Police Committee Meeting
December 11, 1968

Absent: Trustee Swanson
The Police Committee instructed Chief Banks to provide the necessary
equipment and enforce the ordinance pertaining to dogs.
Chief Banks presented a report on tickets issued by individual members
of the Police Department through December 1, 1968.
The Committee discussed the use of a teen age jury in the Estes Park
Municipal Court.
The Committee discussed a policy of more strict enforcement of traffic
laws.
Chief Banks announced Police Officer Ken Curtis terminates as of Dec-
ember 21, 1968.
The Committee discussed the starting salary scale for new police officers
and its effect in hiring new officers.
The Committee instructed the department to place a traffic officer at
the Community Church each Sunday between the hours of 10:30 and 11:00
A. M.
Chief Banks informed the Committee that Mr. Moore's final appearance in
County Court s egarding the calf shooting incident will be December 27,
1968. Restitution to Miss McGregor must be made prior to this date.
There being no further business, the meeting adjourned.

The Committee discussed at length the advantages and disadvantages incurred
in changing the Policemen's Pension Plan from the present non-contributory
plan to the contributory plan. Copies of documents prepared for the
Committee are attached as follows:

Paid policemen of regularly organized and
paid police departments, local marshals.
Police duties must require 80% or more of
their time.
III. Benefits
A. Retirement for Member sixty years of age with twenty years
age of service in Colorado is entitled to a
monthly pension equal to one-half of the
amount of the average salary for one year
before the granting of application for re-
tirement. Acceptance of a salaried posi-
tion paying $60 or more a month will re-
sult in the suspension of the pension dur-
ing the period such job is held.

Monthly pension equal to monthly salary
at date of disability, not to exceed one
year. Disability must be incurred while
in the performance of duty.
Widow or dependent mother - $30 per month
on the death of an officer. No pension
shall be paid to the mother of a deceased
member who leaves a widow. If a widow of
a deceased member remarries the pension
terminates.. _
Children - if a deceased officer leaves
dependent children, each child will re-
ceive $6 per month until age 16.
NOTE: If the fund is insufficient to
cover the benefits listed above propor-
tionate shares will be granted each
claimant until the fund becomes solvent.
State - $600,000 from the revenues de-
rived from the tax imposed on the premiums
collected from foreign or alien insurance
companies will be deposited. in the fund.
The money from the state will be divided
among the police pension funds propor-
tionately according to the ratio of the
number of paid policemen in the municipa-
lity covered by the fund to the total
number of paid policemen covered by the
statute in the state.
Other: 50 per cent of any fine collected
by any court within the municipalities
coming under this provision shall go into
the policemen's pension fund. Donations,
grants, bequests, etc. to the policemen's
pension fund. Money, fees, rewards, etc.
paid to the members or departments will
go into the fund.

VI. Investment of Funds
Will consist of the municipal treasurer,
the mayor, municipal clerk and one elec-
ted member of the police force. The mu-
nicipal treasurer in the municipality
will be responsible for the funds. The
board of trustees of the fund must report.
semiannually to the council of the mu-
nicipality onthe condition of the fund.
0n the decision of the board of trustees
of the fund the money in the fund may be
invested in interest bearing bonds of
the United States, state of Colorado, or
any incorporated city, county or school
district of the state of Colorado.
EXCEPTION: Cities with population under 50,000 - municipality
contriibauting to the fund.

Member 55 years of age with 20 years of
service in Colorado or 25 years of ser-
vice in Colorado at any age is entitled
to a monthly pension equal to one-half
the amount of the average salary for one
year before the granting of the applica-
tion for retirement, regardless of other
income or earnings or sources of that
income.
One-half of monthly salary at time of
disability.
Monthly pension equal to monthly salary
at date of disability, not to exceed one
year. Disability must be incurred while
in the performance of duty.
Widow or dependent mother - monthly pay-
ment of of the monthly salary of the
member when he died. No pension shall
be paid to a mother of a deceased mem-
ber who leaves a widow. If a widow re-
marries, her pension terminates.
Children - a monthly payment of 1/8 of
the monthly salary of the deceased mem-
ber at time of death to each child until
the age of 16.
NOTE: If the fund is insufficient to
cover the benefits listed above propor-
tionate shares will be granted each
claimant until the fund becomes solvent.
Municipalities, population under 50,000 -
the city may elect to contribute from
the general fund an amount not to exceed
a sum equal to 5 per cent of the total
salaries paid to the police force. In
municipalities making such a contribu-
tion, the officers on the force must
match the city contribution with an
identical amount by contribution up to
5 per cent monthly from their salaries.
CURRENT BENEFITS: "Workmen's Compensation" 3
The weekly compensation payment is based on 66 2/3 of as
injured employees salary. The maximum weekly benefit is
$54.25. .In order to qualify for maximum weekly compensation
benefits, an employee would have to earn *81.38 per week or
more. The minimum weekly compensation benefit is $13.03.
Compensation shall be payable as wages upon the 15th•day
after the insured person leaves work and, thereafter,
regularly but not less frequently than once in each calendar
month. There is no payment for the first seven days from
the date of the accident, unless the'disability lasts longer
than three weeks (22 days), in which event compensation shall
be paid retro-active from the day the injured employee leaves
work.

Death benefits are payable only to the dependents of the de-
ceased and not to an estate.
Detailed information:on the benefits under the Colorado Occu-
pational Disease Law, as well as the Colorado Workmen's Comp-
ensation Law may be obtained by writing to the Industrial
Commission of Colorado and enclosing $2.00 to cover the cost
of the booklet.

PROPOSED LEGISLATION ON
POLICEMEN'S PENSION LAW FOR
Cities under 100,000
All pension funds (money) in the State will be placed in a central fund.
A management committee elected by the members will manage the fund as to
investments. The fund will be able to invest up to 507.'of its assets in
stocks.
Each city will have its own Policemen's Pension Board consisting of:.
Mayor or Manager, Treasurer and three members of the Police Department.
Death and disability payments will be by insurance. Each city's fund
will be assessed in relation to the number of persons insured. Benefit
is: on duty 507. FAS; off duty 23/4% per year.
Age and service payments will be authorized by the local board.
Benefits: (25 years service at age 55)
27. per year x 25 years = 507. of F.A.S.
1% additional pension per year of service
up to 60% F.A.S.
Funding: First two years:
City: k mills (now $3,000)
State: 1007. matching of cities share
Employee: 6% of salary
Second and succeeding years:
City: (amount determined by acturial study)
State: Match cities share up to one mill
Employee: 67.
