Dear Mr. and Mrs. Sykora and Mr. Richardson:
Thank you forcontacting our office about the accessory building at the above-referenced
propertythat is currently being used as a detached accessory dwelling unit(guest house).Town
records listthis accessorybuilding as a detached garage.We have no record of this building
being legally converted to an accessory dwelling unit(guest house).
We request that you, as the property owner, submit any information you have demonstrating
that the building was legally converted to an accessory dwelling unit by July 2, 2007for our
review.This needs to include, in writing, the date the garage was converted to an accessory
dwelling unit and a list of contractors that completed the work. If staff determines there is
insufficient information to demonstratethat the building was legally converted to an accessory
dwelling unit(for example, the work was completed with a building permit and in compliance
with the applicable zoning regulations), you will need to convertthe building back to a legal
use such as agarage or storage building.Demolition and/or construction requiresaTown
building permit.Demolition also requires a State demolition permit.
Staff has basedourdetermination that the accessory building is alegally permitted garage, not
an accessory dwelling unit, on the following information:
1.Building Permit #3773, dated August 26, 1985 for a “garage roof restructure”for an
approximately thirty-foot-wide by twenty-eight-foot-longdetached garage.
2.Building Permit #7847, dated June 1, 2005 to build a wood-working shed. The site plan
attached to this building permitdescribes the detached building in question as a garage.
3.A conversation with the Estes Park Sanitation District (EPSD) on June 18, 2007 in which
EPSD stated they have no record of permits or fees paid for plumbing in the detached
building and no record of an accessory dwelling unit.

Larimer CountyTax Assessor records currently list this building as an “Additional Residence.”
Staff contacted the Tax Assessors’office on June 18, 2007 and they stated their records show
that the building used to be listed asa garage. They did not have a record of when theychanged
the listing to “Additional Residence.”Larimer County records are not considered proof that the
building was legally converted to an accessory dwelling unit.
Please note that zoning regulations have not permitted detached accessory dwelling unitson
this lot since at least 1972.Since 2000 this lot has been zoned “E” Estate,anddetached
accessory dwelling units arenotpermitted in this or any residential zoning districtwithin the
Estes Valley. Our 1989, 1992,and 1995 zoning maps show this lot as zoned “R-S” Residential,
and detached accessory-dwelling units, thendefined as “guest houses,”were not permitted in
this zoning district. Our 1974, 1980, and 1984 zoning maps and our 1972 Municipal Code list
this property aszoned “R-1”Residential,and guest houses were not permitted in this zoning
district.
