RECORD OF PROCEEDINGS ✓Public Safety Committee July 28, 1988 Committee: Attending: Also Attending: Absent: Chairman Garrett, Trustees Aldrich and Dickinson Chairman Garrett, Trustee Dickinson Mayor Dannels, Town Administrator Klaphake, Police Chief Racine, Fire Chief Rumley, Finance Officer Vavra, Clerk O'Connor Trustee Aldrich Chairman Garrett called the meeting of the Public Safety Commit- tee to order at 2:00 P.M. PROPOSED ORDINANCE - RECREATION VEHICLES. Police Chief Racine stated Chapter 10.16 of the Municipal Code contained language preventing the parking of recreation vehicles for periods of greater than 18 hours and which were used for living or sleeping purposes. A campground was recently annexed and the Committee reviewed an amendment to Section 10.16.010 - Regulations, which adds the following paragraph: C. Any recreational vehicle or travel trailer, as the same are defined in Section 17.08.030, may be parked for a period of greater than 18 consecutive hours and used for living or sleeping purposes in any recreational vehicle park approved pursuant to the provisions of Chapter 17.32 of the Municipal Code. Chief Racine confirmed Town Attorney White had prepared the proposed amendment to the ordinance. The Committee recommends approval of the ordinance. PROPOSED "OPEN BURNING" ORDINANCE - DISCUSSION. The Committee reviewed an ordinance regulating open burning and burning of garbage, waste and trash which was prepared by Town Attorney White. The proposed ordinance would amend Chapter 8.04 of the Municipal Code by adding Section 8.040.075--Open Burning Prohibited; the following sources of open burning would be exempted from obtaining an open burning permit from Larimer County: A. Open fires used for the non-commercial cooking of food for human beings. B. Flares to indicate some danger to the public. The Committee discussed the possibility of requiring "fire rings" or "approved containers" for open fires, and directed Fire Chief Rumley to contact Town Attorney White for additional review. Following review by Town Attorney White, the proposed ordinance is to be resubmitted to the Committee. ESTES PARK VOLUNTEER FIRE DEPARTMENT. Litigation. Town Administrator Klaphake advised he could, in open session, report on the nature of litigation with regard to a claim filed by Elizabeth English against Fire Chief Rumley and the Fire Department; however, the Committee was requested to safeguard their inquiries and discussion. On November 25, 1986, while standing in the waiting area in front of the door to the BRADFORD PUBLISHING CO. RECORD OF PROCEEDINGS Public Safety Committee - July 28, 1988 - Page two Fire Station, Ms. English was possibly involved in an accident. Ms. English claims she was struck in the back when the door was opened, and she has filed 4 claims, 3 of which are for at least $150,000/each, plus $100,000 in actual damages, at least $100,000 in punitive damages, plus attorney's fees, etc. Pursuant to the Governmental Immunity Act, the Town maintains a statutory maximum liability coverage of $150,000. As a general practice, Punitive Damage Coverage is not provided. The possibility of an excess judgement exists; CIRSA coverage would cease, and Chief Rumley would be responsible for paying punitive damages. The Committee assured Chief Rumley the Town would defend him in this claim as he was acting in his official capacity as Fire Chief. Administrator Klaphake reported that in the future, both he and Town Attorney White would prepare a document stating the Town's policy with regard to supporting staff while acting on the Town's behalf. REPORTS. The Committee reviewed the Activity Report, Shift Commander's Report and Training Summaries for June. Chairman Garrett stated she had received complaints regarding the inaccessibility to #911. Pursuant to the request of Chairman Garrett, Chief Racine investigated said access. Mountain Bell has verified their telephone line is in proper working order. Executone will test their equipment and replace any deficiencies as soon as possible.
