STATUS OF THE POLICE AND FIREMEN'S PENSION FUNDS:
Town Attorney, Gregory A. White, appeared before the Committee to report
on the status of the Police and Firemen's Pension Funds. Attorney
White reported that Estes Park is currently under the old state
pension fund and is in a unique situation because it offers Social
Security coverage which exempts the Police and Firemen's Pension Funds
from many of the basic state laws. The new state Fire and Police
Protection Association will be sending the Town an actuarial study
which will give the rates to affiliate with the new state plan
(FPPA). Attorney White also reported that the present state law
concerning Police and Pension Funds is ambiguous and there is
legislation to amend Section 8 of the Colorado State Statutes which
would lift the moratorium on the Police and Firemen's Pension Funds.
This would allow municipalities to look at private money purchase
insurance Plans rather than go through the Fire and Police Protection
Association. If the Town were to affiliate with FPPA, the police
employees would not get both Social Security and FPPA death and
disability benefits. FPPA also determines the percentage of
contributions based upon their actuarial study. Attorney White
stated that the Committee has four options (1) to do nothing and
retain the present plan; (2) wait to see if the legislation passes
and then make a decision; (3) buy the alternative insurance plan;
or (4) affiliate with FPPA. Chief Ault requested that some guidelines
be established in order to keep the Committee informed of what is
going on concerning the pension funds. The Committee recommends
that Lt. Elste draw up these guidelines with the assistance of Town
Administrator Hill and Attorney Gregory White. The Committee also
recommends waiting to see if the legislation to amend Section 8
passes, and then make a decision on the pension funds at that time.
There being no further business, the meeting adjourned.
