Police Chief Banks, Sgt. Janousek, Town Clerk Hill
Police Chief Banks reported on his recent attendance at the National
Association of Chiefs of Police in Kansas City.
Chief Banks reported Officer Turner has twice made very effective use of
his gas gun this past summer season.
Chief Banks submitted a Police Arrest Report covering the period of time
beginning January 1, 1967 through September 20, 1967. A copy of this re-
port is attached to the minutes.
The Police Committee reviewed the delinquent occupation tax and amusement
licenses. After a short discussion, the Committee recommends to the Board
of Trustees that citations be issued immediately for all delinquent oc-
cupation tax licenses and amusement licenses. Town Attorney Hartwell was
instructed to prepare the necessary citations.
The Police Committee reviewed the new forms suggested by the Town Attorney
to be used for new liquor license applications. The Committee recommends
the forms, as prepared, be adopted and used for all future liquor license
applicants. A copy of these forms are attached to and made a part of these
minutes.
Chairman Petrocine reported Postmaster George Peck has submitted a request
to have the Police Department lock the Post Office each night at 9:00 P.M.
After a short discussion, the Police Committee denied this request.
The Police Committee instructed the Town Clerk to contact County Commissioner
Warren Wolaver for the purpose of submitting a request to the County Com-
missioners for financial assistance in the construction of the Animal
Shelter (Dog Pound).
There being no further business, the meeting adjourned.

II. TWO YEAR LIMITATION:

and Articles of Incorporation if applicant
will do business as such an entity.
IV. INITIAL APPEARANCE BEFORE BOARD OF TRUSTEES
DATE OF INITIAL HEARING:
A. The applicant or his duly authorized represen-
tative shall be present.

B. The Board of Trustees will, by resolution,
establish that the filing date of the
application shall be the date of the initial
hearing.
C. The Board of Trustees will, by resolution,
set the neighborhood boundaries.
D. The Board of Trustees will, by resolution,
set the date of the Public Hearing. (Not
less than thirty (30) days from initial
hearing)
E. Applicant shall furnish detailed survey map
if the building in which liquor is sold is
within 500 feet of any public or parochial
school showing by direct measurement from
nearest property line of land used for the
school to the nearest portion of said building,
using a route of direct pedestrian access.
V. EVIDENCE OF PUBLIC NOTICE
A. The Town will post a sign of the public hearing
in a conspicuous place on the premises and pub-
lish in a newspaper a notice of the public
hearing at least ten (10) days before said
public hearing.

INSTRUCTIONS
FOR
NEW LICENSE APPLICATIONS
1. Licenses to be covered by these instructions are for new
licenses for retail liquor stores, liquor licensed drug stores,
beer and wine licenses, hotel and restaurant licenses and club
license.
2. No application shall be received or acted upon if any one
of the following situations apply:
A. Within two (2) years preceding the date of the
application, the licensing authority has denied an
application at the same location for the reason
that the reasonable requirements of the neighborhood
were satisfied by the existing outlets.
B. Until it is established that the applicant is or
will be entitled to possession of the premises for
which application is made; or, the applicant owns
said premises.
C. Where the zoning code of the Town of Estes Park
does not permit the sale of liquor as contemplated
at the location set forth in the application.
D. Where the building in which liquor is to be sold
is located within 500 feet of any public or parochial
school or the principal campus of any college, univer-
sity or seminary, said distance to be computed by
direct measurement from the nearest property line of
the land used for school purposes to the nearest
portion of the building in which liquor is to be sold,
using a route of direct pedestrian access.
3. The application for said license shall be on such forms
as are furnished by the Town Clerk, shall be completed in their
entirety, and shall be properly verified by the person or persons
making said application. Each application shall be accompanied
by a certified check, bank money order or cashier's check in the
sum of Three Hundred Dollars ($300.00), which shall be used by
the Town of Estes Park to defray the expenses incurred in its
investigation and hearing of the application; as well as the
expenses involved in publishing and posting of the required
notices. Each application shall also be accompanied by a certified
check, bank money order or cashier's check for the amount of the
license fees for state and town licenses and the Town occupation
tax. Character references for each individual, partner, officer
and manager, together with three

for each of said individuals, shall accompany reach eapplication.
Complete plans, drawn to scale, and specifications for the interior
of the building shall be submitted with the application. If the
building is not in existence, the applicant shall, in addition to
the said plans and specifications, submit an architect's drawing
of the building to be constructed.
4. The application shall be filed with the Town Clerk in
duplicate and on receipt of the application, the Town Clerk shall
place it on the agenda for the next regular Board meeting after
filing for preliminary hearing.

5. At the preliminary hearing on the application, the Board
of Trustees will establish, by resolution, the filing date of the
application to be the date of the initial hearing; the Board will
also set the neighborhood boundaries and the date of the public
hearing on the application, which hearing shall be not less than
thirty (30) days nor more than ninety (90) days from the filing
date of the application, and the Board of Trustees shall post
and publish a notice thereof. Posting shall be in a conspicuous
place on the premises for which the application shall have been
made and publication shall be in a newspaper of general circulation
in the Town of Estes Park.
6. Not less than five (5) days prior to the date of hearing
the Town of Estes Park shall make known its findings of its
investigation in writing to the applicant and other interested
parties.
7. The decision of the Board of Trustees of the Town of
Estes Park, approving or denying the application, shall be in
writing, stating its reasons therefor, within thirty (30) days
after the date of public hearing; and a copy of such decision
shall be sent by certified mail to the applicant.
8. No license shall be issued by the Town of Estes Park after
approval of an application until the building in which the business
is to be conducted is ready for occupancy in such a manner as to
comply with all of the provisions of the City and State Building
and Liquor Laws and Regulations; and in particular, only after
inspection reveals that the applicant has complied with the
architect's drawing and the plans and specifications as submitted
with the application.
9. After approval of any application, the Town of Estes Park
shall notify the State Licensing Authority of such approval, who
will then investigate and either approve or disapprove such
application.
10. No portion of the fee accompanying the application shall
be returned to the applicant.
11. The applicant or his duly authorized representative shall
be present at the preliminary and public hearings. Failure to
appear can result in a denial of the application.
12. At the public hearing, any party in interest shall be
allowed to present evidence and to cross-examine witnesses. The
local licensing authority may, in its discretion, limit the
presentation of evidence and cross-examination so as to prevent
repetitive and cumulative evidence or examination.
