. Special review shall be required when a religious assembly use includes a school or
day care facility.
b. Accessory schools and day care centers must comply with the specific use standards
in §5.1.F. (Ord. 6-06 §1)
P. Resort Lodge/Cabins. A guest room or unit contained in a resort lodge/cabin
accommodations use may contain full kitchen facilities instead of the otherwise required
"limited kitchen facilities" (see definition of "guest room" in §13.3), provided that the following
conditions are satisfied:
1. The guest room/unit is contained in a freestanding, detached "cabin" structure, and such
structure contains no more than four (4) such guest rooms/units.
2. For purposes of permitted density/intensity calculations, all guest rooms/units with full
kitchen facilities shall comply with a minimum five -thousand -four -hundred -square -foot land
area per unit requirement, in lieu of the one -thousand -eight -hundred -square -foot
requirement for accommodations units set forth in Table 4-5 of this Code,
Q. Vehicle Services, Limited. All service stations, car washes and quick lubrication service
uses shall be subject to the following standards:
1. Minimum Separation. Such uses shall be located at least five hundred (500) feet from
schools and day care uses, as measured from the outer boundaries of the sites.
2. Site Layout. Conditions of development plan approval may require buffering, screening or
planting areas necessary to avoid adverse impacts on properties in the surrounding areas.
3. Storage and Accessory Sales of Materials and Equipment.
a. No outdoor displays of materials or equipment shall be allowed, except that a display
rack for automobile products no more than four (4) feet wide may be maintained
within three (3) feet of the principal building, subject to a limit of one (1) such display
rack per street frontage.
b. Storage of unlicensed or inoperable vehicles shall be prohibited.
4. Specific Standards for Service Stations and Quick Lubrication Services.
a. The use shall be located at least one hundred (100) feet from the property boundary
of any residential zoning district,
b. All minor repair work, vehicle washing, lubrication and installation of parts and
accessories shall be wholly performed within an enclosed structure.
c. All automobile parts, dismantled vehicles and similar materials shall be stored within
an enclosed building or totally screened from view by a solid or privacy fence. A
chain link fence with slats shall not constitute acceptable screening or fencing for the
purposes of this provision.
d. All vehicles awaiting repair or service shall be stored on site in approved parking
spaces and under no circumstances shall such vehicles be stored on or obstruct
access to a public right-of-way.
