Police Committee Meeting
June 13, 1968

Also attending: Chief W. E. Banks, Town Clerk Dale G. Hill
Reverend Rex Roth, Director of the Covenant Heights Bible Camp, appeared
before the Committee to discuss his request to operate a horse drawn
trolley in Estes Park. After considerable discussion the Committee re-
commends the Board of Trustee allow Reverend Roth's request. The Police
Chief shall have complete authority to discontinue or change the route
of travel. The Committee will submit their approval to the State
Hiway Department. The State Hiway Department must approve any use
allowed that will effect the State Hiway in Estes Park.
Chief Banks reported he has conducted a department schooling session
for the new police officers.
Municipal Judge Wilson and Court Clerk Fonda are authorized to attend
the municipal court session at the Colorado Municipal League in Colorado
Springs on June 19, 1968. Expenses for travel and meals will be allowed.
The Committee discussed the dog ordinance. It was the opinion of the
Committee that the enforcement was very satisfactory and that it should
continue with special emphasis during the fall season when school opens.
The Committee discussed a letter from Robert Altick to the Estes Park
Chamber of Commerce in regard to occupation licenses.
A legal opinion dated June 10, 1968 in regard to occupation licenses,
was discussed.
There being no further business, the meeting adjourned.

Dear Mr. Hill:
I am writing in reply to your request for my opinion as to
whether or not firms doing business in Estes Park in the manner
of such firms as Montgomery Ward and Sears, Roebuck and Company
can be required to obtain a license as required by Section 4.3
of the Municipal Code.
You are advised that it is my opinion that firms doing
business in Estes Park in the manner of such firms as Montgomery
Ward and Sears, Roebuck and Company cannot be required to obtain
a license under the provisions of Section 34.3. A distinction
between the manner in which Montgomery Ward and Sears, Roebuck
and Company do business must be made with the firms such as the
bread companies. The latter companies personally solicit business,
make sales and deliver the goods in Estes Park whereas the former
companies do not solicit business nor make the sales in Estes Park
but merely deliver merchandise which has been either ordered by
phone or mail in other cities.
The Colorado statute authorizing Estes Park to levy an occu-
pation tax and the Court decisions pertaining to occupation taxes
do not, in my opinion, permit Estes Park to require licenses of
those firms doing business in Estes Park in the manner of such
firms as Montgomery Ward and Sears, Roebuck and Company.
If you have any further questions concerning this matter,
please advise me.

'At our bast regular Board meeting it was agreed to consider only..written complaints
sohere is problably your first one, submitted in the hope that it may lead to
a correction of similar situations I have had to deal with in the past.

It is my understanding that last month the Manager purchased 40 quire(960)
mimeo stencils from Bachmans of Greeley at a cost of $144.20. an told that
Bachmans is not a member, of:the the Chamber_ and does not _have a- Town occupational
licenses... a fee which formerly supported the Chamber's advertising program.
Believe use, $iU, the small profit involved in this transaction is not the
matter of primary importance, but rather the question of why Altiek Stationery
was not asked to bid on an order of this size. I feel that the Chamber' s first
consideration should be to promote local business and that it should be an
automatic. reaction ofthe'Manager to think"/8 there any:local business that
.could be benefited?"
This order figures out to be.$3.50 per quire:and I can provide stencils in this
quantity at as low as $1.60=per:'quirel" The very finest stencils would not run
over $2.75 per quire, So in addition to sendin money out of town we have
sent almost one menber's annual dues down the drain. Is this sound, professional
management?
You trill recall that at the regular -board mooting .I asked Ken .Brown the amount
of. this chock and he advised it was'$144.20. I, was. aware of this purchase at
that time but did notmakean issue of tho fact'as I did not want to interject
a personal note in view of'what was coming up_later'on. I thought some member
might have inquired as to. zrhy• this amount was net authorized prior to comnittment
since.it is over $50.00.
Since I have had to submit this Complaint. in'uritihg to the Board I ask that
their answer to me also be in.writing so.that I will.have an exact =planation
of their handling of the complaint and what steps have been taken to prevent
sir&ar reoccurrences.
