WHYTE APPEAL: Chairman Byron L. Graves stated that he had reviewed the case history of Howard A. Whyte. Trustees Robert E. Wagner and Richard A. Wood also stated that they had reviewed the case history of Howard A. Whyte. Mr. Whyte was represented by his attorney, Craig L. Truman. Mr. Truman cross examined Police Chief Robert Ault and Town Administrator Dale Hill, both of whom had thoroughly reviewed Mr. Whyte's case history. Mr. Truman then called a witness, Mr. 0. Kenneth Alford, a Counseling Therapist who is treating Howard Whyte. Mr. Craig Truman then gave his closing statements. Chairman Byron L. Graves indicated that the Committee would be making a decision and notifying Mr. Whyte in writing. Chairman Byron L. Graves declared the hearing closed. Following the hearing the Committee met and made its decision regarding the appeal. Said decision is attached to and incorporated in these minutes. Ann E. ( Ulmad V,05li September 14, 1982 This is notification to you of the decision of the Public Safety Committee of the Town of Estes Park with regard to your appeal of the actions of Robert Ault, Chief of Police in termination of your employment as Police Officer on July 17, 1982, and the decision of Dale G. Hill, Town Administrator, affirming Chief Ault's termination of your employment. As is called for in the Town of Estes Park Personnel Policy, a hearing was held on August 26, 1982, at 2:00 P.M. before the Public Safety Committee of the Town of Estes Park. The decision of the Committee is based upon review of your personnel file and the evidence presented at said hearing. It is the decision of the Public Safety Committee to affirm the actions taken by Chief Ault in your termination. The -Committee specifically finds that your actions of May, 1982, in the use of a revolver during a marital dispute exhibits behavior that is sufficient for termination of your employment as Police Officer. Said conduct is unacceptable to the position of Police Officer of the Town of Estes Park. Also, the Committee further notes that your personnel file indicates other indications of temper control problems leading to friction within the department. -Therefore, please be advised that the Public Safety Committee of the Town of Estes Park hereby affirms the decision of Chief Ault to terminate your employment as a Police Officer with the Town.
